RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
PROPOSED EXCHANGE AGREEMENT AND ASSIGNMENT OF
OFFER TO BUY REAL ESTATE AND ACCEPTANCE WITH
L & H FARMS, LTD. OF WATERLOO, IOWA, FOR THE
ACQUISITION OF PROPERTY IN BLACK HAWK COUNTY
FOR EXCHANGE OF PROPERTY IN THE SAN MARNAN
TIF DISTRICT IN THE AMOUNT OF $461,290.00 FOR
10.156 ACRES OF LAND IN NOVEMBER, 2013 AND
$395,846.00 FOR 8.175 ACRES OF LAND IN MARCH,
2014 AND AN OPTION EXCHANGE AGREEMENT, AS
OCTOBER 21, 2013, AT 5:30 P.M. IN CITY HALL
COUNCIL CHAMBERS, WATERLOO, IOWA AND
INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of
Waterloo, Iowa at 5:30 p.m. on the 21St day of October, 2013, for
the purpose of considering and acting upon a proposed Exchange
Agreement and Assignment of Offer to Buy Real Estate and
Acceptance with L & H Farms, Ltd. of Waterloo, Iowa, for the
acquisition of property in Black Hawk County for exchange of
property in the San Marnan TIF District in the amount of
$461,290.00 for 10.156 acres of land in November, 2013 and
$395,846.00 for 8.175 acres of land in March, 2014 and an Option
Exchange Agreement, and legally described as follows:
November Acquisition
The Southeast Quarter of the Southeast Quarter (SE ka SE
1-4) of Section 10, Township 87 North, Range 14 West of
the 5th P.M. in Black Hawk County, Iowa, except the
highway and adjoining public right of way (32.6
tillable acres, more or less).
AND
The Southwest Quarter of the Southeast Quarter (SW 1-4 SE
-1-4,) of Section 10, Township 87 North, Range 14 West of
the 5th P.M. in Black Hawk County, Iowa, except the
highway and adjoining public right of way (37.3
tillable acres, more or less).
Section 2. That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
