RESOLUTION NO. 2013-801 RESOLUTION ACCEPTING AND APPROVING PROJECT COOPERATION AND TEMPORARY AND PERMANENT EASEMENT AGREEMENT WITH SOUTH VIEW ASSOCIATES, LLC AND DIRECTING EXECUTION OF SAID AGREEMENT BY MAYOR. WHEREAS, the Project Cooperation and Temporary and Permanent Easement Agreement for the hereinafter described parcels is to allow for the construction of a new lift station on South View Associate's property located at 3451 East Orange Road and connection of the lift station to City sewer lines, legally described as follows: Temporary Easement For pump station and force main situated in part of the Southeast of Section 18 Township 88 North, Range 12 West of the 5th Principal Meridian, City of Waterloo, County of Black Hawk, State of Iowa. Containing 9,387 square feet or 0.21 acre. Permanent Easement A parcel of land situated in part of the Southeast of Section 18, Township 88 North, Range 12 West of the 5th Principal Meridian, City of Waterloo, County of Black Hawk, State of Iowa, described as follows: Commencing at the South k corner of said Section 18; thence South 89° (Degrees) 49' (Minutes) 42" (Seconds) East (assumed bearing for the purpose of this description) on the South line of the Southeast of said Section 18, a distance of 741.84 feet; thence North 00°10'18" West, 78.75 feet to the present Northerly right-of-way line of East Orange Road, being the point of beginning of the parcel of land herein described; thence Northeasterly on a 68.00 -foot radius curve concave Southeasterly and having a 69.02 -foot long chord bearing North 33°52'40" East, 72.39 feet (arc length); thence North 64°22'54" East, 109.70 feet; thence South 25°37'15" East, 27.00 feet; thence North 64°22'45" East, 113.60 feet; thence North 19°22'45" East, 20.70 feet; thence North 36°52'11" West, 575.42 feet; thence North 08°07'39" East, 13.74 feet to the present Southwesterly right-of-way line of La Porte Road; thence South 42°30'07" East on the present Southwesterly right-of-way line of La Porte Road, 192.93 feet; thence South 36°47'42" East on the present Southwesterly right-of-way line of La Porte Road, 446.15 feet (445.96 feet record) to the present Northerly right-of-way line of East Orange Road; Resolution No. 2013-801 Page 2 thence South 53°12'23" West on the present Northerly right-of-way line of East Orange Road, 60.04 feet (60.20 feet record); thence South 71°41'42" West on the present Northerly right-of-way line of East Orange Road, 278.64 feet to the point of beginning. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Project Cooperation and Temporary and Permanent Easement Agreement, by and between South View Associates, LLC and the City of Waterloo, Iowa, is accepted and approved, and the Mayor and City Clerk authorized to execute the same in behalf of the City of Waterloo, Iowa.
