RESOLUTION NO. 2013-802 RESOLUTION APPROVING TEMPORARY AND PERMANENT EASEMENT AGREEMENT WITH BROADWAY LIMITED, LC AND DIRECTING EXECUTION OF SAID AGREEMENT BY MAYOR. WHEREAS, the Temporary and Permanent Easement Agreement for the hereinafter described parcels is to allow for the construction of a new sanitary sewer line on property owned by Broadway Limited, LC located at 1750 Broadway Street: Temporary Easement A parcel of land situated in part of the Southwest k of Section 10, Township 89 North, Range 13 West of the 5th Principal Meridian, City of Waterloo, County of Black Hawk, State of Iowa, described as follows: Commencing at the Northeast corner of the Southwest k of said Section 10; thence South 88° (Degrees) 25' (Minutes) 54" (Seconds) West (assumed bearing for the purpose of this description) on the North line of the Southwest k of said Section 10, a distance of 1656.15 feet to Northeasterly right-of-way line of the Canadian National Railroad; thence South 49°15'13" East on said Northeasterly right-of-way line, 790.42 feet to the Northwesterly line of the parcel of land described in City Lot Deed Book 645, Page 416 and recorded in the office of the Black Hawk County Recorder, being the point of beginning of the parcel of land herein described; thence North 46°52'03" East on said Northwesterly line, 70.40 feet; thence South 49°15'13" East, 281.24 feet; thence South 44°57'42" East, 200.50 feet; thence South 49°15'13" East, 42.94 feet; thence South 40°09'09" West, 16.52 feet; thence South 49°34'32" East, 109.50 feet; thence North 36°51'13" East, 15.94 feet; thence South 49°15'13" East, 445.59 feet; thence South 57°16'11" East, 130.36 feet; thence North 89°31'47" East, 113.85 feet to the East line of the Southwest of said Section 10; thence South 01°07'04" East on said East line, 199.00 feet to the Northeasterly right-of-way line of the Canadian National Railroad; thence North 49°15'13" West on said Northeasterly right-of-way line, 1433.34 feet to the point of beginning.
