RESOLUTION NO. 2026-523
RESOLUTION APPROVING ACKNOWLEDGMENT/SETTLEMENT
AGREEMENT FOR TOBACCO VIOLATION -2ND OFFENSE WITH
NEIGHBORHOOD MART, 2100 LAFAYETTE STREET,
WATERLOO, IOWA, AND ACCEPTANCE OF A CIVIL PENALTY
IN THE AMOUNT OF $1,500.00, AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT.
WHEREAS, Neighborhood Mart, located at 2100 Lafayette Street, Waterloo, Iowa, has
been cited for a second violation of applicable tobacco -control requirements; and
WHEREAS, an Acknowledgment/Settlement Agreement has been prepared to resolve the
matter; and
WHEREAS, pursuant to the terms of the Acknowledgment/Settlement Agreement,
Neighborhood Mart shall pay a civil penalty in the amount of $1,500.00; and
WHEREAS, the City Council finds that approval of the Acknowledgment/Settlement
Agreement and acceptance of the civil penalty are in the best interests of the City of Waterloo.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waterloo,
Iowa, that:
1. The Acknowledgment/Settlement Agreement for a second tobacco violation with
Neighborhood Mart, located at 2100 Lafayette Street, Waterloo, Iowa, is hereby approved.
2. The civil penalty in the amount of $1,500.00 is hereby accepted.
3. The Mayor and City Clerk are authorized and directed to execute said document on
behalf of the City of Waterloo, Iowa.
