In all, 453 outfalls were inspected in Permit Year 12. As in previous years,Engineering Department staff also took pictures of outlets inspected and took notes on their condition. To save storage space on city servers, additional pictures were not taken when the condition of the outfall did not appear to have changed from previous years. All reports are on file in the Engineering Department and are available upon request. This data is encorportated into a GIS database which is shared with our waste management department in an effort to facilitate better management of city drainage infrastructure. The dry-weather outfall inspection form is included in Appendix C. A map of inspected outfalls can be found in Appendix B. The dry-weather inspections will continue for the duration of the permit with inspections conducted on all known outlets as well as additional outlets found or constructed. 2 Illicit Discharge Detection and Elimination: Aside from the sanitary sewer backups and overflows that are recorded by the Waste Management Department, the following illicit discharges were observed or reported to the Engineering Department in permit year 12: Date Location Type of Incident 6-9-2015 Highway 218 and Animal carcass spilled from truck bound for rendering plant Williston 5-11-2015 Holiday Inn Express— Oil leakage from tranformer box Laporte Rd 9-28-2015 Ravenwood Nursing Discharge from previous boring project(oil residue from slip lining Home coming out of ground) 9-3-2015 Autopros Sycamore Discharge from commercial carwashing not properly directed to Street wastewater 6-11-2015 University and Hackett Gravel dust and construction site runoff 8-7-2015 718 Glenwood Street Yard waste dumped in intake 5-26-2015 1299 Scott Avenue Yard waste dumped in intake 6-24-2015 5639 Summerland Oil dumped along stream channel Drive 8-20-2015 Hawkeye Community Concrete washout reaching intake College 6-25-2015 1249 Edgewood Oil sheen in stream channel The appropriate City departments were contacted upon each report. The discharges were tracked to their source, if possible, and the discharger/property owner was notified of the violation and required to make corrections accordingly. Iowa DNR was notified as appropriate. Copies of relevant forms are included in Appendix C. 3. Sanitary Sewer Backups and Overflows Elimination Program: The permittee shall continue to implement a program to document sanitary sewer system backups and overflows which contaminate storm water runoff. The information shall then be used to prioritize sanitary sewer rehabilitation. The program shall be implemented for the duration of the permit. The Sewer Department has submitted a detailed 30-year plan to the Iowa DNR and the United States Environmental Protection Agency(US EPA)on how it plans to deal with and eliminate sanitary sewer backups and overflows. Per requirements from the EPA, Waste Management has an up-to-date database with information on each sanitary overflow and backup occurrence noticed or reported within the City. The top two causes of overflows and backups are water infiltration and sump pump/footing drain connections. The City of Waterloo has begun implementing its plan to disconnect all foundation drains from the sanitary sewer in Sanitary Districts 15 and 16 in an effort to reduce sanitary sewer overflows. The city is assisting with the program by offering a reimbursement of up to $2,000 per disconnection. During Permit 'Th Year 12, $1,222,465.86 was provided for disconnection. The disconnection program for the effective 3 area has a two year timeline. After the two year period has lapsed, no further payments will be rendered and those who have not yet disconnected will begin to receive a fee on their water bill until such time as disconnection is completed. Each year, the City of Waterloo reconstructs portions of the sanitary sewer system in conjunction with the annual street reconstruction program. The street reconstruction project is paid for through a one-cent local option sales tax The following sanitary sewer components were to be reconstructed in the 2015 street reconstruction project, these numbers include work done under fiscal years 2014 and 2015, during permit year 12: Street Reconstruction Sanitary Sewer Bid DESCRIPTION Item DIVISION I BASE BID -SECTION III Total Quantity Unit 4 RECONSTRUCT SANITARY SEWER, 15" 1,078.00 LF 5 RECONSTRUCT SANITARY SEWER, 12" 1,962.00 LF 6 RECONSTRUCT SANITARY SEWER, 10" 78.00 LF 7 RECONSTRUCT SANITARY SEWER, 8" 1,195.50 LF 8 REMOVE AND REPLACE SANITARY SEWER, 8" 7.00 LF 9 SANITARY SEWER SERVICE, 6" 3,009.00 LF 10 STANDARD SANITARY MANHOLE,48" 11.00 EACH 11 STANDARD SANITARY DROP MANHOLE,48" 1.00 EACH 12 REMOVE EXISTING STRUCTURE, SANITARY MANHOLE 14.00 EACH 15 TAP AND COLLAR STRUCTURE OR PIPE 1.00 EACH 16 FURNISH AND INSTALL MANHOLE RING AND COVER 1.00 EACH 18 DYE TEST INVESTIGATION 5.00 EACH 19 UNDERGROUND INVESTIGATION-SANITARY 3.00 EACH 3001 CONSTRUCTION SURVEY- EASTON AVE. The City shall continue with this program in an effort to eliminate not only backups, but to reduce overall system maintenance issues. The City of Waterloo reached an agreement with Iowa DNR and the US EPA for ongoing concerns with sanitary overflow discharges. As part of this agreement, the city is working to complete an environmentally beneficial project in the form of a permeable alley down town. Design work is ongoing and the project construction is anticipated to be completed during Permit Year 13. 4. Storm Drain Labeling: A program shall continue to be developed to label all storm sewer intakes. Approximately 50% of intakes shall have been marked within five years of the issue date of the permit with approximately 5% of the existing intakes and all new intakes as constructed. 4 The labeling shall continue for the duration of the permit and shall be re-applied as needed to maintain legibility. Approximately 9,817 of the roughly 12,000 storm inlets within the City of Waterloo had been labeled as of the end of Year 9. A program was developed to inspect and relabel one zone per year. The inspection and relabeling of inlets will be conducted in this manner as staff time allows. During reporting Year 12, 1,426 inlets were inspected, with their condition being noted in a GIS database. Where necessary, new inlet labels were affixed. A map of the Inlet Inspection Zones, along with the inlets inspected during Reporting Year 12 is included in Appendix B. Labels are provided to contractors rebuilding storm inlets during street overlay and reconstruction projects. Contract specifications call for stamped inlet hoods to be installed when inlets are replaced. Labels are affixed to any inlet casting that is reused.During permit year 12, 121 inlets were labeled/relabeled in this fashion. The goal of the Engineering Department is label all inlets once, then maintain as needed. This program is seen as a perpetual project and shall be carried out for the foreseeable future. Engineering staff has found that approximately 10 percent of each year's application is destroyed by vandalism or snow removal. If noticed,destroyed/removed labels are replaced, but the overall goal is to reach all sections of the city first. Labeling is done through a combination of casting, stencils, and adhesive buttons. The storm sewer inlet labeling program shall continue for the duration of the permit. 5. Wet Weather Storm Water Monitoring: Wet weather monitoring requirement was removed by amendment 3-4-2015 5 Section D - Construction Site Storm Water Runoff Control The permittee shall continue implementing and enforcing a construction site storm water runoff control program to reduce pollutants in any storm water runoff from construction activities for which storm water permit coverage is required and that includes the following: 1. Per the ordinance, City staff conduct pre-and post-construction and complaint driven site inspections, as well as quarterly inspections as mandated by the city's permit. City staff are also entitled by the ordinance to make random inspections. Inspections are currently conducted by the Engineering Department. The Engineering Department added a full time employee in Permit Year 8 to increase the frequency of these inspections as needed. In permit year 12, 943 construction site inspections were completed, resulting in 42 Notice of Violations were submitted for construction sites operating within the boundaries of Waterloo's MS4.Two citations were issued as a result of construction activity inspections. Further, six stop work orders or permit holds were issued. These number reflect only permitted construction sites. In addition, three stop work orders and two Notices of Violation were issued on sites where work was begun without permits, or on sites which did not require erosion control permitting, but where issues were observed requiring special consideration. It should be noted that the information reported above includes weekly inspections of city construction sites performed by city staff members. These numbers include all inspections conducted between April 1, 2015 and March 31,2016. The Engineering Department will continue conducting construction site inspections for the duration of the permit. 3. Sediment and Erosion Control Checklist: A standard checklist that addresses sediment and erosion control items for use prior to construction permits shall be used to assist in educational efforts provided to the public regarding the control methods required prior to commencing construction. The permittee shall then implement the program whenever possible to meet these goals. The program shall be implemented for the duration of the permit. Each year, the city selects a watershed and performs a channel walk and watershed assessment in keeping with a modified version of Iowa Department of Agriculture and Land Stewardship's Rapid Assessment of Stream Condition Along Length. The data collected is then analyzed and combined with GIS assessment of current and future land use. Each watershed assessment is then added to the comprehensive watershed management plan that continues to be developed and amended. 9 During permit year 12,the city inspected Black Hawk and Delane Creek. Channel walks were completed, though GIS inspection of watershed land uses is ongoing. A map showing watershed inspections completed to date is included in Appendix G. Section F- Pollution Prevention/Good Housekeeping: The permittee shall continue implementing an operation and maintenance program, including a training component, that shall prevent or reduce runoff from municipal operations and that shall include the following: 1. Operation and Maintenance of MS4 2. Pesticide and Fertilizer Management Program 3. Training Program for Municipal Employees 4. City Facilities BMPs 1. Operation and Maintenance of MS4: A program for inspecting, maintaining and cleaning all components of the MS4, including street sweeping, shall continue to be implemented. All components of the MS4 shall be inspected at least once every five years and maintenance performed as appropriate. The program shall be implemented for the duration of the permit. The Waste Management Department is tasked with the day-to-day maintenance and operation of the storm sewer and floodgate systems. Estimates of Year 12 maintenance activites are provided below. --- Maintenance and monitoring activities conducted by the Waste Management Department includes the following: Hours Number Footage Storm Line TV'd 545 462 47,425 Storm Line Cleaned 222 138 11,197 Storm Line Repaired 9 1 Inlets Cleaned 1,178 6,497 Inlets Repaired/Replaced 1,297 315 Manholes Cleaned 6 3 Manholes Repaired/Replaced 396 57 Culverts Maintained 172 14 Waterways Maintained 314 5 10 The Waterloo Street Department is in charge of the maintenance and basic repair of the 434 miles of roads(1,200 lane miles)within the city limits. During the non-winter months, this department operates a small fleet of street sweepers to collect as much debris as possible from the streets. Because of the size of the city, it takes the sweepers around 6 to 8 weeks to sweep the entire city. The downtown area is swept every Sunday night. The collected material is deposited into a sweepings dump at the Waste Treatment plant. A summary of sweeping activities is provided below. The Street Department is very cautious about the amount of salt they use, both from an environmental and budgetary standpoint. Currently, the City uses 4,000 to 6,000 tons of salt per season. Direct salt is rarely applied, the bulk being applied in a brine mix. The brine mix is primarily applied to the main streets before snow removal operations begin. The brine helps to prevent the snow from adhering to the pavement, making for easier removal. This allows crews the opportunity to devote more time to other sections of the road system. When salt is used, it is lightly mixed with sand. The salt melts the snow/ice while the sand works into remaining snow pack. The sand trapped in the snow pack acts like sandpaper and aids in traction. Mowing and lawn maintenance for most of the city properties and right-of-way are handled by Leisure Services or through private contractors. At the beginning of, and periodically throughout the growing season, Leisure Services staff and their contractors are made aware of the City of Waterloo ordinances regarding lawn waste in the gutters and do quite well at eliminating this discharge. Trash removal is also conducted on public property as part of mowing activities. These operations are evaluated yearly by each department and adjusted accordingly. Each year, the City of Waterloo reconstructs portions of the storm sewer system in conjunction with the annual street reconstruction program. The street reconstruction project is paid for through a one-cent local option sales tax. The following storm sewer components were to be reconstructed in the 2015 street reconstruction project: 11 Reporting Year 12 Street Reconstruction Program Total Unit Quantity Total Cost Storm Sewer-12" LF 1940.3 $ 71,914.30 Storm Sewer-15" LF 455.5 $ 17,280.53 Storm Sewer-18" LF 708 $ 30,082.80 Storm Sewer-24" LF 270.5 $ 15,202.10 Storm Sewer-36" LF 21 $ 1,586.55 Storm Sewer 42" LF 578 $ 55,401.30 Storm Manhole,Type A,48" EACH 33 $ 122,265.00 Storm Manhold,Type A, 60" EACH 2 $ 10,000.00 SW-402 Rectangular Storm Manhold EACH 8 $ 36,000.00 SW-403 Rectangular Manhold EACH 1 $ 4,750.00 Remove Existing Structure EACH 49 $ 25,725.00 Remove Storm Sewer Pipe Less than 36" LF 287 $ 2,669.10 Type E-1-C Inlet EACH 32 $ 78,075.00 Type E-2-C Inlet EACH 32 $ 106,340.00 Type E-3-C Inlet EACH 10 $ 43,210.00 Trench Drain LF 60 $ 12,300.00 Type E-1-C Inlet, Modified EACH 1 $ 3,920.00 Remove/Replace Inlet Boxout, E-1-C EACH 2 $ 2,070.00 Remove/Replace Inlet Boxout, E-2-C EACH 1 $ 1,140.00 Remove/Replace Inlet Boxout, E-3-C EACH 3 $ 5,100.00 Tap and Collar Structure or Pipe EACH 15 $ 19,725.00 Furnish and Install Manhole Ring and Cover EACH 2 $ 1,750.00 Storm Water Protection for,Structures EACH 73 $ 33,580.00 Subdrain is installed under all reconstructed pavements to provide proper drainage, which prolongs pavement life. The City of Waterloo does allow homeowners to connect their sump pumps to the subdrain, provided it is clean water. These connections help to eliminate nuisance sump pump discharges (i.e. flooding of neighboring properties). Beginning in 2012, subdrains began to be upsized to 6"and tees are placed at all homes to facilitate sump connection. Any cross-connections encountered during street reconstruction are eliminated. Additionally, the City of Waterloo conducts an asphalt overlay program to prolong the life of streets until they can be reconstructed. Because the overlay affects street drainage, the storm inlet box-outs are often reconstructed. If a storm inlet is found to be in poor condition, the inlet is reconstructed. The following are the storm sewer components that were reconstructed in the 2015 asphalt overlay project. 12 2015 Street Overlay Program Quantity Cost Remove D and Replace with E-1 Inlet 1.00 $ 3,595.00 Remove and Replace E-1-C (Use Existing Casting) 13.00 $ 40,235.00 Remove and Replace E-2-C (Use Existing Casting) 4.00 $ 18,000.00 Remove and Replace Intake Boxout/E-1-C 9.00 $ 14,355.00 Remove and Replace Intake Boxout/E-2-C 8.00 $ 19,920.00 Furnish E-1-C Inlet Casting 1.00 $ 875.00 Furnish E-2-C Inlet Casting 3.00 $ 5,550.00 Remove Structure 1.00 $ 2,665.00 Rem/Rep RA Inlet Top 1.00 $ 2,880.00 Remove and Replace MH Boxout 30.00 $ 45,750.00 2. Pesticide and Fertilizer Management Program: A pesticide and fertilizer management program shall continue to be implemented and enforced which shall reduce pollutant discharge associated with storage, application and disposal of pesticides and fertilizers for municipal operations. The program shall identify all entities that apply pesticides and fertilizers, require that application of these chemicals be applied by properly trained individuals, require training of management techniques addressing storage, application and disposal. Data regarding the application rates of pesticides and fertilizers shall be gathered and evaluated to determine if lower rates would be equally effective. Should it be determined that lower application rates would be equally or nearly as effective, it shall be required that the lower rates be applied. The program shall be implemented for the duration of the permit. The City of Waterloo Leisure Services Department is in charge of maintenance for all public parks, green spaces and right-of-ways within the city. They instituted a pesticide and fertilizer management program during the first permit year and continue to implement and evaluate this plan as needed. City employees who apply pesticides are required to hold a current Iowa Department of Agriculture and Land Stewardship(IDALS)Commercial Pesticide Applicators License. The annual training required to keep this license also addresses fertilizer application. The Leisure Services Department will continue to implement this program for the duration of this permit. 3. Training Program for Municipal Employees: The permittee shall continue implementing a program for training municipal employees regarding practices to be implemented in city operations to reduce pollutants in storm water. The program shall be implemented for the duration of the permit. The field staff of the Engineering Department were given a powerpoint presentation which was an abbreviation of the Iowa Certified Construction Site Pollution Prevention Inspector(ICCSPPI)Training. Leisure Services,Waste Management Services and Public works were shown ExcalVisual's Spills and 13 Skills video which introduced spill response and cleanup practices. For the Waste Water Treatment Plan, this was coupled with further discussion regarding ongoing GP 1 SWPPP compliance activities with those L, at the plant responsible for conducting routine maintenance and inspection. Further, a Stormwater Pollution Prevention Plan was recently developed for the Wastewater Treatment Plant. The facilities team was trained on the completion of the required inspections and inventories for this plan. Training sessions were conducted by the Engineering Depattinent over a 10-week period between January 12, 2016 and March 23,2016. This time period is historically a slow period for City maintenance personnel. Date Department No. of attendees January 12, 2016 Engineering(Field Staff) 9 January 26, 2016 WWTP 20 January 28, 2016 WWTP 10 February 4,2016 Leisure Services 25 February 11, 2016 Building Dept 16 March 15,2016 Sanitation 11 March 23,2016 Street 26 March 23,2016 Traffic 11 March 23,2016 Central Garage 7 The training programs will continue to be expanded in the following years to include occupation and facility specific storm water pollution prevention training gained from facility reviews. The municipal employee training program will be implemented for the duration of the permit. 4. City Facilities BMPs: A program shall continue to be implemented to assess BMPs at city facilities to be implemented that reduce pollutants in storm water from these facilities. These measures shall then be implemented whenever practical. The program shall be implemented for the duration of the permit. Stormwater Pollution Prevention Plans were developed for the Waste Water Treatment Plant and the Public Works facility during reporting year 11 and an SPCC plan for oil storage was also put together for the Public Works facility. Both of these plans have been finalized and approved by council and are now in the implementation phase as of permit year 12. A chemical storage facility is to be constructed for the Leisure Services Department during permit year 13. The Engineering Depa►tiirent will work with Leisure Services to develop a SWPPP for this facility. This will also be the first city facility being built under the city's revised post-construction ordinance and will be required to implement controls addressing water quality and water quantity. Regional detention basins were inspected as part of routine maintenance and assessment. Clearing of vegetative blockages and removal of sediment from basin cunettes were conducted. As part of the assessment of practices at the Hazardous Materials Training Center, the Engineering Department conducted sampling of water leaving the facility's oil water seperator in an attempt to ensure proper function. The seperator drains the area where vehicle fire training is conducted. The sample was analyzed for oil and grease, none was detected by the lab. We will continue to complete this sampling periodically to ensure continued functioning. 14 In April 2011,the Engineering Department installed three FlexStorm inlet bags for use in the Waterloo City Hall and Traffic Department parking lots. The bags selected are designed to collect trash and sediment in post-construction applications. Hydrocarbon absorbing bags were also included in the setup. The Engineering Department will be monitoring and evaluating the performance of these bags for pollutant removal and required maintenance over the next year. These inlet bags continue to be monitored and maintained as necessary. 15 Part IV - Special Conditions Storm Sewer Mapping: A map of the MS4, including all outfalls, shall be maintained for the duration of this permit. The City of Waterloo Engineering Department is continuing its digital storm sewer system-mapping program. Locations on storm sewer system components(i.e.manholes, inlets, outfalls)are obtained by electronic data collection(GPS). Locations on private storm sewer components are also collected. Engineering Department staff then import the collected locations into a master AutoCAD file. Using construction plans filed in the Engineering Department records, the collected locations are then connected to show the piping system. Attributes for each component location and pipe segment are then input into an Access Database. This system is being integrated into ArcGIS by engineering staff. Locations for approximately 97 percent of the existing public storm sewer system have been obtained at this time. The remaining 3%that is uncollected is that part of the system that has been recently constructed or reconstructed in the prior year's construction season. Locations for approximately 65%of the private storm sewer system have been obtained at this time. New points collected during Permit Year 12 are summarized below: • Curb Inlet Manhole 21 • Pipe Outlet 45 • Pipe Inlet 33 • Area Intake 50 • Grated Intake 82 • Stormwater Manhole 88 • Curb Inlet 2 • Lift Station 4 • Pump Station 9 • Gatewells 9 Metadata is still being collected and entered into the database. Additionally, the sewer department recently invested in a software system called Granite, which will be used in conjunction with our GIS system to collect and maintain metadata about line condition, size and slope as the lines are televised in the field. The Engineering Department also has hand drawn plat books of the sanitary and storm sewers. These books have been scanned(or rescanned as they are updated)and the images are available to the public and other City departments. The storm sewer system shall continue to be digitized, with revisions made as needed, for the duration of the permit. Salt Storage: All salt storage shall be in a structure impervious to precipitation and any spillage due to handling activities in an area subject to runoff shall be immediately removed. 16 While salt storage is held in a covered facility not subject to precipitation, it was observed during a facility inspection in permit year 8 that priority sand/salt mix was being prepared and stored outside. A new salt storage building was built at the public works facility. An additional dome for the purpose of the storage of the city's priority mix pile was intended to be built during reporting year 12,however,this work was not completed as intended. The funds for its completion have been allocated for reporting year 13 per conversations with the city Finance and Street Departments. Impervious salt storage and immediate cleanup of spilled materials will continue to be implemented for the duration of the permit. 17 Appendix A: Outreach Documentation Stormwater Outreach Activit Summa Sheet Name of Activity: 2/\pcj - r r Location of Activity: Date Conducted: ;r.¢QrS SO.rvey'S Description of Audience: Television Radios Print Type of Activity (check all that apply): Booth Workshop • Presentation Other(Please Describe) Duration (hrs) Observations and Comments: ,,,,,i ets- na Q J Cv6ItAgs-6 5\K ye-106 k 35:4, -I ( U reS c c,S C-Sf At dam- e-q r a s Q,,-fir' ^S (SW' Sf a y 0 c*er CEDAR ,U Cedar Falls & Waterloo Area " N-" Post Construction ' ALES !2 STORMWATER MANAGEMENT WORKSHOP ebrioo `oyP H q)F SEPTEMBER 24, 2015 jZainscapin• Fo rglfON 4ROG \. 12 :30-4:00 PM A $4" a/ity aragra Waterloo Center for the Arts that is { 225 Commercial Street, Waterloo, IA 'SfrpY9/21/Is. City of Waterloo • Construction Site Runoff (CSR) Permit Application and Guide 1 3 Regulatory Summary City of Waterloo Municipal Code of Ordinances 8-48: Construction Site Erosion and Sediment Control 4 Guidance Only:This document is only a guide. It summarizes certain applicable ordinance provisions • and provides further information to assist in compliance. Affected parties are urged to review ordinance 8-4B for more complete details and to consult an appropriate professional or City of Waterloo Engineering staff for further assistance. In the event of any conflict between this document and applicable ordinance or regulation, the applicable ordinance or regulation will govern. Applicability: This guide applies to construction sites operating within the City of Waterloo which require a Construction Site Runoff(CSR)permit. Sites requiring coverage include any site which disturbs greater than 1 acre of land for purposes other than agricultural production, and any site which will require building permits for the construction of new commercial or residential buildings. Sites which result in 1 acre or more of land disturbance or those which are part of a common plan of development in which 1 acre or more of land will be disturbed will require GP2 coverage. Additional requirements apply to sites that require coverage by an Iowa Department of Natural Resources(IDNR)General Permit 2(GP2)Authorization. For assistance determining the need for GP2 coverage, contact the City of Waterloo Engineering DepaiLment. Purpose:The Construction Site Erosion and Sediment Control Ordinance was adopted as a means of reaching compliance with state and federal Clean Water Act Requirements as mandated in the National Pollutant Discharge Elimination System(NPDES). The goal of this ordinance is to minimize sediment and pollutant runoff from construction sites. Requirements:Sites requiring a Construction Site Runoff(CSR)permit as specified in Ordinance 8-48 must minimize pollutant discharge from the permitted construction by implementing Best Management Practices(BMPs). BMPs can generally be divided into two groups of mandatory practices, sediment and erosion control practices and good housekeeping practices. • Sediment and Erosion Control Practices • Perimeter controls must be present at downslope locations to protect neighboring properties and infrastructure. Examples of perimeter practices include silt fence, wattles and berms. • Inlet protection shall be implemented at all inlets which could potentially receive sediment from the permitted site. When present in public right-of-way,these inlet protection devices are to allow sufficient flow as to minimize ponding and are to be below grade when feasible. • Slope protection practices are to be implemented where slopes are of sufficient slope and/or length as to pose a heightened risk of sheet and rill erosion. Erosion of slopes may be reduced by the following methods, where appropriate: o Reducing the length of the slope through the placement of berms, wattles or sift fencing o Preventing the detachment of soil particles by sheltering the soils using mulching, hydromulching,or erosion control blankets o Preserving existing vegetation where possible o Diverting stormwater runoff away from sensitive areas • Temporary stabilization must be implemented on areas of the site where disturbed soils are to remain inactive for a period of 21 days or longer. Temporary stabilization is typically achieved by means of mulching, hydromulching or temporary seeding. • Dust control must be implemented as needed to prevent the off-site transportation of sediment by wind. Methods of dust control may include watering, application of a non-toxic tackifying Regulatory Summary City of Waterloo Municipal Code of Ordinances 8-4B: Conste uction Site Erosion and Sediment Control agent such as lignosulfonate,or by means of those practices identified as temporary stabilization. • Outlet protection shall be provided at all stormwater outfalls where flow velocities will pose a risk of erosive activity. Examples of outlet protection include rip-rap or turf reinforcement matting. • Sediment trackout shall be minimized by use of a stabilized construction entrance. Traffic control shall also be implemented to ensure that contractors and subcontractors working on site restrict vehicle traffic to stabilized areas. Any sediment tracked into public roadways shall be removed as soon as possible but in no event shall remain in the street after the end of the working day_ • Permanent stabilization of the site shall be achieved through the establishment of perennial vegetation to a minimum 70%uniform density or by other means of permanent stabilization such as paving or landscaping. Good Housekeeping Practices • Concrete washout shall be contained in a designated structure with a legible sign. Examples of such containments may include lined earthen pits, concrete washout bags, chute boxes or concrete washout roll offs. Containment shall also be provided for masonry washout where appropriate. Concrete and masonry washouts shall be present at a location where they can be accessed from a stabilized entrance in order to reduce sediment trackout • Containment of construction debris shall be provided by means of construction dumpster or other acceptable structure. The site shall be kept clear of waste materials at all times and wastes shall be prevented from being blown onto neighboring properties. • A portable toilet should be available to those working on site. When present, portable toilets must be located on a flat surface away from points of discharge such as inlets or drainageways. Further, portable toilets shall be staked securely to the ground to prevent tipping and shall, where possible,be located in a manner which allows access from the stabilized entrance in order to prevent trackout during maintenance or removal. • Oil products, fuel tanks, and other liquid wastes are to be stored in a designated area on site within spill containment. Any spills which occur on site shall be cleaned up immediately. The possession of a CSR permit does not excuse the responsible party from any other applicable laws, including the spill notification requirements,in the event of a release. For guidance on practice selection and proper installation, consult the Iowa Construction Site Erosion Control Manual, found online at:http:/fwww.ctre.iastate.edu/erosion,( How to acquire a CSR Permit:A CSR permit can be acquired by submitting a CSR permit application and site plan to the City of Waterloo Engineering Department. A CSR permit must be acquired prior to the commencement of earth disturbing activities. After a CSR permit and site plan have been approved, BMPs shall be implemented and the Engineering Department shall be contacted for a pre-construction inspection. Once the pre-construction inspection has been completed, activity on the site can begin. The permit will expire one year after the date of issuance if not closed prior to that date. Permits may be renewed at no cost to the permittee. A CSR permit application is included as Attachment 4,and a guide to completing it is provided as Attachment1. An example plan sheet is provided as Attachment 2. Regulatory Summary City of Waterloo Municipal Code of Ordinances 8-4B: Construction Site Erosion and Sediment Control Inspection and entry:City staff will inspect the site at least once per calendar quarter and also in • response to any complaints. Further, the City of Waterloo Engineering department must be contacted for a post-construction inspection prior to permit closure. Should the City identify items of non- • compliance during a site inspection a Notice of Violation will be issued, identifying issues needing to be addressed and specifying a deadline for reaching compliance. The stated deadline shall not exceed 3 days after issuance of Notice, though deadlines may be extended at the discretion of the enforcement officer for progress shown. • Additional Requirements for Sites Requiring GPZ Coverage Stormwater Pollution Prevention Plan • AStormwater Pollution Prevention Plan(SWPPP)meeting the requirements of Iowa DNR General Permit 2 and City of Waterloo Municipal Code of Ordinances 8-4B shall be completed and submitted to the City of Waterloo Engineering Department for review. This SWPPP must be completed by a qualified individual such as a Professional Engineer,Certified Landscape Architect,Certified Professional of Erosion and Sediment Control,or those other individuals with sufficient knowledge and understanding of applicable regulations who are deemed qualified by the City Engineer. • Upon receipt of a completed SWPPP,the Engineering Department shall have 10 days to review the submitted document and return to the applicant or applicant's engineer either an approval, or a review document specifying corrections or additions which must be made prior to approval. The applicant or applicant's engineer must make the specified changes to the document and resubmit,at which time the Engineering Department shall complete review within 10 days. This process continues as needed until approval is issued. A CSR permit will not be issued prior to approval of a SWPPP. Reporting Requirements • Sites subject to Iowa DNR General Permit 2 Authorization requirements must conduct and • • document inspection of site controls a minimum of once every 7 calendar days. Inspection documentation must be present on site or at an approved off-site location and must be made available to enforcement officers within 3 hours of request. Inspection must begin upon commencement of earth-disturbing activities on site and must continue until a post- construction inspection is completed by City of Waterloo staff. Post construction inspections can be completed only after the site has reached final stabilization. A sample reporting sheet is provided as Attachment 3. The permittee is not required to use this form, however,if they intend to use an alternative, this must be submitted as part of their SWPPP for review by the Engineering Department prior to issuance of permit. Topsoil Preservation Requirement • Construction sites requiring coverage of Iowa DNR General Permit 2 must preserve existing topsoil to a minimum depth of 4 inches or actual topsoil depth if less than 4 inches_ It less than 4 inches of topsoil is present on the site prior to disturbance, the preexisting topsoil conditions must be documented by means of a soil survey conducted by an industry professional(someone who regularly completes soil assessments as part of their professional work),and shall be done Regulatory Summary City of Waterloo Municipal Code of Ordinances 8 AB: Construction Site Erosion and Sediment Control in a manner in keeping with industry standards. Appendix D: Amended Ordinances i • Prepared by Carol Nemmers, Deputy City Clerk, City of Waterloo, 715 Mulberry Street, Waterloo, IA 50703, (319) 291-4323. ORDINANCE NO. 5218 AN ORDINANCE AMENDING THE 2007 CODE OF ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY STRIKING IN ITS ENTIRETY ARTICLE B, CONSTRUCTION SITE EROSION AND SEDIMENT CONTROL, OF CHAPTER 4, STORM WATER MANAGEMENT PROGRAM, OF TITLE 8, PUBLIC UTILITIES, AND BY SUBSTITUTING THEREFOR A NEW ARTICLE B. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: That Article B, Construction Site Erosion and Sediment Control, of Chapter 4, Storm Water Management Program, of Title 8, Public Utilities, is hereby stricken in its entirety, and a new Article B is hereby enacted as follows: TITLE 8 CHAPTER 4 STORM WATER MANAGEMENT PROGRAM ARTICLE B. CONSTRUCTION SITE EROSION AND SEDIMENT CONTROL Section 8-4B-1. Findings. A. The U.S. EPA's National Pollutant Discharge Elimination System ("NPDES") permit program ("Program") administered by the Iowa Department of Natural Resources ("IDNR") requires certain persons engaged in construction activities to submit an application to the IDNR for a State NPDES General Permit No. 2 ("State Permit") . Notwithstanding any provision of this chapter, every permit Applicant bears final and complete responsibility for compliance with a State Permit and any other requirement of state or federal law or administrative rule. B. As a condition of the City's Municipal Separate Storm Sewer System (MS4) Permit, the City is obliged to undertake primary supervisory responsibility for administration and enforcement of the Program by adopting a Construction Site Erosion and Sediment Control ordinance. In furtherance of this objective: 1. Any person, firm, sole proprietorship, partnership, corporation, state agency or political subdivision (each an "Applicant") required by law or administrative rule to apply to the IDNR for a State Permit shall apply for such permit and shall submit a Storm Water Pollution Prevention Plan ("SWPPP") to the City Engineer for approval. For purposes of this article, an Applicant includes but is not limited to a Secondary Applicant, and each Secondary Applicant is subject to all provisions of this article that are applicable to an Applicant unless otherwise expressly Ordinance No. 5218 Page 2 ftwe stated. The Applicant shall not submit the Notice of Intent for said State Permit until the City Engineer has reviewed the SWPPP for completeness and for compliance with the State Permit and City requirements. 2. The Applicant shall have primary responsibility for the SWPPP design, inspection, monitoring and enforcement procedures required to promote Applicants' compliance with the State Permit for said site, but other persons may perform the SWPPP design, installation, inspection, and monitoring under the oversight of the Applicant. 3. A State Permit and SWPPP are not required for construction sites with an area of disturbed land that is less than one (1) acre, provided such land is not part of a larger common plan of development. However, it is recommended that the owner implement erosion control measures as described in the brochure "City of Waterloo Best Management Practices for Single Lots", available upon request at the City Engineer's office and the City Building Department. Notwithstanding the foregoing, the City desires to provide limited storm water oversight of all construction sites and for such purposes a local Construction Site Runoff permit shall be required for stormwater discharges from all construction sites as identified in 8-4B-7(A) , even if otherwise exempted from State Permit and SWPPP requirements. C. No state or federal funds have been made available to assist the City in administering and enforcing the Program. Accordingly, the City may choose to fund its application, inspection, monitoring and enforcement responsibilities in whole or in part by fees imposed on Applicants for permits that may be required hereunder, with such fees to be determined from time to time by resolution of the City Council, and/or other sources of funding established by a separate ordinance.
