The Petitioner(s), which include the undersigned landowners and Elk Run Energy
Associates, LLC, as the option holder for all of the land owned by the undersigned
landowners excluding the railroad, hereby petition the City of Waterloo, Iowa,to annex
the territory that has been legally described on the Annexation Plat provided herein, and
that is illustrated by the map that follows, which also shows the location of the territory to
be annexed in relationship to the City.
The name. addresses,and signatures of the legal owners of the real estate included
within the annexation boundary are set out in the following pages of this Petition for
Voluntary Annexation and made a part hereof.
The Petitioners herein represent one hundred (100)percent of the land area to be
annexed, including the 100-foot railroad right-of-way owned by Union Pacific Railroad
Company. The territory to be annexed includes a portion of a road occupied by Black
I law County, Iowa, through easements with the underlying ownership thereof being in
parties which are included among the Petitioners.
The Petitioners also hereby request, in conjunction with the annexation, that the
City suspend the operative effect of the following City ordinances in the annexed
territory until January 1, 201 1: Section 4-3-7(C), Section 5-2-6(A) and Title 9, Chapter 1,
Article B.
THEREFORE, pursuant to Iowa Code Section 368.7, said owners request a
Resolution annexing the area described herein.
