Put it on the agenda language that goes public tomorrow. From: NANCY ECKERT Sent: Thursday,April 24, 2008 11:31 AM To: MAYOR HURLEY; REGINALD SCHMITT;ARIC SCHROEDER; NOEL ANDERSON; 'Mark Milburn' Subject: RE: City Ordinance Suspension for ERES Annexation Mayor, Those waivers were on their petition for annexation which was submitted to the city. If council does not want to approve those waivers, then we could put wording on the agenda the following: Resolution-to approve said annexation with no suspension of waivers of Section 4-3-7(C), Section 5-2-6(A) and Title 9, Chapter 1, Article B. Nancy From: MAYOR HURLEY Sent: Thursday,April 24, 2008 11:18 AM To: NANCY ECKERT; REGINALD SCHMITT; ARIC SCHROEDER; NOEL ANDERSON; 'Mark Milburn' Subject: City Ordinance Suspension for ERES Annexation Importance: High All - In reading the draft minutes of the April 1st PP&Z annexation/rezone hearing it is not crystal clear that the commission voted to deny the request to suspend burning, shooting and property maintenance ordinances. LS Power was asked by Mr. Bell to include these requests in their annexation petition. They did. Staff recommended to PP&Z that they approve the annexation with no waiver of City Code. When they voted in favor of the annexation (hours later) it was not specifically called out to deny the requested waivers. My stand is that we cannot allow these waivers. The fact is, we likely won't pre-emptively enforce them way out there, but we can't waive them selectively. Possibly illegal, certainly fodder for the opposition, and certainly an avalanche of like requests would follow. First, I'd like Mark's input as to whether this waiver business is a show-stopper or not. I don't think it is, but I'd like confirmation on that. I think all LSP promised was to make the request, and they did. Second, how do we include a "no waiver" proviso in our motion to approve the annexation? Correct it now before the agenda is publiched (tomorrow) or amend it Monday? How would Nancy/Aric/Noel word it? Mayor 1
