PROTEST OF ADJOINING LANDOWNERS
In March 2008-,Elk Run Energy Associates, LLC submitted to-the City of Waterloo-Planning;
Programming.and Zoning.Commission, an application to rezone approximately 260 acres from
"A-1"Agricultural District to "M-2,P"Planned Industrial District, for the purpose of developing
a 750 MW coal-fired electric generation facility.
Iowa Code§ 41-4.5 provides that in the case-of a written protest against a change or repeal-of
zoning regulations which is filed with the City Clerk and signed by the owners of twenty percent
or more of the property that is located within two hundred(200) feet of the exterior boundaries
of the property for which the change or repeal is proposed,the change or repeal shall not become
effective except by the favorable vote of at least three-fourths of all the members of the council.
Pursuant to the information submitted with the above-referenced Application for Rezoning, it
reasonably appears that the individuals named below own at least twenty percent of the property
that is located within two hundred(200)feet of the exterior boundaries of the property for which
the change or repeal is proposed.
The below-named property owners hereby submit this protest against the change in zoning
classification requested by Elk Run Energy Associates,pursuant to Iowa Code § 414.5.
The foregoing is true and correct to the best knowledge of the individuals named below.
