COUNCIL RE: F.Y.2007 U.S.63/WESTFIELD AVENUE CONNECTION
MEMBERS CITY CONTRACT NO.730
HDP-8155(698)-71-07
SUPPLEMENTAL AGREEMENT NO.2 FOR PROFESSIONAL SERVICES
REGINALD A. EARTH TECH,INC.
SCHMITT
Ward I Honorable Mayor Hurley and City Council Members:
CAROLYN Attached is proposed Supplemental Agreement No.2 for professional services with Earth Tech,Inc.on the
COLE above-referenced project. Earth Tech's subconsultant—Weston Solutions,Inc. is requesting additional labor
Ward 2 hours to oversee the John Deere/Westfield Ave.Resource Conservation and Recovery Act(RCRA)site and as it
relates to existing on-site soil/materials handling and management during the construction of the new roadway,
HAROLD as mandated by the U.S. Environmental Protection Agency(EPA).
GETTY
Ward 3 Last week,Weston Solutions identified a budget shortfall for the professional services needed to complete this
construction project. The reasons cited for this shortfall include construction delays caused by inclement
JOHN A. weather conditions and management/disposal issues for excess spoils. WS has estimated the additional labor
KINCAID hours and direct costs that are needed, which results in an increase of agreement costs totaling$53,500.00.
Ward 4
RON These additional project costs would be financed with Federal Funds and a 20%local match or$10,700.00. The
WEEPER local match would be paid from general obligation bonds.
Ward 5
The effective date of the proposed supplemental agreement would be retroactive to cover work completed by
BOB WS that exceeded the original contract amount. On federally funded road projects,Tom Devine,DOT Office of
GREENWOOD Finance, noted that sometimes accounting has allowed for the incurring of costs prior to the execution of the
At-Large agreement based on the situation and circumstances of the project. In this case, the DOT will allow the incurring
of costs prior to execution date. It is believed that"it is not in the best interest to stop the project to complete the
ERIC supplemental agreement".
GUNDERSON
At-Large Therefore, it is recommended that Council approve Supplemental Agreement No. 2 and authorize the Mayor to
sign and enter into said agreement.
