GETTY Please find attached letter from Earth Tech,Inc.requesting the authorization of$40,000 of the
Ward 3 contingency for the above-referenced agreement to accommodate the provisional overhead rate
adjustment.

KINCAID The provisional overhead rate established for the agreement is 150 percent and was based on the actual
Ward 4 rates in the 2000 to 2003 fiscal year range. More recent actual rates are in the 160 percent range and
work on this agreement began in 2006 and has been ongoing in 2007. Therefore, it has been requested
RON that the provisional rate be adjusted from 150 percent to 160 percent for the full term of the agreement.

Under section 3.1.1.2.3 of the agreement, if"these new rates cause the estimated actual costs to be
BOB exceeded,the contingency amount will be used". Federal"SAFETEA-LU Earmark"funds could be
GREENWOOD utilized for this contingency with a 20%local match. This would amount to$8000 and would be paid
At-Large from general obligation bonds.
ERIC Staff have reviewed this document requesting authorization of$40,000 of contingency and recommends
GUNDERSON the City Council approve said document and authorize the Mayor to sign and enter into this agreement.
