Ward 1 Permanent Easement Agreement with
Cedar Valley Tech Works,Inc.

Attached is a proposed agreement with corresponding acquisition plat and legal description granting a
HAROLD permanent easement for construction of a new street connection as a part of the above-referenced project.
GETTY This agreement allows the City to use the described area for new street and appurtenant right-of-way.
Ward 3
There is a required consent clause in the agreement requiring the City to assist CVTW,Inc. and
JOHN A. Deere and Company to comply with and fulfill the duties of the responsible parties under the RCRA
KINCAID permit,so as to implement,maintain,and protect institutional controls and/or engineered barriers on the
Ward 4 premises to avoid human contact with contaminated soils and to avoid further movement or expansion of
contaminated soils and groundwater as provided in the permit.

WEEPER As with real estate documents of this kind,there is indemnity language protecting the CVTW. However,
Ward., the"indemnity provided for in this"agreement"shall not include Claims relating to or arising from any
BOB hazardous substances or other environmental conditions existing in or upon the Premises before the date of

At-Large
CVTW will grant and convey the permanent easement rights to the City of Waterloo for a sum total of one-
ERIC dollar.

the Mayor to sign and enter into this agreement.
