RESOLUTION NO. 2016-696
RESOLUTION SETTING THE DATE OF PUBLIC HEARING
AS SEPTEMBER 26, 2016 FOR THE SALE AND
CONVEYANCE OF PORTIONS OF CITY OWNED PARCELS
TO THE IOWA DEPARTMENT OF TRANSPORTATION, FOR
MUTUAL BENEFIT OF SAID ENTITIES, NEEDED AS PART
OF THE HIGHWAY 63 IMPROVEMENTS PROJECT FROM
DONALD STREET TO CONGER/NEWELL STREET; AND
INSTRUCT CITY CLERK TO PUBLISH.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS
FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa shall meet in Harold E. Getty
Council Chambers at City Hall, Waterloo, Iowa at 5:30 p.m. on the 26th day of September, 2016,
for the purpose of considering and acting upon the sale and conveyance of portions of city
owned parcels to the Iowa Department of Transportation, for mutual benefit of said entities,
needed as part of the Highway 63 Improvements project from Jefferson Street to Franklin Street,
Parcel 73, SW of railroad bridge—Hwy 63 underpass, and legally described as follows:
A parcel of land located in part of Section 24, Township 89 North, Range 13 West in the
City of Waterloo, Black Hawk County, Iowa as shown on acquisition plat, Exhibit "A",
and by reference made a part hereof.
THE EASEMENT RIGHTS FOR SUBDRAIN MAINTENANCE GRANTED IS TO
LAND DESCRIBED AS FOLLOWS:
Commencing at the Southwest Corner of Lot 1 of Auditor Rainbow's Plat No.1; thence
NO 009'06"W 208.86 feet along the West line of said Lot 1 and East line of Logan
Avenue to the Existing Southerly right of way line of the Chicago Central and Pacific
Railroad Company; thence S49'1 8'04"E 128.63 feet along said Existing Southerly right
of way line to the point of beginning; thence, continuing along said Southerly right of way
line, S49°18'04"E 76.89 feet; thence SOI°14'08"W 54.04 feet; thence N42°55'03"W
107.76 feet; thence N32°46'18"E 30.02 feet to the point of beginning. Said parcel
contains 3,171 Square Feet.
Section 2. That the City Clerk is hereby directed to publish notice of the time and place
of said hearing in the Waterloo Courier.
