Mayor John R. Rooff in the Chair. Roll Call: Anders, Jordan, Krizek, Murphy, Gronen, Getty, Berry. Invocation by: Reverend Thomas Wegener, Faith Lutheran Church (Missouri Synod). Pledge of Allegiance: Tom Jennings, Police Chief. ORAL PRESENTATIONS 114593 - Tom Hall stated that he has added another person, and it is his first time to a city council meeting, and he introduced Robert Fulton to the council. Getty/Gronen that the above oral comments be received and placed on file. Ayes: Seven. Motion carried. 114594 - Jordan/Berry that the Agenda, as proposed, for the Regular Session on Monday, December 4, 2000, at 5:30 p.m., be accepted and approved. Ayes: Seven. Motion carried. 114595 - Murphy/Gronen that the Minutes, as proposed, for the Regular Session on Monday, November 20, 2000, at 5:30 p.m., be accepted and approved. Ayes: Seven. Motion carried. Mayor Rooff read a proclamation declaring December 2000 as Human Rights Month. Ned DeBerg recognized Chad Fifield for his assistance in securing an emergency scene until arrival of response personnel. HEARINGS AND BIDS 114596 - Krizek/Jordan that proof of publication of notice of public hearing on Lead Abatement for the Anaerobic Digester Project, Contract No. 629, as published in the Waterloo Courier on November 17, 2000, be received and placed on file. Ayes: Seven. Motion carried. 114597 - This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Jordan/Getty that the hearing be closed and oral and written comments be received and placed on file. Ayes: Seven. Motion carried. 114598 - Getty/Gronen that "Resolution confirming approval of plans, specifications, form of contract, etc. in conjunction with Lead Abatement for the Anaerobic Digester Project, Contract No. 629", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2000-639. 114599 - Anders/Murphy that "Resolution authorizing to proceed in conjunction with above said project", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2000-640. 114600 - Murphy/Jordan to receive, file and instruct City Clerk to open and read bids and refer to Superintendent of Water Pollution/Flood Control for review: Bidder Bid Bond Total Bid Advanced Technologies Corp., Cedar Falls, IA 5% $126,460.00 Pospisil Painting, Inc., Cedar Rapids, IA $13,875.00 $277,500.00 L & P Painting, Cedar Rapids, IA 5% $252,112.50 Ayes: Seven. PETITIONS FROM PUBLIC 114604 - Berry/Anders that communication from City Clerk transmitting request of American Cancer Society for a variance to the Noise Ordinance on May 18, 2001, from 6:00 p.m. to 12:00 midnight to allow bands to play and/or vocal chorus to sing at Waterloo Memorial Stadium in conjunction with Relay for Life event, together with recommendation of approval of Police Chief to approve to 11:00 p.m., be received, placed on file and "Resolution approving said request to 11:00 p.m.", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 2000-642. DOCUMENTS 114605 - Krizek/Jordan that communication from City Planner transmitting Scope of Services and Purchase Order Contract with Howard R. Green Consulting Engineers at a cost not to exceed $5,000.00 to prepare an application for EPA Brownfields Cleanup Revolving Loan Funds in the amount of $1,000,000.00 be received, placed on file and "Resolution approving said contract", be adopted and Mayor and City Clerk authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 2000-643. 114606 - Krizek/Jordan that communication from Chief of Police transmitting grant application for Department of Justice, Bureau of Justice Assistance, 2001 Bulletproof Vest Partnership Program for funds to be used to purchase replacement vests, be received, placed on file and "Resolution approving said grant application", be adopted and Mayor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 2000-644. 114607 - Krizek/Jordan that communication from Assistant City Engineer transmitting Completion of Project and Recommendation of Acceptance of Work performed by Aspro, Inc., & Subsidiaries of Waterloo, Iowa, in conjunction with F.Y. 1999 Street Reconstruction Program, Contract No. 594, be received, placed on file and "Resolution approving said documents", be adopted and two-year maintenance bond be received and placed on file. Resolution adopted and upon approval by Mayor assigned No. 2000-647. 114610 - Krizek/Jordan that communication from Building Official transmitting Contracts, Bonds and Certificates of Insurance in the amount of $107,955.00 from Huff Contracting, Inc., of Waterloo, Iowa, in conjunction with Memorial Hall A.D.A Improvement Project be received, placed on file and "Resolution approving said documents", be adopted and Mayor and City Clerk authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 2000-648. 114611 - Krizek/Jordan that communication from Mayor Rooff transmitting an agreement with Hogan -Hansen for consulting services at a cost of $80.00 per hour to establish an indirect cost allocation plan so that activities within the city are charged with their proper share of indirect costs be received, placed on file and "Resolution approving said agreement", be adopted and Mayor authorized to execute same. RESOLUTIONS TO BE ADOPTED 114612 - Berry/Jordan that communication from Assistant City Planner transmitting request to adopt new resolution to sell and convey a portion of the alley generally located in the 800 block west of Rhey Street, north of Fowler Street, for $1.00 to B&G Builders and rescind Resolution 2000-427 be received, placed on file and "Resolution approving said sale and conveyance and rescinding Resolution No. 2000-427", be adopted. ORDINANCES TO BE ADOPTED 114613 - Anders/Jordan that "an Ordinance amending the 1999 Traffic Code by: adding a new Subsection (72a) Hoff Road to Section 543, Thru Streets (place stop sign at Kitty Hawk Drive and Hoff Road)", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 114614 - Jordan/Murphy that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 114615 - Getty/Jordan that "an Ordinance amending the 1999 Traffic Code by: adding a new Subsection (72a) Hoff Road to Section 543, Thru Streets (place stop sign at Kitty Hawk Drive and Hoff Road)", be considered and passed for the second and third times and adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 4449. December 4, 2000 BILLS PAYMENT 114616 - Krizek Page 4 that "Resolution approving Schedule AP640, pp. 1-87, dated December 4, 2000, in the amount of $3,706,977.01, a copy of which is on file in the City Clerk's Office", be adopted, together with recommendation of approval of the Finance Committee.
