RESOLUTION NO. 2016-906 RESOLUTION AUTHORIZING SALE AND CONVEYANCE OF THE VACATED ALLEY WITHIN THE FORMER BOWL-IN BLOCK, GENERALLY LOCATED IN THE BLOCK BOUNDED BY MULLAN AVENUE, JEFFERSON STREET, WEST 1ST STREET, AND HIGHWAY 218, TO 14AWKEYE COMMUNITY COLLEGE, IN THE AMOUNT OF $1.00, AND APPROVING A DEVELOPMENT AGREEMENT WITH HAWKEYE COMMUNITY COLLEGE. WHEREAS, the City of Waterloo, Iowa is the owner of real property in the City of Waterloo, Iowa, as describe below, and WHEREAS, an offer to purchase the vacated alley within the former Bowl-In block, generally located in the block bounded by Mullan Avenue, Jefferson Street, West 1st Street, and Highway 218 has been made by Hawkeye Community College, in the amount of$1.00, and a WHEREAS, a public hearing was held on November 14, 2016, at 5:30 p.m. in the Harold E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey said vacated alley owned by the City of Waterloo, Iowa,to Hawkeye Community College, and WHEREAS, it is the opinion of this council that said sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The following described real property, as fully described in the published notice in the Waterloo Courier on November 8, 2016 is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2. That the offer of Hawkeye Community College to purchase real property for the sum of$1.00, is hereby accepted for real property described as follows: ALL THAT PART OF THE 20 FOOT ALLEY IN BLOCK 12, ORIGINAL PLAT WATERLOO WEST LYING WESTERLY OF THE FOLLOWING DESCRIBED CURVE; COMMENCING AT THE EASTERLY CORNER OF LOT 10 OF SAID BLOCK 12, THENCE S 41-07'W 90 FEET ALONG THE SOUTHEASTERLY LINE OF SAID LOT 10 TO THE SOUTHWESTERLY LINE OF THE NORTHEASTERLY 90 FEET OF SAID LOT 10, THENCE N 49°14%2'W 35.6 FEET ALONG SAID SOUTHWESTERLY LINE, THENCE NORTHEASTERLY 92.7 FEET ALONG A 701.7 FOOT RADIUS CURVE, CONCAVE NORTHWESTERLY, THE CHORD FOR WHICH BEARS N 54°23%2'E AND HAS A LENGTH OF 92.6 FEET TO A POINT ON THE NORTHEASTERLY LINE OF SAID LOT 10 THAT IS 14.3 FEET NORTHWESTERLY OF THE MOST EASTERLY CORNER OF SAID LOT 10 WHICH IS THE POINT OF BEGINNING; THENCE CONTINUING ALONG SAID CURVE TO THE SOUTHWESTERLY LINE OF LOT 1, SAID BLOCK 12 TO A POINT THAT IS 11.4 FEET NORTH OF THE SOUTHERLY MOST CORNER OF SAID LOT 1, ALL IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. Resolution No. 2016-906 Page 2 3. That the City of Waterloo, Iowa conveys said parcels of real property described above to Hawkeye Community College by quit claim deed. 4. That the Mayor and City Clerk are authorized and directed to execute said deed. 5. That the original of said deed fully executed and acknowledged is hereby approved and confirmed by this Council. 6. That the Planning and Zoning Director is authorize and directed to deliver said quit claim deed to Hawkeye Community College upon receipt of$1.00 7. That the Development Agreement dated November 14, 2016, between Hawkeye Community College and the City of Waterloo, Iowa, is hereby approved. PASSED AND ADOPTED this 14th day of November 2016.
