The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa, at 5:30 p.m., on Monday, April 26, 2004. Mayor Timothy J.
Hurley in the Chair. Roll Call: Kincaid, Cole, Greenwood, Clark, Schmitt, Gunderson,
Welper.
Moment of Silence.
Pledge of Allegiance: Sandie Greco, Superintendent of Traffic Operations.
ORAL PRESENTATIONS
119770 - Charles Myles, 637 Adams Street and President of Unity Neighborhood Association,
submitted a petition requesting the mayor and city council to put a stop to the
developers of the manufactured housing now being put up on the Eastside of
Waterloo. Mr. Myles stated the housing is of inferior quality and appearance
will exert a long term negative impact on the surrounding community.
Willie Greer stated he thought you could not put any house in a residential
neighborhood unless it is put up in the same manner, just like regular
constructed homes. Mr. Greer stated these homes have metal frames and basically
are trailers, and they will lower the value of homes in the area. Mr. Greer
stated that apparently these houses have not held in their value in Houston,
Texas. Mr. Greer stated he could understand if the homes were put in a
designated area, not up the way they are unless the contractors are going to put
in a foundation.
Pete Ross, 420 Hewitt Street and a member of Unity Neighborhood Association,
stated this is no area for these houses as the lots are small and there is no
room for a garage. Mr. Ross stated that Evansdale is putting up beautiful
homes. Mr. Ross stated he knows the value of the homes will not go up, but
down. Mr. Ross asked for a moratorium until we decide a better way of doing it.
Alvin Wright, 720 Sumner Street, quoted Section 414.28 of the Iowa State Code,
and stated he interprets that it means if other homes are not of same quality
than there should be some way to stop them because these homes are not
compatible as they have no basements, they don't have permanent foundations,
they have wheels and can be moved. Mr. Wright asked for a moratorium to stop
the building as state law says this is a way for the city to stop them from
putting in more.
Mayor Hurley stated he does not believe it would have anything to do with
basements.
Fred Levy, 2126 City View Street, spoke against the homes and said they did not
know they were coming. Mr. Levy stated there is one of the homes right beside
his, and he has put a lot of money into his home and would like to make money on
if he should decide to sell. Mr. Levy stated the homes have no basements. Mr.
Levy stated he feels these homes will lower the value of his home, and he feels
the private contractor made a deal with the city.
Martin Culpepper asked the council to take into consideration the petition. Mr.
Culpepper stated people are unhappy about the situation and feel things should
be done right. Mr. Culpepper stated he thought by ordinance the city has to
notify people within 250 feet of the construction. Mr. Culpepper stated
neighbors are concerned, and they are all taxpayers.

119771 - Mayor Hurley stated the city will continue to look to see where we can help the
citizens. Mayor Hurley stated the people bringing in the manufactured homes are
doing everything legal in the State of Iowa and by the Waterloo Code of
Ordinances, and there is very little we can do to stop them except stop buying
them as it is market driven. Mayor Hurley suggested someone research the deed
restrictions for the area which could restrict manufactured homes. Mayor Hurley
noted these are manufactured homes, not trailers. Mayor Hurley stated the lots
were purchased in the open market or at a sheriff's sale, and the city did not
sell or give them any lots.
Jim Walsh, City Attorney, reported the Code of Iowa addressing manufactured
homes. Mr. Walsh stated that many people did not want them in their
neighborhoods, and the manufactured home industry lobbied the legislators that
they should be allowed to sell manufactured homes for residential areas. Mr.
Walsh stated the manufactured homes are allowed to use a pier footing system.

Mr. Walsh stated the city's zoning restrictions are illegal and cannot be
enforced if they discriminate against manufactured homes.
Willie Mae Wright, 327 Almond Street, asked what does compatibility mean.
Visual compatibility means looks, and we are talking about looks. Ms. Wright
asked why are they bringing these homes into this area and exploiting black
people. Ms. Wright stated there is no market for them, they are not livable,
not compatible, and they not wanted. Ms. Wright asked the council to do
something to stop them. The ones already there, the city can't take away, but
don't let them bring in any more.
Don Ross, 217 Thompson Avenue and Chair of the Franklin/Gateway Neighborhood
Association, stated it seems the city is always deciding and doing things that
are decisive rather than unifying. Mr. Ross reported there are 175 homes, 30
businesses, 4 churches, 1 school and non-profit clubs in his neighborhood. It
is an older neighborhood with older/senior folks. Mr. Ross wondered where our
conscience is, and that during bad times is the time to give not take away. Mr,
Ross asked the mayor and council to look at neighborhood clean ups again, as we
are talking about a few thousand dollars, not millions. Mr. Ross challenged the
council to come to their meeting on May 13, 2004 as the association will be
walking the neighborhood.
Mayor Hurley responded he will continue to look for monies, and he is not done
yet, but we have to be careful where we take it from.
Jill Schulz, 3625 University Avenue, read a prepare statement to the council
regarding the Kinsdale development that was approved for rezoning to "R-3"
Multi -Family Housing District (a copy is on file in the City Clerk's office).
Ms. Schulz urged the council to approve the contract with Earth Tech to start
construction plans to relieve the sewer and water overload problems around
Ansborough, Downing and Garden Avenues. Ms. Schulz implored the council to
continue with improving all the areas in the neighborhood, including Huntington
Road, Robin Road, Sager Avenue and other homes that could be affected across
from the proposed addition and west of Central Middle School. Ms. Schulz
implored the council to recognize and address the traffic issue in this area,
and stated she has a real concern for traffic on Greenhill Road. Ms. Schulz
asked the council to recognize the traffic situation and if possible put another
stop light at the entrance and exit from the Kinsdale development onto and off
Greenhill Road as soon as the development is built, or consider lowering the
speed limit from 45 mph to 35 mph or even 30 mph from the University off -ramp
onto Greenhill Road to Cedar Heights Drive. Ms. Schulz would like to see a more
vigilant effort to police this part of Greenhill Road for speeding traffic.
Living on University Avenue, Ms. Schulz stated she still has a major concern
about the congestion and possible accidents that will happen at the McDonald's
and K -Mart intersections. Ms. Schulz stated these are all very real and life
altering issues for the residents in the Kinsdale area.
Mayor Hurley stated he appreciated the way Ms. Schulz presented her views, and
that her suggestions on enforcement are good and reasonable. Mayor Hurley
stated the contract with Earth Tech at a cost of $138,000.00 is a start, and
that we will use the 2001 Study from Earth Tech. Mayor Hurley stated the lift
station will help the problem, but will not solve it. Hopefully, we will
develop comprehensive study involving the neighbors. Mayor Hurley stated the
project needs to be followed with a program to get residents of the area to
disconnect their homes' footing drains from the sanitary sewer. Mayor Hurley
stated the city will not be able to pay to disconnect the hundreds of homes and
the disruption required to the foundations and around the houses. Mayor Hurley
stated he wants to hold neighborhood meetings.
Lori Miller, an employee of Operation Threshold, stated she has worked for
Operation Threshold since 1996. Ms. Miller reported that for the last several
years, Operation Threshold has been working with the Salvation Army to help
homeless men. Ms. Miller stated there will be an open house on Wednesday from
2:00 p.m. to 4:00 p.m. at the Salvation Army on Argyle Street. Ms. Miller
thanked the city and Community Development for their efforts in bringing in
affordable housing to Waterloo.

119776 - This being the time and place of public hearing, the Mayor called for written
and oral objections.
Don Ross, 217 Thompson Avenue and Chairperson of the Franklin/Gateway
Neighborhood Association, asked what is the $4 million going to be used for, it
could do a lot of clean ups. Mr. Ross complimented the mayor and council for
bringing Ferguson to Waterloo. Mr. Ross stated he saw on the Internet that
Ferguson holds about $700 million inventory at all times, and they had about $5
billion in sales. Mr. Ross stated it is his understanding that the city doesn't
have any money because of the budget. Mr. Ross stated he is for this company,
but he is talking about his neighborhood and individuals in his neighborhood who
have needs. Mr. Ross stated he feels we need to have a moral conscious to look
at those who are here. Mr. Ross stated there are 30 businesses in his
neighborhood and asked what kind of influx would his neighborhood businesses
bring in. Mr. Ross stated the on one hand the city says it doesn't have any
money, on the other hand the city sells bonds to give to a company that does not
need it, and then says no to his neighborhood. Mr. Ross suggested changing the
bond sale to $4,007,000.00 to help his neighborhood.
Mayor Hurley responded it is an incentive package put together by the city.
Mayor Hurley stated that we cross budget boundaries when we talk about garbage
and sewer funds. Mayor Hurley reported that the return on investment for
Ferguson over 20 years is 7 percent. Mayor Hurley stated we will get money from
the TIF, and if they expand their business, the city's revenues will improve
dramatically and help our general fund. Mayor Hurley stated he will try to keep
waste management efforts separate from the general fund.
Don Temeyer, Community Planning and Development Director, stated that we
probably won't sell $4 million, but that amount gives the city the capability to
build a railroad spur if needed. Mr. Temeyer stated that the city will spend
$3.2 million to purchase the land from the property owners and $600,000.00 for a
railroad spur. Mr. Temeyer stated that the city is paying for the railroad spur
because it is part of the incentives. The railroad spur is a private line and
construction of the railroad spur by the city was part of our incentive package.
