IA, 50703 319-291-4366 Return to preparer after recording. AMENDMENTTO MARTIN ROAD DEVELOPMENT PLAN REC ITALS A. On October 7, 1996, the City Council of the City of Water!oo, Iowa (the "City") adopted Ordinance No. 4204 and adopted Resolution No. 1999-499, determining that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa Iaw, and approved and adopted the Martin Road Devetopment FIan of the City of Waterloo Iowa (the "PIan"). B. On August 9, 2004, the City Council adopted Ordinance 4708 and Resotution No. 2004-522, in which it was agreecl to amend the PIan by enlarging the area included therein, and one or more other amendments have been made to the PIan to include additional urban renewal projects or for other purposes. C. On October 27, 2014, the City Council adopted Ordinance 5249 and on October 20, 2014 adopted Resolution No. 2014-903, in which it was agreed to amend the PIan by enlarging the area included therein, and one or more other amendnients have been made to the PIan to include additional urban renewal projects or for other purposes. D. The City desires to amend the PIan again to enlarge the area included therein, to include new urban renewal projects and to update related information in the PIan. AMENDMENT NOW TKEREFORE, the Martin Road Development PIan, as previously amended, is hereby further amended as foliows: 1. Paragraph l.A.3.b(6) is hereby stricken in its entirety and replaced with the foliowing new paragraph I.A.3.b(6): (6) All objectives of the original p!an adopted in 1996 and all amendments to said plan adopted prior hereto. 2. Attachments A and B to the PIan are hereby stricken in their entirety, and the new Attachments A and B which are attached hereto are substituted in their piace so that the Plan shows the current legal description and map, describing and depicting the boundaries of the Martin Road Development Plan and TIF District, as amended. 3. Attachments C and D to the Plan are hereby stricken in their entirety, and the new Attachments C and D which are attached hereto are substituted in their place so that the Plan shows current information about bonding capacity and project budgets. 4. The attachments listed below, each of which is attached hereto, are included in this amendment to show compliance with procedural requirements under state law for adoption of this amendment, but do not replace or supersede similar attachments to the original Plan or any amendment thereto adopted prior to this amendment: Attachment G (Planning, Programming & Zoning resolution) Attachment H (notice of consultation) Attachment I (resolution adopting this amendment) Attachment J (ordinance adopting amended TIF district) Attachment K (published notice of public hearing) Attachment L (posted notice of public hearing) 5. Except as modified by this amendment, the Plan, as previously amended, shall continue unmodified in full force and effect. PASSED AND APPROVED this 4 day of 2016.
