Mayor Timothy J. Hurley in the Chair. Roll Call: Kincaid, Cole, Greenwood, Clark, Gunderson, Welper. Moment of Silence. Pledge of Allegiance: Rudy Jones, Community Development Director. 119254 - Welper/Kincaid that the Agenda, as proposed, for the Regular Session on Monday, January 5, 2004, at 5:30 p.m., be accepted and approved. Ayes: Six. Motion carried. 119255 - Welper/Kincaid that the Minutes, as proposed, for 2003, at 5:30 p.m., be accepted and CONSENT AGENDA 119256 - Clark/Kincaid that the following approved: a. b. items on the the Regular Session on Monday, December 22, approved. Ayes: Six. Motion carried. consent agenda be received, placed on file and Darryl Hartema, Fire Captain, and Mike Jenn, Mechanic, to travel to Waywagee, Wisconsin, on December 29, 2003, to pick up aerial, with costs not exceed $215.00, including use of city vehicle. HEARINGS 119257 - Kincaid/Clark that proof of publication of notice of public hearing on request of Steven Mingus to vacate 6'4" of the 8' easement generally located at 1221 Julian Avenue and along the northerly side of Lot 68 in Kearns Addition for the purpose of building a garage, as published in the Waterloo Courier on December 22, 2003, be received and placed on file. Ayes: Six. Motion carried. 119258 - This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Clark/Cole that the hearing be closed and recommendation of approval of the Planning, Programming and Zoning Commission and oral and written comments be received and placed on file. Ayes: Six. Ayes: Six. Motion carried. 119260 - Welper/Clark that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Six. Motion carried. 119261 - Kincaid/Welper that "an Ordinance vacating 6'4" of the 8' easement generally located at 1221 Julian Avenue and along the northerly side of Lot 68 in Kearns Addition for the purpose of building a garage", be considered and passed for the second and third times and adopted. Ayes: Six. Ordinance adopted and upon approval by Mayor assigned No. 4663. 119262 - Greenwood/Welper that proof of publication of notice of public hearing on request of Hope Anderson, Gary Bishop and DuWayne Wessels, Jr. to rezone from "A-1" Agricultural District to "R-4" Multiple Residence District property generally located on East Orange Road near Hawkeye Community College for the purpose of allowing additional apartment development, as published in the Waterloo Courier on December 22, 2003, be received and placed on file. Ayes: Six. Motion carried. 119263 - This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Ayes: Six. Ordinance adopted and upon approval by Mayor assigned No. 4664. DOCUMENTS 119267 - Clark/Welper that communication from City Engineer transmitting Completion of Project and Recommendation of Acceptance of Work performed by Aspro, Inc. & Subsidiaries of Waterloo, Iowa, in the amount of $2,702,872.95 in conjunction with F.Y. 2003 Asphalt Overlay Program, Contract No. 660, be received, placed on file and "Resolution approving said documents", be adopted and two-year Maintenance Bond be received and placed on file. Resolution adopted and upon approval by Mayor assigned No. 2004-2. • • January 5, 2004 Documents - continued 119268 - Clark/Welper Page 3 that communication from Associate Planner transmitting request of Jeff Duffy for tax exemptions on improvements totaling $6,835.00 for property located at 1046 Amherst Street in the Consolidated Urban Revitalization Area, together with recommendation of approval, be received, placed on file and "Resolution approving said application", be adopted and City Clerk instructed to forward same to Black Hawk County Assessor. Ayes: Six. Resolution adopted and upon approval by Mayor assigned No. 2004-3. 119269 - Clark/Welper that communication from Leisure Services Director transmitting Contracts, Bonds and Certificates of Insurance in the amount of $82,615.00 from Paul G. Christensen Construction of Cedar Falls, Iowa, in conjunction with Gates Pro Shop ADA Restroom Addition, be received, placed on file and "Resolution approving said documents", be adopted and Mayor and City Clerk authorized to execute same. Ayes: Six. Resolution adopted and upon approval by Mayor assigned No. 2004-4. BILLS PAYMENT 119270 - Greenwood/Cole that "Resolution approving Schedule AP640, pp. 1-56, dated January 5, 2004 in the amount of $1,357,273.80, a copy of which is on file in the City Clerk's Office", be adopted, together with recommendation of approval of the Finance Committee. Ayes: Six. Resolution adopted and upon approval by Mayor assigned No. 2004-5. NEW BUSINESS 119271 - Kincaid/Gunderson that the City Engineer be instructed to prepare plans, specification, form of contract, etc. in conjunction with F.Y. 2004 C.M.C. Parcel 2 Demolition, Contract No. 680, be received and placed on file. Prior to a vote on the above motion, the following comments were heard. Don Temeyer, Community Planning and Development Director, reported that Parcel 2 is located on the northeast side of the buildings and includes all the burned out buildings. In answer to a question from Councilperson Greenwood, Mr. Temeyer stated that typically demolition companies are allowed to salvage items of value in the buildings. Mr. Temeyer stated that any hoist in the good building is the owner's property. Councilperson Clark asked what happens to the soil as the buildings are demolished. Mr. Temeyer responded that the bid document will request alternates to get rid of unsafe material. The footings will be removed, and the city will apply for a future grant to remove any contamination. June 1, 2004 is the anticipated completion date of this project. It could be a couple of years before we hear from the state on any contamination. Following comments a vote was taken on the above motion with the following result. Ayes: Six. Motion carried. 119272 - Welper/Greenwood that plans, specifications, form of contract, etc. in conjunction with F.Y. 2004 C.M.C. Parcel 2 Demolition, Contract No. 680, be received, placed on file and approved. Ayes: Six. Motion carried. 119273 - Welper/Kincaid that "Resolution preliminarily approving plans, specifications, form of contract, etc. in conjunction with above said project", be adopted. Ayes: Six. Resolution adopted and upon approval by Mayor assigned No. 2004-6. January 5, 2004 Page 4 New Business - continued 119274 - Kincaid/Cole that "Resolution setting date of hearing as January 26, 2004 at 5:30 p.m. in the City Hall Council Chambers and taking of bids in conjunction with F.Y. 2004 C.M.C. Parcel 2 Demolition, Contract No. 680", be adopted and City Clerk instructed to publish notice of same. Ayes: Six. Resolution adopted and upon approval by Mayor assigned No. 2004-7. 119275 - Kincaid/Welper that communication from General Manager of Waterloo Water Works transmitting request to certify the amount of $3,100.13 for work performed by the Water Works at 163 University Avenue, together with recommendation of approval of Waterloo Water Works Trustees, be received, placed on file and "Resolution approving said request", be adopted and City Clerk authorized to certify same to Black Hawk County Treasurer. Ayes: Six. Resolution adopted and upon approval by Mayor assigned No. 2004-8. 119276 - Kincaid/Welper that communication from General Manager of Waterloo Water Works transmitting request to certify the amount of $2,848.00 for work performed by the Water Works at 326 Oliver Street, together with recommendation of approval of Waterloo Water Works Trustees, be received, placed on file and "Resolution approving said request", be adopted and City Clerk authorized to certify same to Black Hawk County Treasurer.
