RESOLUTION NO. 2017-33
RESOLUTION AUTHORIZING TO PROCEED WITH SALE
AND CONVEYANCE OF CERTAIN TRACTS OF LAND,
FORMERLY PORTIONS OF WEST SAN MARNAN DRIVE
RIGHT-OF-WAY, LOCATED ADJACENT TO SUNNYSIDE
COUNTRY CLUB.
WHEREAS, the City Council of the City of Waterloo, Iowa met in Regular Session on
November 7, 2016, and directed the process for the sale of certain tracts of land formerly portions
of West San Marnan Drive, set the date for a public hearing for an opportunity to be heard as
January 9, 2017, set the date of bid opening as January 12, 2017, and the date of public hearing
on the sale and taking of bids for said property as January 17, 2017, and
WHEREAS, pursuant to Iowa Code Section 306.23, written notice was sent on
November 9, 2016 via certified mail, to owners of the adjacent land from which certain lands
were originally acquired, or as an owner of certain lands when originally purchased or
condemned for highway purposes, that the City of Waterloo, Iowa, would take bids for the sale
and conveyance of certain tracts of land, formerly portions of West San Marnan Drive right-of-
way, and
WHEREAS, notice of public hearing on the opportunity to be heard was published in the
Waterloo Cedar Falls Courier on December 22, 2016, and notice of public hearing public on the
sale and conveyance of certain tracts of land and taking of bids for said property was published in
the Waterloo Cedar Falls Courier on December 30, 2016, and
WHEREAS, the City Council of the City of Waterloo, Iowa, met in Regular Session on
January 9, 2017 and as part of those proceedings, held a public hearing allowing interested
parties an opportunity to be heard regarding the sale and conveyance of certain tracts of land,
formerly portions of West San Marnan Drive right-of-way, and
WHEREAS, the City Council of the City of Waterloo, Iowa,met in Regular Session on
January 17, 2017 and as part of those proceedings, held a public hearing to receive and consider
the sale and conveyance of certain tracts of land, formerly portions of West San Marnan Drive
right-of-way, and it was announced at the public hearing that no bids were received.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA,that it is deemed advisable and necessary and it is so ordered, on motion
by this council,that the City of Waterloo proceed with the disposal of certain tracts of land,
formerly portions of West San Marnan Drive right-of-way pursuant to Iowa Code Section
306.23.
