Mayor John R. Rooff in the Chair. Roll Call: Getty, Jordan, Krizek, Murphy, Anders, Collier, Mollenhoff. Invocation by: Reverend William Schultz, Immanuel Lutheran Church, MO Synod Pledge of Allegiance: Larry Cunningham, Superintendent of Central Garage 107702 - Mollenhoff/Jordan that the Agenda, as amended, for the Regular Session on Monday, November 18, 1996 at 7:00 p.m., be accepted and approved. Ayes: Seven. Motion carried. 107703 - Jordan/Collier that the Minutes, as proposed, for the Regular Session on Tuesday, November 12, 1996 at 7:00 p.m., be accepted and approved. Ayes: Seven. Motion carried. Mayor Rooff read a Proclamation declaring November 24 - December 1, 1996 as Bible Week. Cindy Wells of the Updowntowners presented a check in the amount of $10,000 to be used for antique lighting. Mike Hahn, Waterloo Main Street, presented the first in a series of Waterloo miniatures. 107704 - Krizek/Collier that proof of publication of notice of public hearing on request of Leon and Kathy Mosley to rezone from "M-1" Light Industrial District to "R-2" One and Two Family Residence District property generally located north of Osage Road, easterly of Bishop Avenue and southerly of Wyandotte Street to sell lots for residential use, as published in the Waterloo Courier on November 5, 1996, be received and placed on file. Ayes: Seven. Motion carried. 107705 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Collier stated his support for the request to rezone the property. Leon Mosley informed the council that all the lots included in the rezoning are being sold together and will be used for one residential structure and the surrounding lot. Anders/Collier that the letter of objection to duplexes being built on the property be received and placed on file. Ayes: Seven. Motion carried. 107706 - Mollenhoff/Murphy that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission and oral and written comments be received and placed on file. Ayes: Seven. Motion carried. 107707 - Collier/Jordan that "an Ordinance amending Ordinance No. 2479, as amended, City Zoning Ordinance, by adding Subsection No. 300 to Section 2A-5, Rezoning Certain Property", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 107708 - Jordan/Krizek that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended. Ayes: Seven. Motion carried. 107709 - Mollenhoff/Jordan that "an Ordinance amending Ordinance No. 2479, as amended, City Zoning Ordinance, by adding Subsection No. 300 to Section 2A-5, Rezoning Certain Property", be considered and passed for the second and third times and adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 4208. PETITIONS FROM PUBLIC 107722 - Mollenhoff/Krizek that communication from City Planner transmitting request of Y.M.C.A. of Black Hawk Country to rezone from "R-2" One and Two Family Residence District to "R-2" One and Two Family Residence District/"C-Z" Conditional Zoning to allow existing residence at 615 S. Hackett Road to be used for office and/or program purposes, together with recommendation of approval of the Planning, Programming and Zoning Commission, be received, placed on file and "Resolution setting date of hearing as December 16, 1996 at 7:00 p.m. in the City Hall Council Chambers on the above described request", be adopted and City Clerk instructed to publish notice of same. DOCUMENTS 107723 - Krizek/Collier that communication from City Planner transmitting request of Pramod Sarin for tax abatement for improvements made at 215 and 217 Courtland Street in the Franklin Urban Revitalization Area Plan, be received, placed on file and "Resolution approving said request", be adopted and City Clerk instructed to notify County Assessor of same. Prior to a vote on the above motion, the following comments were heard. Councilperson Getty stated that information received in the council packet contained a list from the Housing Inspector of deficiencies at 215-217 Courtland, and he asked if those repairs have been completed. It was unknown if the repairs had been made at this time. With the approval of the maker and seconder the above motion was withdrawn. Murphy/Collier that the above item be tabled for one week. ORDINANCES TO BE ADOPTED 107724 - Jordan/Collier that the request of James Mashek to rezone from "A-1" Agricultural District to "C-2" Commercial District to allow construction of mini -storage buildings on property generally located just north of 2531 Logan Avenue (U.S. 63 North) be referred to the Planning, Programming and Zoning Commission for a conditional zoning. Prior to a vote on the above motion, the following discussion was heard. Anders stated his preference to vote on the resolution as stated on the agenda tonight and let the chips fall where they may. He stated that the issue has been delayed three weeks already and will be delayed further if remanded back to Planning, Programming and Zoning. His experience has been that the Planning Commission will send it back to council with no additional changes. Jordan restated that Mashek would like a chance to reconsider the request under conditional zoning as he was unclear about the best way to present the request. Following discussion a vote was taken on the above motion with the following result. Ayes: Four. Nays: Getty, Murphy, Anders. Motion carried. Motion carried. 107734 - Mollenhoff/Getty that "Resolution authorizing award of contract to Cedar Valley Corporation of Waterloo, Iowa in the amount of $2,255.00 per hour in conjunction with Downtown Snow Removal for 1996-97 Winter Season", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1996-774. ORAL PRESENTATIONS 107735 - L.C. Hennessey, 717 Eastgate, congratulated Mayor Rooff and the good work that is being done in the city. He commented that as a child he worked to plant and sell vegetables to neighbors. He realized the value of a profit after laboring to grow and sell his produce. He would like to comment on the contract with Koll Realty for a $25,000 monthly fee. They should have to produce something before getting paid. He quoted Rick Young as stating Koll hasn't produced anything for the city as a result of their fee. Hennessey supports cancellation of their contract. Hennessey quoted Bob Heaton as defending Koll's services and his concern if they would leave town. Hennessey asked where would Koll go. Hennessey suggested that an outlet center would be appropriate at the airport. Jimmie Porter, 1322 Northey, expressed his condolences to the Rooff family for the death of a member. He asked to discuss a matter pertaining to a daycare center with councilpersons Getty and Collier after the meeting. Getty/Mollenhoff that the above oral comments be received and placed on file.
