UNFINISHED BUSINESS 107306 - Mollenhoff/Jordan that communication from Building Official transmitting recommendation of award of contract in the amount of $522,300 to Cardinal Construction of Waterloo, Iowa in conjunction with F.Y. 1996 Parking Ramp Renovation Project (East 5th, West 5th and Commercial Streets), be received, placed on file and "Resolution approving said award of contract", be adopted. Motion carried. 107310 - Getty/Murphy that the request of the Black Hawk County Supervisors that the City of Waterloo approve and accept a Quit Claim Deed from Black Hawk County for property generally located at East Eighth and Mulberry Streets, together with recommendation of denial of Park Commission be received, placed on file and request be denied. Prior to a vote on the above motion, the following comments were heard. Murphy stated it bothers him to accept additional liabilities through our $25,000 deductible for something already in place and county owned. Mollenhoff respectfully responded that the city already has enormous liability in streets alone. Mollenhoff is concerned with addressing the need to have a place for kids to play. Jordan concurred with Mollenhoff and feels the city has a responsibility to provide children with places to play. Collier agreed that a playground is well needed but the equipment needs to be replaced or repaired. He asked how much money will be needed to get the right equipment. Krizek asked if there will be fencing and supervision for the lot. Getty said he felt that the county has chosen the city as the place to dump another item they don't want. He feels the county should look at it again with the organizations that are volunteering time and money. Ayes: Seven. Motion carried. 107318 - Jordan/Collier that communication from City Planner transmitting Neighborhood Recognition Application from M.A.P.L.E.S. Neighborhood Association, be received, placed on file and "Resolution approving said application", be adopted. Prior to a vote on the above motion, the following comments were heard. Norm Granger, Allen Hospital, reported that this is a neighborhood association which covers all residents, business and schools. The name M.A.P.L.E.S represents Mt. Carmel Village, Allen Hospital, Prairie Park Apartments, Logan Intermediate, Emergency Fire Rescue Station 3 and St. Paul's Church. Following comments a vote was taken on the above motion with the following result. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1996-608. 107319 - Anders/Murphy that an agreement with City of Cedar Falls and Carol French Johnson for Sharing of Library Director Services for the period of August 5, 1996 through February 6, 1998, be received and placed on file. RESOLUTIONS TO BE ADOPTED 107320 - Krizek/Jordan that communication from Executive Director of Silos & Smokestacks transmitting an application to secure R.I.S.E. funding for a Local Development Project in the amount of $500,000 for the Silos & Smokestacks Public Market and Tourist Information Center, with the local match of $250,000 to be provided by Silos & Smokestacks, be received, placed on file and "Resolution approving said application", be adopted and Mayor authorized to execute same. ORDINANCES TO BE ADOPTED 107321 - Anders/Murphy that "an Ordinance repealing Section 27-6, Discharging and Possessing Air Rifles and Similar Devices, Prohibited; Exception of Chapter 27, Offenses --Miscellaneous; and enacting in lieu thereof a new Section 27-6, Discharging and Possessing Air Rifles and Similar Devices Prohibited, Exception of Chapter 27, Offenses --Miscellaneous (license bow deer hunting as allowed by the Iowa Department of Natural Resources under its Special Deer Management Zone procedures for a two year period)", be received, placed on file, considered and passed for the first time. Prior to a vote on the above motion, the following comments were heard. Jordan asked who is liable for the deer management zone. City Clerk Fangman reported that the owner and manager of the property is the Department of Natural Resources. The city is addressing the matter because it is within the city limits. Mollenhoff asked if there is liability from the act of passing the ordinance. City attorney Jim Walsh informed the council that they cannot be held liable for policy decisions. Lawsuits may be filed but not successfully as policy makers have immunity.
