Resolution adopted and upon approval by Mayor assigned No. 1996-498. 107075 - Getty/Jordan that communication from City Planner transmitting Preliminary Plat of Klingaman Park First Addition, together with Engineer's Certificate of Survey, Deed of Dedication, and Resolution of Planning, Programming and Zoning Commission, be received, placed on file and"Resolution approving said preliminary plat", be adopted. Before a vote on the above motion, the following comments were heard. Wayne Lowe, 4789 CLover Lane, spoke at the Planning and Zoning meeting on June 6, 1996 and successfully stopped the zoning for commercial and residential development in this plat. After that meeting he met with a representative from Young Development and personally requested that the streets not be made to open into the new plat. He was told that someone would get back to him in two weeks but no one contact him. The last time anything was done to the streets in this area was in 1982. Residents requested that paved street be put it into the subdivision and the City offered to provide them through an assessment program. The cost of the program resulted in the request being pulled by the citizens Just recently the streets were seal coated and are now in good condition. His primary concern is that they remain in good condition. Marilyn Belthius, 4855 Williams Drive, would be affected if through streets are created as Williams will be a connector. The streets in this area have just been seal coated and residents are concerned with keeping them in good condition. They are worried about contractors tearing them up during construction. Rick Young, Young Development, stated that he is convinced. that this area will need a commercial are on the south side of the development. As the city moves to more neighborhood oriented sections, each neighborhood has traditionally had a convenience store for sundry items. He has asked Planning, Programming and Zoning to amend their overall plan to address this need. The neighborhood was established outside the city limits to begin with to avoid city taxes but now want to avail themselves to all the amenities. As a developer he will be required to provide streets, sewer and water to new residences and those property owners will bear the cost. He doesn't care if the streets are designed as through streets or cul de sacs however Planning recommended the through street design. City Planner Don Temeyer reported that it is city staff's opinion on future planning that through streets be established in all plats. The plats and street design of Klingaman Park First Addition should pull traffic away from the unimproved streets by emptying onto Hoff Road or down to Shaulis Road. It is best to provide public safety and public access to new areas of development with through streets. Councilperson Murphy stated that he will monitor this area with the neighbors and move to address concerns before they become costly. Motion carried. 107086 - Mollenhoff/Collier that "an Ordinance amending the 1991 Traffic Code by: adding Subsection (2a) Linden Avenue to Section 556, No Parking Here to Alley (install "no parking here to alley" sign in the 200 block of Linden Street)", be considered and passed for the second and third times and adopted. Motion carried. 107088 - Krizek/ Mollenhoff to table indefinitely the consideration of the "Ordinance repealing Subsection (358) South Street of Section 551, Parking Prohibited at all Times on Certain Streets, and enacting in lieu thereof a new Subsection (358) South Street of Section 551, Parking Prohibited at all Times on Certain Streets (reinstall "no parking this side" signs on the southwest side of South Street in the 100 block). Motion carried. 107089 - Jordan/Krizek that an Ordinance amending the 1991 Traffic Code by adding a new Section 418, Street Vendors Prohibited (prohibiting persons from using public property or parking areas to conduct business)", be received, placed on file, considered and passed for the first time. Before a vote on the above motion, the following comments were heard. Roger Kalsem, 427 Belle St, introduced himself as the old sweet corn guy, seen on corners for years. He asked that the council work with the vendors to solve this problem. As he sees it there are two options, ban selling on public property or work with vendors to establish criteria for permitting sales on public property. City property is some of the best for vending. He understands the concerns about liability exposure but asked that the council consider how vendors enhance the city. He asked their cooperation in working out different policies than this ordinance as a solution to the problem. Kevin Kalsem, 427 Belle St, expressed how he would hate to see our free enterprise system have a cap placed on it through this ordinance. He would recommend that a variance be established to allow local home grown produce vendors to have preference. Councilperson Mollenhoff supports the idea of entrepreneurship and feels the council should be looking at how this will affect the downtown area. He recognizes that we need to generate excitement in downtown and street vendors may help bring more citizens downtown. Councilperson Murphy agreed and would like to delay any action to look into the matter more. Councilperson Getty stated that he would suggest it be monitored through a permit system and vendors be required to clean up their area after use.
