UNFINISHED BUSINESS 106439 - Mollenhoff/Murphy that communication from Associate Engineer transmitting recommendation of award of contract to B & B Builders & Supply of Waterloo, Iowa in the amount of $504,967.58 in conjunction with F.Y. 1996 Concrete & Structures Repair Program, Contract No. 502, be received, placed on file and "Resolution approving award of said contract", be adopted. PETITIONS FROM PUBLIC 106440 - Krizek/Jordan that communication from City Clerk transmitting request of Gary Rankin, Young Plumbing & Heating, for an exception to burning of yard waste to burn creek bottom vegetation, assorted grasses and woody plants on property located in the creek area from east of West Fourth Street to Ridgeway Avenue from between Kingswood Place and Pinehurst Lane, together with recommendation of denial of Superintendent of Parks and Fire Chief, be received, placed on file and request be denied. Prior to a vote on the above motion, the following comments were heard. Gary Rankin, 1470 Oakcrest, identified the area he is requesting to burn as the creek bottom running alongside several properties between West Fourth Street and Ridgeway Avenue. He is requesting the burn to eliminate weeds and shrubs which are impeding the waterflow. This has created a backup of water during heavy rainfalls. The water is backing up onto Fourth Street and overflowing the sanitary sewer system. Rankin contacted the properties owners of Kingswood Place and Quail Valley Apartments and they have given their approval of the proposed burn. Councilperson Krizek informed Mr. Rankin that the request was discussed with the Fire and Parks department staff. It has been suggested that individuals ordered to community service could be utilized for this project. Juvenile Court Services can be contacted for persons that might be available for this type of work. Fire Chief Magsamen recommended denial of this burn because of the lack of controlled area and the proximity to residences. He agreed to work with Mr. Rankin if the area was thinned and product to be burned was cut into size which complies with the City's burning policy. Following comments a vote was taken on the above motion with the following result. Ayes: Seven. Division 2, Pawnbrokers and Secondhand Goods Dealers of Article II, Specific Businesses and Occupations, of Chapter 23, Licenses and Business Regulations, of the 1993 Code of Ordinances of the City of Waterloo, Iowa; and enacting in lieu thereof a new Division 2,. Motion carried. 106454 - Collier/Murphy that "an Ordinance repealing Division 2, Pawnbrokers and Secondhand Goods Dealers of Article II, Specific Businesses and Occupations, of Chapter 23, Licenses and Business Regulations, of the 1993 Code of Ordinances of the City of Waterloo, Iowa; and enacting in lieu thereof a new Division 2, Pawnbrokers, and Division 2.1, Secondhand Goods Dealers, of Article 11, Specific Businesses and Occupations, of Chapter 23, Licenses and Business Regulations, of the 1993 Code of Ordinances of the City of Waterloo, Iowa (separating pawnbrokers and secondhand goods dealers licenses)", be considered and passed for the second and third times and adopted. Ordinance adopted and upon approval by Mayor assigned No. 4161. 106455 - Anders/Collier that "an Ordinance amending the 1991 Traffic Code by: repealing Subsection (21) Falls Avenue of Section 541, Increasing Speed Limits in Certain Areas; and enacting in lieu thereof a new Subsection (21) Falls Avenue of Section 541, Increasing Speed Limits in Certain Areas; and by repealing Subsections (11) Bismark Street and (42) Falls Avenue of Section 543, Thru Streets; and enacting in lieu thereof new Subsections (11) Bismark Street and (42) Falls Avenue of Section 543, Thru Streets (four-way stop at Magnolia and Falls Avenue, four-way stop at Magnolia and Bismark Street and reducing the speed limit from 30 mph to 25 mph on Falls Avenue from Fletcher Avenue to Ansborough Avenue)", be received, placed on file, considered and passed for the first time. Prior to a vote on the above motion the following discussion was heard. Councilperson Mollenhoff requested that the maker and second of the motion agree to the extension of the 25 mph speed limit on Falls Avenue beyond Fletcher Avenue all the way to University Avenue. Councilperson Anders asked for input from the Superintendent of Traffic Operations with regard to the proposed change. Mike Mrzlak, Superintendent of Traffic Operations, stated that he would have no problem with the proposed speed limit change. His department has checked the area to see if it warrants a traffic signal but it does not comply. Police Chief Koehrsen reported that he would fully support the request to lower the speed limit as their officers have been needed to increase speed enforcement in the area. The maker and second of the motion agreed to reduce the speed limit from 30 mph to 25 mph on Falls Avenue from Fletcher Avenue to University Avenue. The motion passed as a result of the following vote. Ayes: Seven. Motion carried. Councilperson Krizek asked that Mrzlak review the speed limits surrounding all the city's schools to assist in the protection of our children. Councilperson Anders asked that an update to the signage be completed at the same time.
