Jim Walsh, City Attorney, stated that Hunt -Wesson's sewer fees are not being
abated, and that they will be charged the same amount of fees as other industrial
users. IBP and Eagle Tanning are the only industries that are paying a
discounted sewer rate.

Ayes: Seven. Motion carried.

that rules requiring ordinances to be considered and voted for passage at two
prior meetings be suspended.
Prior to a vote on the above motion, the following comments were heard.
Councilperson Anders stated that due to the opposition of the rezoning request
that the council not suspend the rules and that the ordinance be read three times
before passage.
Councilperson Jordan stated that he usually supports suspending the rules, but
that this request has been reviewed and voted on by the School Board and has been
in public view for approximately two months.
Following discussion, a vote was taken on the above motion with the following
result. Ayes: Five. Nays: Krizek, Anders. Motion failed.
PETITIONS FROM PUBLIC

that communication from Assistant City Planner transmitting request of Waterloo
Tent & Tarp Co. for a "M -2,P" Planned Industrial District site plan for property
generally located in Lot 5 MidPort America Park Plat No. 1 for a 30,000 square
foot building to be constructed on the site, with 30 off-street parking spaces,
access drive and associated landscaping, be received, placed on file and
"Resolution setting date of hearing as September 8, 1997 at 7:00 p.m. in the City
Hall Council Chambers on the above described request", be adopted and City Clerk
instructed to publish notice of same.
Prior to a vote on the above motion, the following comments were heard.
Kathy Oberle, 1101 Western Avenue, stated that she is not against Waterloo Tent &
Tarp Co. She reminded the council that Meany Casket requested many of the same
incentives. Ms. Oberle stated that as a resident purchasing new property she
would not be offered tax abatement. When Waterloo Tent & Tarp Co. moves to the
new location in MidPort America they will have their taxes abated for many years.
Ms. Oberle stated that many other businesses have left the community because they
were not offered the same incentives as Waterloo Tent & Tarp. Following
discussion, a vote was taken on the above motion with the following results.
Ayes: Seven.

ORAL PRESENTATIONS
109021 - Nick Greco, 5435 Foulk Road, presented a petition from residents of the Suburban
Heights Addition opposing the construction of a double wide mobile home and a pond
in the 5400 block of Foulk Road. Mr. Greco stated that the property formerly was
farm land but it is now zoned as residential. The citizens in the neighborhood
are concerned about the value of their homes if a double wide mobile home is
constructed on the property. Mr. Greco stated that the value of the homes in the
area range from $60,000 to $100,000, and that they question what Tim Brustkern is
going to do with seven acres of property that he owns in the area.
Jim Walsh, City Attorney, stated that the Zoning Ordinance defines mobile homes
and manufactured homes, and that a manufactured home would be allowed on that
property.
Mayor Rooff stated that he and the council will work with the residents on this
issue and do whatever they can to make sure the development only enhances the
residents' homes. Mayor Rooff and the Council will visit their neighborhood.
Kevin Gaul, 4238 Suburban Drive, stated that he purchased his home in that area
because of the people and the quiet atmosphere. Mr. Gaul was raised on a farm and
wanted that kind of atmosphere for his children. He is concerned about the value
of the homes if mobile homes are allowed.
A resident of 4152 Suburban Drive stated that he is concerned that nothing has
been decided Mr. Brustkern has been moving dirt He questioned what has been
decided regarding streets and setbacks.
Mayor Rooff stated that the residents should have questions prepared when the
council visits the property as city staff will be along to answer questions.
Lou Cutwright, Building Official, stated that Tim Brustkern took out a permit on
July 7, 1997 for property located at 5322 Foulk Road.
A resident at 5050 Foulk Road questioned if they would need foundations, basements
and be required to meet other city codes
Lou Cutwright, Building Official, stated that by state law the city cannot require
any more than the manufacture would require to support that home. The homes are
not required to have basements but foundations. Appearances cannot differ from
the other foundations in the neighborhood.
City Attorney Jim Walsh stated that some neighborhoods have deed restrictions, and
he suggested that the citizens have their attorney investigate to see if their
area has deed restrictions.
