July 18, 1997 ORDINANCES TO BE ADOPTED - CONTINUED Page 4 Mayor Rooff asked Fire Chief Magsamen if he had met with Mr. Fix to discuss language change to the ordinance. Fire Chief Magsamen stated that he met with Mr. Fix immediately following the council meeting on August 11, 1997. Mr. Fix was to review the ordinance and contact Chief Magsamen with any changes. Mr. Fix has not contacted Chief Magsamen at this time. Following discussion a vote was taken on the above motion, with the followi result. Ayes: Seven. Al Carrier, Police Officer, to attend Veteran Officer Tactical Review Course International Association of Chief's of Police in Maple Grove, Minnesota on September 8-9, 1997, with costs not to exceed $525.00. 3. Motion carried. ORAL PRESENTATIONS 108977 - Ron Hemenway, 315 Vinton, presented a petition from his neighbors in support of a fence he installed. Mr. Fix installed the fence around a tree adjacent to the alley. The city has received complaints that the fence is located on city right- of-way and for him to remove the fence. Mr. Fix requested that he be allowed to purchase the right-of-way, and that he not be required to remove the fence. Mayor Rooff referred this item to the Planning Department for review, and to report back to the council in one week. Don Temeyer, City Planner, stated that the Planning & Zoning Department has reviewed this request. Mr. Hemenway's request will need to go the Planning, Programming and Zoning Commission and will be brought back to the council in three weeks Councilperson Mollenhoff stated that he does not want Mr. Hemenway to be penalized until the Planning, Programming and Zoning Commission's next meeting. Collier/Jordan that the pictures and petition in support of the fence at 315 Vinton be received and placed on file. Ayes: Seven. Motion carried. 108978 - Councilperson Krizek stated that since the city closed llth Street, Hannah and South Street, citizens have been using Grant, Randall and Leavitt. There have been several accidents. Eric Thorson, City Engineer, stated that llth Street should be opened by Tuesday or Wednesday. Marily Metzner, 644 West Donald, asked when West Donald Street will be completed. Eric Thorson, City Engineer, responded that West Donald will be completed this year. Ms. Metzner questioned when the West 5th Street ramp will be opened. Lou Cutwright, Building Official, stated that there is a little work to be completed in the ramp and that the elevator needs to be inspector.
