UNFINISHED BUSINESS
108766 - Getty/Collier
that communication from City Planner transmitting request of Metro Investments, Inc.
for a loan in an amount not to exceed $75,000 to develop a car wash at Logan Plaza,
with a 10 -year amortization and 5 -year balloon at 6.5 percent, subject to a local
lending institution participating in the project financing, be received, placed on
file and request denied. (This item was approved on June 23, 1997 and is being
reconsidered per motion of the City Council on July 7, 1997).
Prior to a vote on the above motion, the following comments were heard.
Hugh Field, 620 Lafayette Street and attorney for the applicant, stated that he was
confused as to where the project stands.
Mayor Rooff stated that he was out of town on June 23, 1997 when this issue was on
the council agenda. When he returned to his office, he polled the council
individually. The council had been made aware that Howard Allen, the applicant for
the loan, was a convicted felon for drug trafficking. Mayor Rooff spoke with Mr.
Allen. The Mayor feels that he gave his intent to veto the resolution adopted on
June 23, 1997.
Mr. Field informed the council that the resolution became law after Mayor Rooff
failed to veto it within 14 days and it was published in the Waterloo Courier. Mr.
Walsh received a letter from Assistant City Attorney Sang -Ki Han stating that Mayor
Rooff vetoed the resolution. Mr. Han made reference to June 25, 1997. On today,
July 14, 1997 Mr. Field received a letter from City Attorney Jim Walsh that Mr. Han
was mistaken, that there was no written veto from the Mayor. Mr. Field stated that
planning to veto and vetoing are not the same thing. Mr. Field was confused at to
what was happening at tonight's meeting. He stated that there was nothing on the
council agenda of July 7, 1997 that the council was going to reconsider the request.
The Open Meetings Law states that governing bodies must apprise the public of what
is on the agenda and the motion to reconsider was not on the council agenda of July
7, 1997. Mr. Hugh noted that this city council established its basis for reviewing
the loan applications.
Mayor Rooff stated that this item was brought up for reconsideration at the July 7,
1997 council meeting to be placed on the council agenda of July 14, 1997. Mr. Rooff
reminded Mr. Field that Mr. Field asked him to poll the council. Mayor Rooff stated
that the council felt it did not have enough information and asked that the
application be reconsidered.
Mr. Field pointed out to the council that the council established the standards for
these applications one year ago. He stated that the mayor cannot veto the
resolution because it's too late. He questioned how many loans have been approved
for known felons.
Mayor Rooff responded that the council had a responsibility to the citizens once
they discovered Mr. Allen's convicted felon record to reconsider the request. The
mayor reiterated that no open meetings law was violated.
Mr. Walsh expressed his opinion that the city council meeting is no place to debate
legality. He stated that a motion was made at the July 7, 1997 council meeting to
reconsider the application at the July 14, 1997 council meeting and thereby notice
was given. The council can reconsider issues, they do it all the time. Mr. Field
stated that the bell is rung and you cannot undo it.
Mr. Walsh stated that he would feel much more comfortable before a judge arguing why
a loan was reconsidered than he would standing before a taxpayer explaining why a
convicted drug dealer received a city loan to construct a car wash in an area
sensitive to drug problems
Val Martin, 3433 Rosehill Terrace, stated that Waterloo has been a city of
opportunity for her. Ms. Martin stated that she has known Mr. Allen as a landlord
who takes care of his tenants. She feels Mr. Allen has done a tremendous job taking
care of his tenants.
Margaret Stoutner, insurance agent, has found Mr. Allen to be trustworthy and
honest. Mr. Allen has done nothing but improve property for the city of Waterloo.
She asked that council not reconsider the application.

Huting, Superintendent of Parks, stated that the ordinance is for one year.
Councilperson Murphy stated he has heard from residents in the Katoski Greenbelt
area who are concerned that this ordinance will increase illegal deer poaching
during the deer hunt.
Jennifer Lancaster -Woodley, Department of Natural Resources officer, stated that the
deer hunt should cut down on the poaching.
