Rooff in the Chair. Roll Call: Getty, Jordan, Krizek, Murphy, Collier, Mollenhoff, Anders. 108469 - Jordan/Mollenhoff that the Agenda, as proposed, for the Appeal Hearing on Tuesday, May 27, 1997 at 6:30 p.m., be accepted and approved. Ayes: Six. Absent: Anders. Motion carried. APPEAL HEARING 108470 - HOLD HEARING --This being the time and place of public hearing on request of Shannon Nielson to appeal city orders directing her to remove or destroy a pitbull and rottweiler, the Mayor called for written and oral objections. Anders now present at 6:31 p.m. Mayor Rooff asked for statements from the persons petitioning to have the animals removed. Mary Nielsen, 1228 Northey, introduced herself as a silent neighbor, but has called the Humane Society on numerous occasions about the animals owned by Shannon Nielson. She lives closest to Shannon and the two dogs in the order have been loose. Her grandchildren can't come over and play outside or her husband mow the lawn. There is now a small kennel in the yard for four dogs. Mrs. Nielsen did witness a neighbor being chased by the rottweiler and forced to run up on top of a car. Shannon's husband is very abusive and beats the dogs. She personally witnessed the man beating one of the dogs with a two by four. The two dogs are mean and will growl and bark at you if you are out. Previously the backyard fence was not tied down so the animals could get loose. Humane Society Officers Athey and Hepler detailed the complaints received by the Humane Society in reference these animals. On May 1st officers went to the home and issued the order to remove the vicious animals. The order was issued largely because of the complaints and comments about shooting the animals from neighbors. Officers did take each animal out of the sight of the owner and played and tussled with them. Both animals were very friendly and never showed vicious tendencies toward the officers. The Humane Society did issue the citation for animals at large but haven't witnessed the animals chasing anyone. Lisa Hickman, 1216 Northey, stated she has called the Humane Society numerous times about the animals. Shannon did respond to her complaints by laughing and saying the Humane Society wouldn't do anything because they have friends working there. The dogs come over and defecate in the neighbors yards' and the owners never clean up after them. Jack Edwards, 1234 Northey, stated that he has witnesses seeing the dogs chasing after him. He called Animal Control about their not issuing tickets. He has witnessed the dogs attacking a friend's dog in the yard also. Attorney Eric Johnson questioned his client Shannon Nielsen. Nielsen was asked how long she has had the dogs. Nielsen responded that she has had both dogs their whole lives, one is two years old and one three years old. Johnson asked about the care of the dogs when the Nielsen's were not at home. Nielsen stated that the animals are in crates in the house when she or her husband aren't home. After they are home the dogs are usually in the house or let out into the fenced back yard. Adolph has been through obedience school. Nielsen has a one year old daughter and wouldn't let the dogs around her if they were vicious. Nielsen denied knowing that the dog has gotten out and chased someone. The dogs have gotten out once. She is willing to put up a privacy fence and leave up the chain link fence. Lisa Hickman reported that the animals have gotten out on numerous occasions and Mrs. Nielsen has never apologized but responded that there "isn't anything she can do". Hickman asked why the Humane Society didn't issue a citation for the complaint from Mr. Edwards about the dogs at large on April 29. Human Society noted that the log indicates the animal was chased home and the owner put the dog in the house with no citation issued. Johnson asked the Humane Society how many complaints about the animals have been received. Jody Hepler reported that they have a new computerized system to log complaints. The new system shows that the first complaint logged was on April 20th about vicious dogs at large. Several more complaints were received but officers were not able to identify the dogs were at large. Linda Morrison, 1240 Northey, went to the Humane Society and was told that Shannon's friend no longer works there. She has called to complain about the dogs at least three times in the last year. Morrison feels that the Humane Society is covering up. Mary Nielson, 1228 Northey,stated that Shannon's back yard needs to be seen. The rottweiler has stripped all the bark off a couple of thirty year old walnut trees. Hickman complained that the Nielsen's have never cleaned up after the dogs in three years. Bill Grimm, 1710 Forest Ave., reported the city went out and cut branches on the trees many times. The number of times that tires are squealing is evident that the placement of signs is a matter of safety. Two petitions have been presented in the past and the safety of the intersection is a concern. Following comments a vote was taken on the above motion with the following result. Ayes: Five.
