Mayor John R. Rooff in the Chair. Roll Call: Getty, Murphy, Jordan, Krizek, Gronen, Collier, Anders ORAL PRESENTATIONS 111229 - Dwayne Eilers; 2260 Independence Avenue, reported that the Fire Department has again asked to inspect 1930 Drew, which is for sale. Mr. Eilers questioned why the Fire Department wants to inspect the property when they have already performed an inspection at 1930 Drew. Mr. Eilers stated that the letter he received from the Fire Department last time stated he had 60 days to make repairs. Sixty days after Mr. Eilers received the letter, the Fire Chief ordered the house boarded up. Mr. Eilers questioned why he is different from everyone else in the community because he does not feel the Fire Department inspects every house that is for sale in the community. Mr. Eilers stated that he met with city staff andcouncil members at his properties, and they were fine. Fire Chief Frank Magsamen stated that the property was boarded up after the letter was sent out on August 13, 1998, and Mr. Eilers was given proper time to properly secure the property. Chief Magsamen stated that the property was secured in October, which was the proper time frame. Chief Magsamen reported that the site has had ten fires. The housing inspector reviewed 11 different properties and identified corrections on some of the properties. Mr. Eilers owns four of the properties that were identified in need of repair. Chief Magsamen stated that at the meeting there was discussion to set up another meeting. Chief Magsamen reported that Mr. Eilers has removed the boards from the mobile home. Mr. Eilers stated that Chief Magsamen originally checked the property and said the door was unlocked. Chief Magsamen stated that he has not checked the property, and that it is his understanding that there was going to be another meeting with Mr. Eilers to see if doors and windows were properly secured. Mayor Rooff stated that Mr. Eilers said he was going to take the boards off the property. Mayor Rooff reported that he told Mr. Eilers that the city would hold a neighborhood meeting to discuss the property. Mr. Eilers stated that a lady at the meeting questioned that if the city was going to board up the mobile home, why not board all of them because they are worse than his. Mayor Rooff stated that the city will have a neighborhood meeting open to the public. Mayor Rooff stated the neighbors are scared to death because of all the fires. Mr. Eilers stated that this is the third time that the Fire Marshal has, under orders from the city, boarded up his property. Mayor Rooff questioned if the property was safe. Mayor Rooff stated that if Mr. Eilers thinks he is being harassed he should take the necessary steps. Mr. Eilers asked why the city is not fair to everyone, that there are properties in the city that have not been inspected in years. Mayor Rooff stated that the city is trying to keep up with the problem calls, and that is why staff is out in that area. Mr. Eilers questioned why the police and fire departments are not doing something about the fires. Mr. Eilers questioned what is being done about the burned out property. Mayor Rooff stated that the city will be out to inspect Mr. Eilers' trailers. Jordan/Murphy that the above oral comments be received and placed on file. Ayes: Seven. Motion carried. Motion carried. 111244 - Krizek/Anders that "an Ordinance vacating the east -west unimproved alley generally located between Adams and Webster Streets, west of Hewitt Street", be considered and passed for the second and third times and adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 4329. 111245 - Jordan/Collier that "Resolution authorizing sale and conveyance of said property", be adopted and City Attorney instructed to prepare and deliver a deed accordingly.
