111199 - Anders/Jordan
that communication from Assistant City Planner transmitting request of Jim
Blackledge on behalf of Max Guernsey for a site plan amendment to the "S-1"
Shopping Center Commercial District for property located at 357 Fletcher Avenue
for construction of an additional building to enclose the existing hoist area,
together with the recommendation of approval of the Planning, Programming and
Zoning Commission, be received, placed on file and "Resolution setting date of
hearing as December 7, 1998 at 7:00 p.m. in the City Hall Council Chambers on the
above described request", be adopted and City Clerk instructed to publish notice
of the same. Ayes: Seven.

111200 - Getty/Jordan
that communication from Assistant City Engineer transmitting appeal of Odell
Walker to City Engineer's decision to deny request for a curb -cut at the
southeast corner of Boston Avenue and East Donald Street, together with
recommendation of the Planning, Programming and Zoning Commission to affirm City
Engineer's decision of denial, be received, placed on file and approved.
Prior to a vote on the above motion, the following comments were heard.
Councilperson Getty stated that Mr. Walker contacted him and Councilperson
Collier. Mr. Walker would like to build an attached garage to his residence and
use Donald Street as an ingress and egress. Councilperson Getty stated that Mr.
Walker's request is no different than other houses already have on Donald Street
Councilperson Getty stated that one of the reasons staff has recommended denial
is that some day this area might be used for a bike trail. Councilperson Getty
stated he feelsthat if a bike trail is constructed in the area it will be put on
the south side of Donald Street and not on the north side. Councilperson Getty
recommended that the council vote no to the Engineer and Planning, Programming
and Zoning Commission's recommendation of denial and approve the curb cut.
Following discussion a vote was taken on the above motion with the following
result. Ayes: One. Nays: Getty, Murphy, Jordan, Gronen, Collier, Anders.
Motion failed.
111201 - Collier/Murphy
that an exception to Section 33-10 of the Waterloo Code of Ordinances be granted
and the request of Odell Walker for a curb -cut at the southeast corner of Boston
Avenue and East Donald Street be approved. Ayes: Six. Nays: Krizek.
Resolution adopted and upon approval by Mayor assigned No. 1998-709.

that communication from Assistant City Planner transmitting appeal of Stephen and
Joan Summerhays to City Engineer's decision to deny request for a curb -cut at the
northeast corner of Baltimore Street and Lorraine Avenue, together with
recommendation of the Planning, Programming and Zoning Commission to reverse City
Engineer's decision and approve appeal, be received, placed on file and
"Resolution approving said curb -cut", be adopted.
Prior to a vote on the above motion, the following comments were heard.
Councilperson Anders questioned why staff recommended denial of the request.
Eric Thorson, City Engineer, stated that Section 33-10 of the Waterloo Code of
Ordinances requires that when access is from corner lots which front onto major
or minor arterials, access shall be limited to the street with the least
vehicular traffic Mr. Thorson reported that traffic volume on Baltimore Street
is approximately 2,900 vehicles per day compared to 200 to 300 vehicles per day
on Lorraine Avenue. Mr. Thorson stated that he recommended against the request
for a curb -cut on Baltimore Street because the use of lesser -volume streets is in
accordance with city rules and was a good engineering practice.
Following comments a vote was taken on the above motion with the following
result. Ayes: Six. Nays: Krizek.

that "an Ordinance amending the 1996 Traffic Code by adding Subsection (21a)
Rachael Street to Section 552, No Parking Between Signs (installation of No
Parking Between Signs on Rachael Street at the intersection of Nancy Road)", be
received, placed on file, considered and passed for the first time.
Prior to a vote on the above motion, the following comments were heard.
Mike Hoover, 941 Nancy Road and a student at Sacred Heart Catholic School, stated
the following five reasons why he requested the above ordinance change: 1) When
kids are coming home from the park, people driving their cars cannot see the kids
because of all the cars parked along Rachael; 2) When cars are coming down
Rachael and vehicles on Nancy are turning onto Rachael, they almost hit each
other; 3) When one vehicle is going east on Rachael and another is going west,
with all the parked cars they are inches from hitting one another; 4) Sometimes
kids have to stick their hand out between the parked cars so other cars driving
down Rachael can see them; 5) On soccer nights people park on Rachael when they
could park behind Hoover School in the parking lot.
Mayor Rooff thanked Mike for bringing this before the council. Mayor Rooff
stated that the council needs Mike's perception because he is out there with the
other kids.

term expiration of December 1, 2001; Norman Duquette with alternate Ira Kimm with
term expiration of December 1, 2000; and Lt. Joe Sink as the City's alternate
representative with term expiration of December 1, 2000, be received and placed

Mayor Rooff thanked the following members of the Fire Department who have
volunteered their time to help with restoration of Memorial Hall: Ray Moore,
Roger Boyd, Joe Sink, Tom Siglin, Matt Knox, Craig Schellhorn, Ben Petersen, Chad
Petersen, Bryan Shannon, and Jeff Palmer. Mayor Rooff stated that people are in
awe of the work that has been done at Memorial Hall, and he thanked them for
their commitment. Mayor Rooff accepted a check in the amount of $250 from the
North East Iowa Chapter 861 of the Military Order of the Purple Heart to be used
in the restoration of Memorial Hall.
