The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa, at 7:00 p.m., on Monday, October 26, 1998. Mayor John R. Rooff
in the Chair. Roll Call: Getty, Murphy, Jordan, Krizek, Gronen, Collier, Anders.
ORAL PRESENTATIONS
111126 - Dwayne Eilers, 2260 Independence Avenue, reported that he has received another
notice from the city wanting to inspect another one of his homes. Mr. Eilers
stated he telephoned Fire Chief Magsamen and asked how often rental homes are
inspected, and Chief Magsamen told him once every five years. Mr. Eilers stated
that his homes have been inspected every three years. Mr. Eilers checked with
the Black Hawk. County Courthouse and found two people whose homes have not been
inspected in 11 years, and he wants to know why his property is being inspected
every 3 years.
Dennis Duggan, Assistant Fire Chief, stated that all the information on homes in
the city is received from the Black Hawk County Courthouse. The information is
put into the system and inspections are done by the list generated from the
information, starting from top to bottom. Duggan stated that usually when the
Fire Department receives two substantiated complaints, the building is inspected
yearly.
Mayor Rooff stated that he, Fire Chief Magsamen and Councilperson Collier have a
meeting with Mr. Eilers tomorrow at 9:00 a.m., and he asked Mr. Eilers to bring
his list to the meeting. They can take his list containing the two names to the
courthouse and ask them how they compile the information.
Councilperson Collier questioned Mr. Eilers if he has removed the mobile homes
that were damaged in the fires at the Woodland Terrace Mobile Home Park. Mr.
Eilers responded all but one with a steel frame, and that he is waiting for the.
salvage company.
Joyce Wilder Marshall, 1030 Webster, stated that she appeared before the council
a few weeks ago. Ms. Marshall stated that last Tuesday she was threatened
because she had gone to the council with her concerns. Ms. Marshall stated that
she filed a police report of the incident.
Mayor Rooff responded that the Eastside Ministerial Association is in charge of
funding for citizens in need of assistance.
Mayor Rooff reported that Councilperson Getty celebrated his 59"' birthday on
Sunday, October 25, 1998. Mayor Rooff stated that he attended an award luncheon
at IBM a few weeks ago where Councilperson Collier was recognized for 25 years of
service with IBM.

tried to establish parking for his customers. Mr. Pedersen stated that the
proposed ordinance is a thinly veiled attempt to take parking away from Mr.
Litzkow's customers and take away his business.
Jim Walsh, City Attorney, stated that this matter has a long history that goes
back many years. The issue we are looking at is parking under control or is it a
visual problem. Mr. Walsh stated that if the council believes the ordinance is
going to stop parking in the street then they should adopt the ordinance, and Mr.
Litzkow will have to secure off-street parking.
Mayor Rooff asked if the parking area is being used for customers or junk cars.

service to the city. Mr. Pedersen reported that tonight there is one car
ditch, and Mr. Litzkow has reported the car to the police. Mr. Pedersen
that there are administrative members who do not want Mr. Litzkow in business.
Mr. Pedersen stated that the plan to move the vehicles to the north side of
Hawk Road was proposed by city staff,
Board of Adjustment and the Planning,
staff recommended denial.

Don Temeyer, City Planner, stated that citizens in the neighborhood were opposed
to the plan, and that Mr. Litzkow wanted to expand the boundaries of the court
order. Mr. Temeyer stated that the plan was a solution that city staff felt
should be examined and put before the Board of Adjustments. Mr. Temeyer stated
that Mr. Litzkow moved his cars before the plan was presented to the Board of
Adjustments and neighbors were very upset.
Councilperson Gronen stated that he drove through Black Hawk Road. There are no
shoulders, and if you have to park you have to park on the road. Councilperson
Gronen stated that he had to drive 10 mph down the road.
Mr. Pedersen stated that he does not agree with Mr. Temeyer's recollection of
events regarding Mr. Litzkow's request to move his vehicles to the north side of
Black Hawk Road. Mr. Litzkow was told that appearing before the Board of
Adjustments and the Planning, Programming and Zoning Commission was a formality
and that city staff was behind the plan.
Mayor Rooff suggested that the council delay the second and third reading on the
proposed ordinance for two weeks to investigate whether Mr. Litzkow is within the
boundaries set by the court. Mayor Rooff stated that the city does not want to
put Mr. Litzkow out of business. Mayor Rooff would like to help Mr. Litzkow
comply with his court ordered boundaries, get junk cars off the road and review
in two weeks. Mayor Rooff stated that the city has received complaints that cars
keep encroaching on the road right-of-way.
Mr. Pedersen stated that there are a few people who have managed to keep this
going for ten years.
Mayor Rooff asked that Mr. Pedersen and Mr. Litzkow meet with Councilpersons
Gronen and Getty to come up with a solution. The city would like to provide
parking for his customers so there is not a problem with cars driving on Black
Hawk Road by Mr. Litzkow's business.
Mr. Pedersen stated that there has never been a problem, it is not a direct route
to anywhere.
