The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall
Council Chambers, Waterloo, Iowa, at 7:00 p.m., on Monday, October 19, 1998.
Mayor John R. Rooff in the Chair. Roll Call: Getty, Murphy, Jordan, Krizek,
Gronen, Anders. Absent: Collier.
ORAL PRESENTATIONS
111096 - Dwayne Eilers stated that he received a couple of letters from the Fire
Department that two of his mobile homes were in violation of the city's
ordinance. Mr. Eilers reported that he spoke with Fire Chief Frank Magsamen
regarding the violation, and Chief Magsamen informed Eilers that the city
received a complaint from a neighbor that the front door on the vacant mobile
home located at 1930 Drew was open. Mr. Eilers stated that a city crew spent
approximately an hour and a half boarding up the property, and he was billed
$142.00.
Fire Chief Magsamen responded that there was a fire at the mobile home located at
1930 Drew, and that the mobile home was vacant, and windows and doors were
accessible. The Fire Department sent a letter to Mr. Eilers on August 13, 1998
informing him to secure the mobile home for safety reason. Chief Magsamen stated
that when Mr. Eilers failed to comply, the city boarded up the doors and windows.
Mr. Eilers stated that the mobile home located at 1930 Drew did have a porch
fire, but that there was no damage to the mobile home, it was clean and safe, and
he removed the steps and does not feel it presents a hazard. Mr. Eilers asked
where does the city have the authority to board up his house because the door is
open.
Chief Magsamen stated that his department sent another letter to Mr.Eilers
regarding the property located at 1926 Eric. The letter was sent after the city
received a complaint from a neighbor that the kids were getting inside the home,
and the city asked Mr. Filers to meet them at the home to perform an inspection.
Chief Magsamen stated that the Fire Department follows City Code of Ordinances
regarding unsafe structures.
City Attorney Jim Walsh stated that vacant structures that are open and
constitute a fire hazard can be boarded up per City Code.
Mr. Eilers asked why Waterloo has more boarded houses than any city in Iowa.
Mayor Rooff stated that the city has 130 homes that need to be torn down, and
1,300 homes judged to be in a state of disarray. Mayor Rooff stated that his
administration wants to work with citizens and neighborhood groups to clean up
dilapidated city structures and make them safe. Mayor Rooff asked Mr. Eilers to
meet with Fire personnel.
Mr. Eilers stated that not one city official has sent one letter to him to let
him know what is going on with the investigation in the arson fires at mobile
homes that he owns in the Woodland Terrace Mobile Home Park.
Mayor Rooff and city staff will meet with Mr. Eilers at 1930 Drew on October 27,
1998 at 9:00 a.m.
Mary Haais, 116 Courtland, stated that there are homes in the 100 block of Irving
Street that need to be boarded up, and that there are vans in the street with
expired license plates.

Forest Dillavou, Huntington Road, asked if the city is notifying citizens when
they are making changes to parking on city streets. Mayor Rooff responded that
the citizens should be notified by mailed. Mr. Dillavou stated that he knows of
two citizens who were not notified of tonight's changes. Mayor Rooff asked City
Attorney Jim Walsh to find out if his office sent out letters to the residents.
