Moved by Getty, seconded by Krizek that the Agenda, as proposed, be approved. Ayes: Seven.

Voluntary annexation of three parcels of property generally located at North Elk Run Road was
reviewed. On October 6, 1998 the Planning, Programming and Zoning Commission reviewed the
request of city staff to process the petitions of three property owners to voluntarily annex into the
city. Two of the property owners requested annexation in conjunction with Martin Luther King
Jr. Drive project. The remaining parcel is being voluntarily annexed by the owner to avoid
creating an island, as required by State law. To receive funding reimbursement for the project, all
portions need to be inside the city limits. According to the 1997 Code of Iowa, a person or
persons who are owners of land adjoining the city submit a petition for voluntary annexation to
the city council. The city council adopts a resolution annexing the petitioned land and the city
clerk files a copy of the resolution, map and legal description of the territory involved with the
Secretary of State, County Board of Supervisors, each affected utility, the Iowa Department of
Transportation and also records the resolution, map and legal description with the County
Recorder's office. The Planning and Zoning Commission unanimously recommended the
annexation. The parcels do not currently have sanitary sewer, but if development occurs in the
area installation of sanitary sewer could be negotiated. Public safety services would extend to the
annexed property. All Land Use Plans indicate the area is an Industrial zoning, not residential. It
was the consensus of the council to proceed with the voluntary annexation.

meeting be adjourned at 5:58 p.m. Ayes: Seven. Motion carried.
