Mayor John R. Rooff in the Chair. Roll Call: Getty, Murphy, Jordan, Anders, Collier, Krizek. Mayor Rooff asked that everyone observe a moment of silence for Councilperson Frank Mollenhoff who died on Tuesday, July 14, 1998. Mayor Rooff stated that council members will fill the at -large position within the next ten to fourteen days. Mayor Rooff stated that this administration selected the people when they first ran for office, and they would like to do that again and then get a vote of confidence from the people. The Mayor believes Councilperson Mollenhoff would agree with the decision to appoint his replacement. Mayor Rooff stated that they would like to find someone who will fit in with the team. Motion carried. 110713 - Murphy/Jordan that "an Ordinance establishing grades for the F.Y. 1998 Sidewalk Repair Assessment Program - Zone 9, Contract No. 541", be considered and passed for the second and third times and adopted. Ayes: Six. Ordinance adopted and upon approval by Mayor assigned No. 4314. 110714 - Getty/Murphy that "an Ordinance repealing Sections 28-35, Weapons, Explosives, Fireworks, Etc., and 28-51, Hunting and Trapping, of Chapter 28, Parks and Recreation; and enacting in lieu thereof new Sections 28-35, Weapons, Explosives, Fireworks, Etc., and 28-51, Hunting and Trapping, of Chapter 28, Parks and Recreation", be received, placed on file, considered and passed for the first time. Ayes: Five. Nays: Jordan. Motion carried. Prior to a vote on the above motion, the following comments were heard. Councilperson Jordan stated that he has always opposed the ordinance because of safety concerns. Paul Huting, Superintendent of Parks, stated that this ordinance is identical to last years except that council will not have to act on the ordinance each year. The ordinance will allow bow hunting of deer in designated areas of Katoski Greenbelt from the second Monday in October to January 10 of the following year, as allowed by the Iowa Department of Natural Resources under its Special Deer Management Zone procedures. Mayor Rooff stated that this is the third year allowing bow hunting of deer in certain parks in the city limits, and that the council has had to look at the ordinance every year. The council can bring it back for review if they have questions. Councilperson Jordan suggested that the ordinance only be approved for two years. Mr. Huting stated that the Department of Natural Resources will submit their annual reports to the council. Jennifer Lancaster, Department of Natural Resources Officer, stated that no bow may be carried or displayed within 600 feet of any residence without the permission of the owner, of within 75 feet of any bike trail, nature trail, other recreational facility or any area posted as a no hunting area. Ms.Lancaster stated that there have been no safety problems since the ordinance was first approved in 1994. Councilperson Anders asked that since there is no sunset clause, if the DNR or Black Hawk County Conservation Board declares the hunt is no longer needed would the hunt be called off. Ms. Lancaster stated that they will continue to watch the hunt, and if it become no longer necessary, the DNR would not have the bow deer hunt. Ms. Lancaster stated that the DNR will prepare annual reports, and the council will have updates. Councilperson Anders commended the DNR and the Black Hawk County Conservation Board. They have trained and certified the hunters. There have been no incidents that he is aware, and it is a very effective way of controlling the deer. Ms. Lancaster stated that other cities have looked at Waterloo's ordinance, and she believes the success is due to the hunters. Councilperson Jordan asked what parks are included in the ordinances, and if there have been additions. Paul Huting, Superintendent of Parks, stated that the first ordinance was for the Katoski Greenbelt area, and this ordinance regulates bow hunting in the Hartman Nature Center and George Wyth State Park. Jennifer Lancaster, Department of Natural Resources, stated that the parks are either state or county owned but located in the city limits. The same parks were in the ordinances adopted last year by the council, there are no new areas. Councilperson Murphy stated that the ordinance does not allow them to hunt in other areas without coming back to the council. He would like to lease the land from the city to mow the grass and bale it for his horses. Don Temeyer, City Planner, stated that two people are interested in the property. Mr. Hoffman reported that there were two of them last year, but the other party does not want to share the land this year. Tom Hall, P.O. Box 154, reported that a youngster on a bike with no lights ran out in front of his car, and he almost hit him.
