There is no need for a lot of parking. They would like to open the restaurant soon. Mr. Bajramovic reminded the council that it is very important that they have the council's support. It is very important to keep tradition. Bosnian restaurants are just little bits of Bosnian traditions, but very important bits. Bosnian restaurants are very important. Mayor Rooff stated that his administration likes to support culture whenever possible. The council will need to over ride the recommendation of denial of the Planning, Programming and Zoning Commission to approve the rezoning request. Councilperson Anders stated that there that it takes six votes to override Commission's recommendation of denial. fair vote from the whole council. Anders/Murphy is only four council members present and the Planning, Programming and Zoning's Councilperson Anders would like to see a that the rezoning request be tabled until July 6, 1998 when all the council members will be present. Motion carried. 110483 - Councilperson Krizek stated that perhaps the rezoning request should go back to the Planning, Programming Commission to give Bosnian representatives an opportunity to appear before the commission. Mr. Ford stated that because of the petition of opposition, it will be necessary to have approval of six council members regardless of the recommendation of the Planning, Programming and Zoning Commission. Krizek/Murphy that the petition of support of the Colonial Apartment rezoning and oral comments be received and placed on file. Ayes: Four. Absent: Jordan, Collier, Mollenhoff. Lou Cutwright, Building Official, stated that the legal owner of any residential property will not be required to be licensed as a contractor to remodel or repair the owner's own property as long as the building contains four or fewer dwellings, but permits must be obtained. Joel Harris, Service Master, stated that the current code requires that they submit proof of insurance. Mr. Harris feels this ordinance will place undue burden on small contractors. Mr. Harris urged the council to reconsider. This is not a fair burden to put on small contractors and is just another hoop they will have to jump through. They already pay Building Inspection for a permit which protects the homeowners. Mr. Harris feels the fee is just another form of tax, and that it seems they are being feed to death. Building fees have doubled, and that testing is a concern for small contractors. Mayor Rooff stated that if you are an electrician or a plumber you must be tested and licensed. The city is trying to protect citizens. Contractors don't always do an adequate job, and the citizens have no way of checking to see if the contractor is qualified. Mr. Harris stated that Building Inspection is making sure the contractors do their job when they apply for a permit. Mayor Rooff stated that there are a lot of aging citizens in the community who are being abused in the market place. This ordinance came about because of the problem many citizens have with roof repairs. Mr. Harris questioned if the ordinance contains a grandfather clause. Mr. Cutwright responded that there is no grandfather clause. All contractors will be required to take a test. There is a $75 fee for a license and certificate of competency. The contractors license will be required by May 1999. Mr. Harris urged the council to reconsider their vote. Howard Harris asked what will happen if a contractor is unable to pass the test. Mayor Rooff responded that the inspectors will work with everyone to help them pass the test. The Mayor declared that a quorum was not present, but opened the meeting for discussion. The proposed changes to the Housing Code were reviewed. Mayor Rooff reported that the Landlord Association, Councilperson Anders and the Fire Chief have held meetings and have finely tuned the ordinance. Councilperson Anders stated that several meetings have been held with the Landlord Association., and that this is a good document that everyone agrees with. Gary Rankin clarified that the registration fee is $25.00 and a change in ownership will require a new application and payment of the $25.00 fee. The fees have remained the same, the fire exit clause and fire extinguishers have been removed from the ordinance. The registration fee will be used to start the program and keep it going in the future. Mr. Rankin wants enforcement of the ordinance watched closely. Mayor Rooff stated that it is not the intention of the city to hamper good landlords. This ordinance also puts responsibility on the tenant. This is a beginning where we work as a partnership. Fire Chief Magsamen stated that tenants will be responsible for storage and disposal of garbage, and to make sure the smoke detector is working The tenant cannot destroy, deface, damage, impair or remove a part of the building, disturb a neighbor's peace, or allow the occupancy of a building to exceed the number of persons permitted by the ordinance. Tenants will need to be informed that they have responsibility for the premises and that they can be ticketed for any violations. Councilperson Murphy questioned if this ordinance covers non -rental property. Fire Chief Magsamen stated that this ordinance can be used to address problems on non -rental property. The Fire Department will focus on landlord/tenant property and address others on a complaint basis. Mayor Rooff stated that there is a provision in the ordinance for persons who do not have the resources to make the repairs. An application can be made to the Community Development Department for financial assistance. In response to a question, Magsamen stated that an outdoor swimming pool must have a fence or barrier installed, inspected and approved prior to filling with water.
