The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa, at 7:00 p.m., Monday, August 16, 1999. Mayor Pro Tem Harold
Getty in the Chair. Roll Call: Getty, Murphy, Jordan, Krizek, Gronen, Collier.
Absent: Anders.
Invocation by: Rev. Dan Paxton, Heartland Vineyard Christian Fellowship Church.
Pledge of Allegiance: Fire Chief Frank Magsamen.
ORAL PRESENTATIONS
112598 - Jerry Shatzer, 1829 West Seventh Street, stated that he wished to comment on
the council's action to deny the gentleman's request for a variance to the
city ordinance to allow a paintball operation in the city limits. Mr.
Shatzer commented that the city might be missing an opportunity by denying
the request as he feels it is a big business which could draw people to
Waterloo using our hotels, restaurants, etc. Mr. Shatzer stated that when he
was a kid, they used to shoot each other with a BB gun and say a bee stung
them.
Vickie Smith, Principal at Logan Middle School, thanked the council and staff
for their help. City staff cut the grass at Logan and turned up the ground.
Ms. Smith thanked the staff from the Fire Department and Leisure Services.
Leisure Services provided woodchips to the school.
Cheryl Christensen, 1702 Mitchell, stated that she read recently in the paper
about communities holding informational meetings regarding Y2K compliance and
asked if the city was going to work with residents on the Y2K. Ms.
Christensen asked if city departments would hold meetings in the community.
Mayor Pro Tem Getty noted that the city has been working for the past 18
months to become Y2K compliant. Mayor Pro Tem Getty stated that he will pass
along Ms. Christensen's suggestion to Mayor Rooff.

Mayor Pro Tem Getty performed swearing in of Police Officer Darin P.
Rulapaugh.
Mayor ProTemGetty presented a Certificate of Appreciation to Police Officer
Doug Larrabee for 30 years of service to the city.
Fire Chief Frank Magsamen recognized Brett Bredman and Dave Boesen for their
promotion to the position of Fire Lieutenant.
Mayor Pro Tem Getty read a proclamation declaring August 21-28, 1999, as
National Truck Driver Appreciation Week.

that communication from City Clerk transmitting requestofLarry Anfinson,
2205 Katoski Drive, for a variance to the Noise Ordinance from August 23,
1999, through August 23, 2001, from 7:00 a.m. to 11:00 p.m., in conjunction
with live bands practicing at his residence on different dates and at various
times, together with recommendation of approval of the Police Chief, be
received, placed on file and "Resolution approving said request", be adopted.
Prior to a vote on the above motion, the following comments were heard.
Mayor Pro Tem Getty stated that he has a problem with approving the variance
for two years.
Larry Anfinson, 2205 Katoski Drive, stated that although he has requested
from 7:00 a.m. to 11:00 p.m., he doubts that the bands will ever practice
that early. Mr. Anfinson stated that he requested the variance for two years
so that he will not have to come before the council each time a band practice
is scheduled, but he will only have to notify the Police Department. Mr.
Anfinson stated that the bands will play mostly on Friday and Saturday
evenings. Mr. Anfinson noted that there are only two other homes in the
neighborhood; a neighbor across the street from him and one down the road.
Councilperson Jordan stated that he initially had concerns about allowing the
variance, but Police Chief Koehrsen assured him the variance could be revoked
if residents complain about the loud music.
Following discussion a vote was taken on the above motion with the following

The proposed changes to the Zoning Ordinance as it pertains to the construction of decks on the
front face of homes was reviewed. On April 6, 1999 the Planning, Programming and Zoning
Commission reviewed a proposal by staff to add wording to allow the construction of decks to
the front face of homes in Part XXIV 2 -A -48(G) of Zoning Ordinance No. 2479. The council
reviewed the proposed wording and sent it back to staff for additional wording.
The Planning staff has contacted other communities and other departments regarding the
proposed wording. One of the council's concerns was the accumulation of garbage, old furniture,
etc., on the deck additions. Chapter 231, Litter Control, of the Waterloo Code of Ordinances
addresses the accumulation of garbage. Councilmembers also sent staff photographs of some
deck designs they would be in favor of and forwarded them to staff for the revised wording.
The definition of a deck has been added and some of the wording has been changed to reflect the
size of the additions to the home. Previously, it was set at V4 the distance of the front yard
setback and '/a the width of the home. This has been changed to 1/2 the width for the home based
on the photographs received, and wording has been added that the addition could not be enclosed
in the future.
Staff's main concern was ensuring the open space of the front yard and not allowing any
encroachments which could lead to sight distance problems, aesthetic eyesores, etc. Staff believes
this wording will work to bring people back to the front of their homes and neighbor more with
other residents.
Councilperson Murphy noted that he has seen many of the decks in front of homes around town
and asked how they got built.
Don Temeyer, City Planner, stated that residents who tear off old porches are currently allowed
to replace them with decks, and homeowners whose home sit deeper than the general setbacks in
the neighborhood are also allowed to build decks out to the setback line. Mr. Temeyer stated that
the majority of them are probably legal. If the homeowners did not take out a permit to build the
deck in front of the home, they will need to go before the Board of Adjustment.
Councilperson Jordan stated that he supports the proposal to allow decks on the front of homes.
Councilperson Jordan commented that the city will need to set up guidelines for the code
enforcement officers to follow.
Councilperson Krizek noted that the litter control section of the Code of Ordinances addresses
unauthorized accumulation of garbage on property, and the code enforcement officers will be able
to enforce any violations.
Councilperson Murphy stated that he believes that the more residents build front porches, the
more it will deter crime.
Councilperson Getty stated that he supports the proposal to allow decks on the front of homes.
Councilperson Getty suggested that a railing height be placed in the ordinance. Mr. Temeyer
noted that railing height is under the purview of the Building Code.

Programming and Zoning Commission.
