Prior to a vote on the above motion, the following comments were heard. Police Chief Koehrsen stated that he has no objection with the request, and that the Police Department conducts similar activities within a confined, controlled area using appropriate equipment. Chief Koehrsen commented that this is a business and they will be responsible for any liability. Councilperson Jordan stated that he has concerns regarding the kind of clientele and age of the participants. Dennis Halverson, owner of Warrior Paintball, stated that the average age is 20. Mr. Halverson stated that all participants are required to wear protective facial gear and padding, and the paintball gaming system will be located in a secluded area. Participants must be age 12 or over and any participants under 18 years old must have permission of a legal guardian. Councilperson Collier questioned what impact the paint guns will have and if someone could be injured. Mr. Halverson stated that a participant could be injured if not wearing the proper safety equipment. In addition, there is a 20 foot shot rule to reduce the chances of injury from the paint ball guns. Mr. Halverson noted that the paint ball guns are operated by nitrogen and air and not any live ammunition. Mr. Halverson stated that there will always be at least two referees on the field. Councilperson Jordan stated that he is pro business, but he has a problem with the paintball gaming system. Councilperson Jordan stated that we read in the paper about all the school violence, and he feels as a city we need to stop violence and not promote people shooting each other. Councilperson Jordan stated he does not feel the city should promote this type activity. Mr. Halverson stated that paintball in no way promotes violence, but it is a sport. Mayor Pro Tem Getty asked if the council approves the variance, and the paintball gaming system is operating can the council rescind the variance if there are an unusual amount of calls. Assistant City Attorney Sang -Ki Han stated that the Waterloo Code of Ordinance prohibits discharging any leaden or other dangerous missile or substance within the city, and the council has to approve a waiver and can also rescind the waiver. Mr. Han stated that he and city staff met with the applicants, and they will have regulations built into the system and will have to carry proper liability insurance. Mr. Halverson stated that as long as it is will not be safety issues, and that their provide a safe and controlled environmen participants can bring their own equipment, equipment.
