ORAL PRESENTATIONS 111479 - Councilperson Murphy stated in Sunday's Waterloo Courier there was an article which named Councilperson Scott Jordan as the favorite business person and Mayor John Rooff as the best known political person in the Cedar Valley area. Councilperson Murphy stated that he felt it was a great honor for Councilperson Jordan and Mayor Rooff to be recognized by the citizens. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1999-30. 111485 Krizek/Collier that proof of publication of notice of public hearing on the proposed Consolidated Urban Revitalization Area, as published in the Waterloo Courier on January 18, 1999, be received and placed on file. Ayes: Seven. Motion carried. January 25, 1999 HEARINGS CONTINUED Page 2 111486 This being the time and place of public hearing, the Mayor Pro Tem called for written and oral objections. Mayor Pro Tem Anders stated that there are two issues, those who are included in the Consolidated Urban Revitalization Plan (CURA) and those who are not. Don Temeyer, City Planner, stated that last Fall staffbegan working with the City Council and the Planning, Programming and Zoning Commission to determine which areas to designate in the Plan. Everyone who received a notice is included in the Plan. The Consolidated Urban Revitalization Plan allows property owners who significantly improve a parcel of land within the designed Urban Revitalization Area to receive a total or partial property tax exemption on the increased valuation of the property. The homeowner has to file a request for tax exemption with the Assessor requesting the abatement. The increase in the actual value of the structure must be at least 10 percent to benefit from the Plan. Mr. Temeyer reported that all qualified real estate assessed as eligible residential property is eligible to receive a three-year full exemption or a ten year, partial exemption on the actual value added by improvements. The Assessor's office will determine that the actual value of the real estate has increased due to the improvement. Mr. Temeyer stated that the city tried to concentrate on areas that needed improvements. The Planning and Zoning Department mailed out 9,000 notices to property owners in the Plan Area. Todd Eastman stated that he is in the process of purchasing property in the 1400 block of Newell Street. The property falls on the wrong side of the street and is not included in the Plan. Mr. Eastman reported that he is in planning a 600 foot addition and has the contractor's design. Mr. Eastman stated that this is a good program for his property, and that his purchase of the property is contingent on the parcel being included in the Plan. Mr. Temeyer stated that the property is located north of Newell Street. Once the City Council adopts the Plan and decides to add any areas, the amendment will have to be taken to the Planning, Programming and Zoning Commission to be added to the Plan Area. Mayor Pro Tem Anders stated that the property that Mr. Eastman would like included in the CURA Plan does not have any other homes by it, just farm land. Mayor Pro Tem Anders stated that we need to move the boundaries to add this property. Ron Stahl, 147 Hope Avenue and President of Gates Park Neighborhood Association, stated that the northern half of the neighborhood is not included in the Plan and asked why it was not included. Mr. Temeyer stated that when the city established the district, the northern half of the neighborhood did not fall within the income guidelines. When the 2000 census is completed, that area may fall within the guidelines. Anthony Tisdale, 438 Cottage Street, asked if a- property owner makes application through the Assessor's office and if there is a time limit. Mr. Temeyer stated that the city must first approve the improvement and then it is forwarded to the Assessor's office. The city will coordinate the applications with the Assessor's office. Mr. Temeyer stated that the CURA Plan stays in effect until the city council no longer feels it is necessary. All who qualify will continue to receive their abatement through their schedule. Eunice Siedsma, 330 Cutler Street, stated that she has a dilapidated garage that is not connected to the house that she would like to tear down and build a new garage. Ms. Siedsma asked if the garage has to be attached to the house in order to qualify for the tax abatement. Mr. Temeyer stated that to his knowledge the garage does not have to be attached to the home. The criteria is that the improvement has to add taxable value to the current value in order to qualify. Glen Pietan, 412 Cutler Street, stated that ten years ago he put in a car port and had to get an easement. Mr. Pietan would like to add an addition to the back of the house, a 20 x 26 room and a 20 x 26 garage. Mr. Pietan stated that he was informed it would cover too much of his property. Mr. Temeyer stated that if a property owner does not meet the specifications of the ordinances, he can go before the Board of Adjustments to see if they will waive the requirements. January 25, 1999 Page 3 HEARINGS CONTINUED Bob Campbell, 425 Charles Street, asked if the property has to be torn down and reconstructed would he be allowed to do the work himself. Lou Cutwright, Building Official, stated that the ordinances indicates that if you are not the owner of the property, you cannot do the work yourself. If the property has less than four units, the property owner can do the remodeling except for the electrical and plumbing. In order to do electrical and plumbing work, you must be licensed. Mr. Cutwright reported that if the owner does not live in the home, he can do the construction portion of the improvement but would have to make application for a permit on all the items. The owner of property at 118 San Souci stated that he made improvements at another address in the amount of $12,000 last year. He asked if the tax exemption would be retroactive. Mr. Temeyer stated that he would need to verify that with the Assessor's office. If the improvement is not on the tax roll, itmight be eligible. We would need to check to see if the improvement increased the taxable value. If the improvement has already been added to the tax roll, it would not be eligible for the CURA Plan. Father Brunkan, St. Mary's Catholic Church, 2127 East Fourth Street, stated that he hopes the council does everything possible to help the citizens. He stated that there are 32 houses boarded up in his neighborhood. Father Brunkan asked if the city could get the owners to fix up or demolish the dilapidated structures Mr. Temeyer stated that the Urban Area shows 164 dilapidated structures, 516 seriously deteriorated, and 1,500 in need. Mr. Temeyer stated that the council with Community Development has asked the State of Iowa for funding which will go for rehabilitation in targeted areas. Father Brunkan stated that the homeowner has to door, that improvements won't always increase the dilapidated property next door. Mr. Temeyer stated that every bank has a program for these targeted areas. The city's funds are mainly being used in the targetedareasof the We Care Neighborhood and Walnut Neighborhood. Mayor Pro Tem Anders stated that Mayor Rooff has worked very hard to get the banks involved. Joan Marshall, 226 Bates Street, stated that she has a new house from Operation Threshold, but .that there are no street lights or curb and that there is a dilapidated house next door. Ms. Marshall reported that there is an alley in back of her house which is owned by the city but it is full of trees and stumps. Mayor Pro Tem Anders stated that Councilpersons Getty, Gronen and Collier will work with Ms. Marshall. Merlin Biertz, 123 Prospect Circle, stated that there is a lot of property owned by landlords who have done nothing to improve the homes. Mr. Biertz questioned what is the incentive to get the landlords to fix up the homes. There are four or five landlords that won't do anything. Mr. Temeyer stated that CUBA is for rental property. There is a need for rental property because not everyone can own a home. Mr. Temeyer stated that the 1700 block of East 4th Street is in the Gates Park Neighborhood. Mr. Temeyer stated that each neighborhood is doing different things block by block. Mayor Pro Tem Anders stated that the city is working on dilapidated buildings and undesirables every day.
