HomeMy WebLinkAboutAECOM-4/26/2010A=COM AECOM 319 232 6531 tel 501 Sycamore Street 319 232 0271 fax Suite 222 Waterloo, Iowa 50703 www.aecom.com CEDAR VALLEY RIVERFRONT RENAISSANCE WATERLOO VISION IOWA PROJECTS CONSTRUCTION REVIEW SERVICES FOR THE LOWER PLAZA, ADDITIONAL CONSTRUCTION REVIEW SERVICES FOR THE WATERLOO DAM REHABILITATION AND RIVER WALL CONSTRUCTION AND ADDITIONAL DESIGN SERVICES SUPPLEMENTAL AGREEMENT NO. 10 WHEREAS, a Professional Services Agreement was entered into between the City of Waterloo, Iowa (Client), and AECOM Technical Services, Inc., formerly Earth Tech, Inc. (Consultant), of Waterloo, Iowa, dated September 22, 2003, for the preliminary design, final design and construction -related services for the Cedar Valley Riverfront Renaissance, Waterloo Vision Iowa Projects, including the three major projects known as the Riverwalk Loop, Cedar River Dam Improvements and the Cedar River Plaza and Amphitheatre in Waterloo, Iowa; and WHEREAS, Supplemental Agreement No. 1 was entered into between the Client and the Consultant dated January 24, 2005, for Phase II - Final Design Services of selected alternatives; and WHEREAS, Supplemental Agreement No. 2 was entered into between the Client and the Consultant dated October 10, 2005, for Phase III - Construction -Review Services for that portion of the project including floodwall modifications at the Lower Plaza and Waterloo Center for the Arts Youth Pavilion; and WHEREAS, Supplemental Agreement No. 3 was entered into between the Client and the Consultant dated September 18, 2006, for Phase III — Construction -Review Services for that portion of the project including the Riverwalk Loop Trail from East 6th Street to 18th Street; and WHEREAS, Supplemental Agreement No. 4 was entered into between the Client and the Consultant dated May 21, 2007, for Phase III — Construction Review Services for that portion of the project including the Waterloo Dam Rehabilitation and River Wall Reconstruction; and WHEREAS, Supplemental Agreement No. 5 was entered into between the Client and Consultant dated June 15, 2007, for Phase III - Construction Review Services for that portion of the project including the Riverwalk Loop Trail from Cedar Bend Park to Mullan Avenue; and WHEREAS, Supplemental Agreement No. 6 was entered into between the Client and the Consultant dated September 2, 2008, for Phase III - Construction Review Services for that portion of the project including the Riverwalk Loop Trail Enhancements (Overlooks) along the north side of the Cedar River, from 6th Street to the Cedar River Dam; and WHEREAS, Supplemental Agreement No. 7 was entered into between the Client and the Consultant dated October 20, 2008, for Phase III - Construction Review Services for repairs of damage to portions of the project along the Cedar River caused by the flood of 2008; and WHEREAS, Supplemental Agreement No. 8 was entered into between the Client and the Consultant, dated August 17, 2009, for final design services for Mark's Park and additional design services for a Performance Structure for the amphitheatre area of the lower plaza; and ALTOM Page 2 WHEREAS, Supplemental Agreement No. 9 was entered into between the Client and the Consultant, dated March 26, 2010, for Phase III - Construction Review Services for that portion of the project including the Riverwalk Loop Trail from West 6th Street to 18th Street on the south side of the Cedar River; and WHEREAS, the Client and the Consultant now desire to enter into Supplemental Agreement No. 10 for Phase III - Constructed Review Services for that portion of the project including the Lower Plaza, additional construction review services for the Waterloo Dam Rehabilitation and River Wall Construction, and for additional design services for the Cedar Valley Riverfront Renaissance Waterloo Vision lowa Projects. NOW THEREFORE, it is mutually agreed to amend the original Professional Services Agreement as follows: Project Description The project consists of the following three elements: 1. Construction review services for the construction of the FY 2010 Lower Plaza, extending from near the Waterloo Center for the Arts to Park Avenue. The Lower Plaza project consists of enhanced pavement for the plaza and performance areas, earthen levee relocation and retaining wall construction, amphitheatre and associated limestone seating, infrastructure for Mark's Park, control buildings and electrical service for the performance area, irrigation, landscaping and amenities for the plaza, including lighting, benches and planters. 2. Additional construction review services for the Waterloo Dam and River Wall Construction including work associated with the revised rock anchor system and additional work elements associated with the 2007 and 2008 flood events. 3. Additional design elements for the Cedar Valley Riverfront Renaissance Waterloo Vision Iowa Projects that have been completed since the final design scope was written in January of 2005. The following items were completed as part of the overall design for the project and were not anticipated at the time of the original project development. • Environmental Documentation. Documentation required for HUD Section 108 funding, including an Intensive Level Historic Survey and an Archaeological Phase I Investigation. • Federal and State Funding. Design and coordination efforts required for four (4) of the Riverwalk Loop Projects upon receiving federal and state funding. Iowa Department of Transportation requirements for design and specifications were used on these projects, including appropriate submittals and coordination with the funding agencies. The projects were required to follow the standard federal and state aid process. • Downtown Signage Review. Review conducted in conjunction with the Iowa Department of Transportation completing new signage for the Highway 218 and 63 corridors. AECOM worked with City staff, design team members and the Iowa DOT to determine location for signage, in addition to language for the downtown destination signage. AZCOM • Upper Plaza Alternatives. Additional alternatives were reviewed for the orientation of the Upper Plaza due to the pending adjacent private development. Several alternatives were reviewed before arriving at the final orientation. • Right -of -Way Requirements. Due to the complexity of the R -O -W agreement with US Bank, several additional design drawings were required during the negotiation process, in addition to coordination and meeting time. • Assistance with Drawings for Grant Applications. Additional drawings were created during the project to assist in funding applications. • Dam Re -Design. Due to the Karstic rock condition below the existing dam, the rock anchors needed to be re -designed during construction. • Additional River Wall Design. During final design of the projects, it was determined rehabilitation of the existing north river wall downstream of the dam was required. The design for this reconstruction was included in the river wall construction project. • Additional Enhancement Opportunities. Several additional enhancements were included in the projects not known during the original scope of the project. These included additional retaining walls that were required for several of the projects, Rath letters to be incorporated in the trail system and Prairie Pathways signage. In addition, overlooks in Paramount Park and 6th Street were significantly expanded upon receiving additional funding for these projects. • Parking Configurations. Several parking configurations were reviewed in the area of the Upper Plaza for City staff and design team reviews. These included additional parking ramps, if needed, for the area in the future in addition to potential parking arrangements with and without the future private development. • Additional Riverwalk Loop Design on 6`h Street from Washington Street to the Levee. During the course of the final design for the project and the associated economic stimulus funding received, the original project limits expanded to include adding this section of recreational trail to the riverwalk loop to tie into the US 218 trail system. • Agency Coordination. Due to the sensitivity of the projects within the US Army Corps of Engineers Local Flood Protection System and the flooding events in recent years, additional scrutiny was placed on permitting for the projects. Additional time was required for obtaining required permits. • Additional Project Administration. Due to the required staging of the project, delays caused by flooding, additional funding source requirements and inclusion of the two related projects, the Cedar River Portages and Mark's Park, the project has extended further than anticipated. Additional design team and City staff meetings have been required. The original Vision Iowa Grant has been extended two years to completion in 2011. Page 3 COM The above items summarize the major items not included in the original design scope. As the project is an hourly not to exceed project, it was decided to see if the additional work could be completed within the original contract budget. Based on the current project standing, it is clear the additional work will not fit within the original budget. An analysis was completed on the three projects for which design remains to allow letting for construction bids — Riverwalk Loop from Mullan Avenue to Park, the Cattle Congress Pump Station and the Upper Plaza. These three projects are currently in the design process but require additional work for final construction document preparation. In addition to these three projects, tasks have been included to update the web site with current photos, project administration for project completion, and a task to complete design elements required for the additional design elements in Mark's Park and the Performance Structure as a part of the recent RECAT Grant. The elements of Item 3 represent additional final design needs since the original authorization on January 24, 2005. Review of the overall project budget for design and construction -phase services supports that the additional design can be funded by a reduction in the estimated construction -phase service fees so that the budget in total remains as originally estimated. The Scope of Services for these three project elements are further defined as follows: II. Scope of Services FY 2010 Lower Plaza Construction Review Services (Tasks 1-15) The Scope of Services will encompass and include services, materials, equipment, personnel and supplies necessary to provide construction staking, field review, materials testing and contract administration during the construction phase for the FY 2010 Lower Plaza. Services from InVision Architecture and Craig Ritland Landscape Architects (CRLA) are included and will be used to assist in Tasks 1, 3, 4, 6, 11 and 12. Task 1. Conduct a preconstruction conference attended by representatives of the Contractor, Client, Consultant and affected utilities. Task 2. Provide construction -staking for horizontal and vertical controls for the project as follows: a. Project Control b. Set Stakes for Easement Limits c. Marking Removal Limits d. Set Stakes for Location of Silt Fence e. Set Rough Grading Stakes f. Set Stakes for Sanitary Sewer g. Set Stakes for Water Mains, Hydrants and Valves h. Set Stakes for Storm Sewer Pipe and Subdrain Pipe Set Grade for Adjustment of Fixtures j. Set Stakes for Sidewalks k. Set Stakes for Walls Set Stakes for Steps and Stairs m. Set Stakes for PCC Pavements n. Set Stakes for Curb and Gutter o. Set Stakes for Location of Fountain Page 4 AZCOM p. Set Stakes for Locations of Drinking Fountains O. Set Stakes for Locations of Bollards r. Set Stakes for Location of In -Pavement Lights and Area Light Fixtures and Poles s. Set Stakes for Locations of Planters t. Set Stakes for Locations of Mechanical and Electrical Building u. Stake Locations of Handrails v. Stake Location of Irrigation System w. Office Work Task 3. Review shop drawings and other submittals as required of the Contractor by the contract documents for conformance with the design concept of the project and compliance with the information given in the contract documents. Task 4. Answer design interpretation questions from the Client, Contractor, review staff and appropriate agencies. Task 5. Prepare bi-monthly applications for payment based on information provided by field review staff and Contractor and forward to the Client for execution with recommendation for approval and payment. Task 6. Perform construction site visits by design personnel at appropriate stages of construction to review the quality of the work and to determine whether the work conforms to the contract documents. Task 7. Prepare and assist the Client and Contractor in processing contract change orders. Task 8. Provide periodic field observation during construction to review the work of the Contractor to determine if the work is proceeding in general accordance with the contract documents and that completed work appears to conform to the contract documents. Staffing requirements may be adjusted during the project in relation to the level of construction activity. Task 9. Report to the Client any work believed to be unsatisfactory, faulty or defective or does not conform to the contract documents, and advise the Client of any work that should be corrected or rejected. Task 10. Consider and evaluate Contractor's suggestions for modifications and report them with recommendations to the Client. Task 11. Participate in a review of the project with the Client and review staff near project completion and prepare a list of items to be completed or corrected. Task 12. Participate in a field observation of the completed project with the Client and review staff before a final application for payment is processed for the Contractor. Task 13. Maintain files for correspondence, reports of the job conferences, shop drawings and sample submissions, reproductions of original contract documents including addenda, change orders, field modifications, and additional drawings issued subsequent to the execution of the contract, Engineer clarifications and interpretations of the contract documents, progress reports and other project -related documents. Page 5 AZCOM Task 14. Provide the Client with a copy of revised drawings of the construction plans (record drawings) for the project based on the construction observation records of the field review staff and the Contractor showing those changes made during construction considered significant. Task 15. Prepare and assist the Client with the final close-out documentation received from the Contractor. Additional Construction Review Services for the Waterloo Dam and River Wall Construction (Tasks 16-17) These tasks include additional work required as part of the rock anchor installation for the dam. During construction, it was observed the existing bedrock below the dam was more weathered than borings had shown. The anchor system was redesigned to account for the Karstic Limestone and additional time was required due to the revised installation recommendations. In addition to the rock anchor installation, additional field inspection time was required during and after the 2007 and 2008 flood events for closure of the flood protection levee openings and reconstruction of causeways after the flood events. Task 16. Additional Field Observation. This task includes the additional field observation during construction to review the work of the contractor to determine if the work was proceeding in general conformance with the revised construction documents. The task includes additional field observation time required for repairs and causeway reconstruction after the flood events. Task 17. Additional Construction Administration. This task includes the additional construction engineering time required for oversight of the project revisions due to the rock anchor revisions and the reviews after the flood events. Additional Design Services (Tasks 18-23) These tasks include design work required to complete the remaining design components of the Riverfront Renaissance projects. The three projects remaining include the Riverwalk Loop from Mullan Avenue to Park Avenue, the Cattle Congress Pump Station and the Upper Plaza. The tasks also include updating the website, project administration and design required for the additional elements of Mark's Park and the Performance Structure included in the recent RECAT Grant award. Task 18. Completion of final design for the Riverwalk Loop from MuIlan Avenue to Park Avenue. This task includes final construction document preparation for the portion of the Riverwalk Loop from Mullan Avenue to Park Avenue to be let for construction bids in 2010. Task 19. Completion of final design for Cattle Congress Pump Station. This task includes final construction document preparation for the Cattle Congress Pump Station to be let for construction bids in 2010. Task 20. Completion of final design for Upper Plaza This task includes final construction document preparation for the Upper Plaza project to be let for construction bids in 2011. Services from InVision Architecture and CRLA are included in this task. Task 21. Update Web Site. This task includes updating the river renaissance website with current project photographs and information. Page 6 Task 22. Project Administration. This task includes project administration and coordination for the remaining projects including project meetings with the design team. It is anticipated three (3) additional design team meetings will be held for the project. Task 23. Additional Design Elements. This task includes those elements identified in Item 3 of the project description that require funding beyond the replacement of the services for the three project elements to be completed in Tasks 18, 19 and 20. Task 24. Additional Mark's Park and Performance Structure Design RECAT Grant. This task includes design of the additional enhancements to Mark's Park and the Performance Structure as shown in the recent RECAT Grant award. Components include additional play equipment for Mark's Park and enhancements to the Performance Structure. InVision Architecture will be completing this task. III. Compensation Compensation for the above services will be on any hourly basis in accordance with Part III of the original agreement. Fee for the services is estimated for the individual projects as follows, and shall not be exceeded without authorization of the Client. A. B. C. D.
