Mayor Rooff in the Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, and Lichty. Absent: Roehr, and Wilharm. Invocation by Councilman Geiger. 69354 - Moved by Getty, seconded by Bowers that the Agenda, as amended, for the Regular Session of January 19, 1976 at 7:00 P.M., be accepted and approved. Motion carried. 69355 - Moved by Geiger, seconded by Dowie that the Minutes of the Regular Session held January 12, 1976 at 7:00 P.M. and Special Session held January 15, 1976 at 4:00 P.M., be approved. Motion carried. 69356 - Moved by Dowie, seconded by Bowers that proof of publication of Notice of Public Hearing on proposal to sellDisposal Parcels No. J-26 and No. J-37, Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, 138 Harrison Street and 163 Harrison Street, published in the Waterloo Daily Courier on December 18, 1975, to Jerry E. Shaw, be received and placed on file. Motion carried. 69357 - The Mayor announced the time had arrived to hear objections, and called for oral and written objections. No objections were made or filed. Moved by Bowers, seconded by Dowie that "Resolution approving the sale of Disposal Parcel No. J-26 and Disposal Parcel No. J-37 in the West- field -Virden Urban Renewal Area, Project Iowa R-7, and authorizing the execution of the necessary contract for sale of land for private re- development and deed", be adopted. Ayes: Five. Absent: Roehr and Wilharm. Resolution adopted and upon approval by Mayor, assigned No. 24416 in official resolution book. 69358 - Councilman Getty introduced Tom Pulchinski, General Manager of Waterloo Baseball, Inc., and reported several benefits have been scheduled to raise money for Waterloo Baseball, Inc., one of which was a basketball game between the KWWL Super Shooters and City Officials. Mr. Pulchinski briefly outlined the coverage being given by the news media for the game to be held at West High School on Sunday, January 25, 1976 at 2:00 P.M. and locations where tickets could be bought. 69359 - Moved by Getty, seconded by Lichty that the communication from Gene Yagla, Atty. in behalf of Waterloo Yellow Cab Company requesting an increase in the rates for taxicabs, be received, placed on file, approv- ed and the City Attorney instructed to draw and submit an Ordinance amending Section 36-58 (a) (1), (a) (2) and (a) (5) of Chapter 36. Motion carried. 69360 - Moved by Dowie, seconded by Bowers that the request from Wendell Lockard Construction, Inc. for permission to construct one 26' drive entrance at 751 Ansborough Avenue, as shown on the attached plat, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 69361 - Moved by Geiger, seconded by Dowie that communication from Sign and Traffic Maintenance Department reporting a request from residents on East Ridgeway Avenue from Hammond Avenue to LaPorte Road for reduction of speed limit from 35 M.P.H. to 25 M.P.H., and recommending reduction from 35 M.P.H. to 25 M.P.H. on East Ridgeway Avenue from Haunuond Avenue to San Marnan Drive, be received, placed on file, recommendations approv- ed and the City Attorney instructed to submit an amendment to the Traffic Ordinance accordingly. Motion carried. 69362 - Moved by Bowers, seconded by Dowie that the minutes of the Comummity Development Board for their regular meeting held December 9, 1975, be received, placed on file and approved. Motion carried. 69363 - Moved by Dowie, seconded by Getty that the Data Processing Agreement dated 1/12/76 between the City of Waterloo, Iowa and Black Hawk County, be received, placed on file and action deferred until January 26, 1976. Motion carried. - 2 - 69364 - Moved by Getty, seconded by Lichty that Construction Permit No.76-253-S for sanitary sewer extension to commercial properties in Section 2-88-13 from the Iowa Department of Environmental Quality, subject to certain conditions and requirements, be received and placed on file. Motion carried. 69365 - Moved by Getty, seconded by Lichty that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 84 to Section 2A-5, re- zoning certain property", be considered and passed for the second time (the first having passed under C.R. #69313 of 1/12/76). Ayes: Five. Absent: Roehr and Wilharm. Motion carried. 69366 - Mayor Rooff reported the federal people wanted the language corrected in prior resolution abolishing the Low Rent Housing Commission and the pro- posed resolution would wipe out the old,and establish the City of Water- loo would exercise the low rent housing project powers. Moved by Bowers, seconded by Dowie that "Resolution terminating the Department of Housing and Rehabilitation and providing for the exercise of Low Rent Housing powers under Chapter 403A of the Code of Iowa by the City of Waterloo, Iowa", be adopted. Ayes: Five. Absent: Roehr and Wilharm. Resolution adopted and upon approval by Mayor, assigned No. 24417 in official resolution book. 69367 - :Moved by Lichty, seconded by Bowers that "Resolution accepting certain deeds for public street purposes", be adopted. Ayes: Five. Absent: Roehr, and Wilharm. Resolution adopted and upon approval by Mayor, assigned No. 24418 in official resolution book. 69368 - Moved by Bowers, seconded by Dowie that communication from City Engineer, submitting recommendations for the 1976 (FY 1977) Paving Program, be received and placed on file. Motion carried. 69369 - Moved by Getty, seconded by Lichty that the following requests for permission to attend functions, with expenses allowed not to exceed amount shown, be received, placed on file and approved: City Engineer with three, Engineering Personnel to 12th Annual Concrete Paving Work- shop, Des Moines, Iowa, February 10, 11, 12, 1976, $400 plus use of City car; Community Development Administrator to 1976 Annual Meeting of Water Resources Congress, St. Louis, Missouri, February 21 thru 24, 1976, $345.00. Ayes: Five. Absent: Roehr, and Wilharm. Motion car- ried. 69370 - Moved by Dowie, seconded by Bowers that the communication from the Asst. City Attorney requesting a date of hearing be set on a proposal to con- vey to the State of Iowa two parcels of land in Sections 11-88-13 and 2-88-13 for the purpose of correcting erroneous legal descriptions on deeds to the City of Waterloo, be received, placed on file and "Resolu- tion fixing the time and place of hearing on a proposal to convey two parcels of land in Sections 11-88-13 and 2-88-13 in the City of Water- loo, Iowa to the State of Iowa", adopted, same being February 2, 1976 at 7:00 P.M. in the Council Chambers in the City Hall and the Clerk instructed to publish the notice of hearing. Ayes: Five. Absent: Roehr, and Wilharm. Resolution adopted and upon approval by Mayor, assigned No. 24419 in official resolution book. 69371 - Moved by Geiger, seconded by Getty that the Taxicab Driver permit Applications and fees of Carol Anne Grovo, 1336 Black Hawk Road, Christine Held, 1662 Golden Valley Drive, and David John Goldsmith, 1828 Mitchell Avenue, be received, placed on file and approved. Motion carried. 69372 - Councilman Dowie asked if the Council controlled the licenses after issuance and was informed it could revoke a license for certain specific things. Motion carried. 69374 - Moved by Geiger, seconded by Getty that the report of City Attorney and list of bonds filed with Clerk through 1/19/76, be received, placed on file and approved.
