On Roll call, Present: Bowers, Dowie, Geiger, Getty, Wilhatw. Absent: Lichty. Invocation by Councilman Geiger. 69287 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for the Regular Session of January 5, 1976, at 7:00 P.M., be accepted and approved. Motion carried. 69288 - Moved by Wilharm, seconded by Roehr that the Minutes of the Special Session held on January 2, 1976 at 11:45 A.M. and of the Organization Meeting held on January 2, 1976 at 11:50 A.M., be accepted. Motion carried. January 5, 1976 in Council Rooff in the Roehr and 69289 - Moved by Roehr, seconded by Wilharm that the proof of publication of Notice of Assessment for oiling certain streets, avenues, drives, boulevards and alleys under Oiling Project for the Year 1975, be re- ceived and placed on file. Motion carried. 69290 - The Mayor announced the time had arrived to hear objections, and called for oral and written objections. The Clerk reported written objections had been filed by: 1. D. E. Stoner, 714 Hanna Blvd., et al, to Bismark Street; 2. Marion E. and Sally A. Hutchinson, 1241 Ackermant Street; 3. Mr. and Mrs. H. Roy Watts, 1277 Ackermant Street; Oral objections were made by: Mrs. Roy Watts to the poor job done in the 1200 block of AckeLmant Street. Moved by Getty, seconded by Dowie that the above objections to assess- ments made under the Oiling Program for Year 1975, be received and placed on file. Motion carried. 69291 - City Engineer Radue reported Bismark Avenue was only 17° wide instead of 24', and the schedule and notices had been corrected accordingly. In the discussion on the 1200 block of Ackermant Street, it was point- ed out the assessments for the entire block were $654.10, Mayor Rooff supported sustaining the objections. Curt Parsons, 207 Miriam Drive, Complimeted the Street Department on the very fine exceptional job done on his street. Moved by Getty, seconded by Wilhatm that "Resolution sustaining the objections to the assessments for the 1200 block of Ackermant Street made under the Oiling Program for the Year 1975", be adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24397 in official resolution book. 69292 - Moved by Wilhai_ui, seconded by Dowie "Resolution approving the levying assessments for the cost and expenses of improving certain streets, avenues, drives, boulevards and alleys in the City of Waterloo, Iowa, by oiling the same, being the Oiling Program for Year 1975", be adopted. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24398 in official resolution book. 69293 - Moved by Roehr, seconded by Wilharm that proof of publication of Notice of Proposal to Dispose of Real Estate known as 1039 and 1041 Gilbert Street, SZ lot 23 and N 2 lot 23, Behm Addition, as published in the Waterloo Daily Courier on December 18, 1975, to the highest bidder plus costs, be received and placed on file. Motion carried. 69294 - The Mayor announced the time had arrived to hear objections and called for oral and written objections. There were no objections made or filed. Munson and Lillie K, Munson of Waterloo, Iowa in the total amount of $100.00, approving and authorizing the sale and con- veyance of 1039 and 1041 Gilbert Street, SZ Lot 23 and NZ Lot 23, Behm Addition, as published in Notice of Proposal to Dispose of Real Estate in Waterloo Daily Courier on December 18, 1975, and directing and'authorizing the Mayor and City Clerk to execute and deliver a deed for said property", adopted. Ayes: Six. Absent: Lichty. Motion carried. 69298 - Moved by Wilharm, seconded by Roehr that request of Gjellefald Con- structors, Inc., Forest City, Iowa, for a time extension on the Orange Township Sanitary Sewer Outfall, Contract No. 177, and City Engineer's recommendation that completion date be revised from Decem- ber 19, 1975 to February 20, 1976, be received, placed on file, recom- mendations approved and said completion date set as February 20,1976. Motion carried. 69299 - Mbved by Wilharm, seconded by Dowie that Change Order No. 1 for Down- town Fourth Street Improvements, Contract No. 152, for work performed by Cedar Falls Construction Co., Inc. at a decrease in costs of $13,232.95, and City Engineer's recommendation for approval, be re- ceived, placed on file, approved and Mayor and City Clerk authorized to execute same. Ayes: Six. Absent: Lichty. Motion carried. 69300 - Councilman Getty favored that paragraphs (1) and (2) under Subsection (h) should be deleted from the ordinance. A discussion followed on dancers or entertainers not touching each other while performing, or coming into contact with the customers or patrons while doing their act. January 5, 1976 - 3 69300 - (Continued) Moved by Roehr, seconded by Bowers that "An Ordinance to amend the Code of Ordinances of the City of Waterloo, Iowa, adopted by Ordinance No. 2584, Section 19, passed December 27, 1971, and as amended by Ordinance No. 2699, Subsection 2-4, passed September 3, 1974, by re- pealing Section 4-29 as amended, entitled "Prohibiting Sales and Acts", of Chapter 4, Article II, entitled "Sale and Consumption of Beer and Liquor", as amended, and enacting in lieu thereof, an ordinance re- lating to the regulation- of beer and liquor", be considered and passed for the second time (the first having passed under C.R. #69259 of 12/22/75). Ayes: Bowers; Dowie, Roehr, and Wilharm. Nays: Geiger and Getty. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24400 in official resolution book. 69302 - Moved by Wilhalw, seconded by Bowers that communication foam McElroy Auditorium Manager reporting retirement of Ted Hoeper as of 1/1/76 and entitlement to 124 hours sick leave and two weeks vacation pay, be received, placed on file and "Resolution approving payment of $607.92 accummulated sick leave and vacation pay to Ted Hoeper, retiree of McElroy Auditorium', adopted. Ayes: Six. Absent: Licnty. Resolution adopted and upon approval by Mayor, assigned No. 24401 in official resolution book. 69303 - Moved by Dowie, seconded by Wilharm that the Delinquent Weed Certifi- cation List, together with cost for the destruction of weeds, vines, bushes, etc., be received, placed on file and "Resolution fixing time and place for hearing on proposed assessments for cutting and destruction of weeds for the calendar year 1975", adopted, with date of hearing set as February 2, 1976. Ayes: Six. Absent: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24402 in official resolution book. 69304 - Moved by Getty, seconded by Bowers that the following requests for permission to attend functions,with expenses allowed not to exceed amounts shown, be received, placed on file and approved: Superinten- dent of Conway Civic Center to study operating percedures of conven- tion Centers and attend Managers Meeting, January 12 thru 16, 1976, inclusive,.
