The Council of City of Waterloo, Iowa, met in Regular Session in Council
Chambers in City Hall at 7:00 P.M. on February 16, 1976. Mayor Rooff in the
Chair. On roll call; Present: Bowers, Dowie, Geiger, Getty, Roehr and Wil -
harm. Absent: Lichty. Invocation by Councilman Wilharm.
69483 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for
the Regular Session of February 16, 1976 at 7:00 P.M., be accepted
and approved. Motion carried.
69484 - Moved by Wilharm, seconded by Bowers that the Minutes of the Regular
Session held February 9, 1976 at 7:00 P.M., be approved. Motion
carried.
69485 - Moved by Roehr, seconded by Bowers that proof of publication of
notice of public hearing on rezoning, upon the request from Cedar
Hills, Inc., upon recommendation of City Zoning Commission and Coun-
cil's own motion, to rezone from "A-1" Agricultural District to
"R-4, R -P" Planned Residence District, a part of S 2 of Section
18-88-12 located on North side of East Orange Road and West of U.S.
Highway No. 218, as published in the Waterloo Daily Courier on Janu-
ary 29, 1976, be received and placed on file. Motion carried.
69486 - The Mayor announced the time had arrived to hear objections, and
called for oral and written objections. No objections were made or
filed.
Moved by Getty, seconded by Bowers that "An Ordinance amending Ordinance
No. 2479, as amended, by adding Sub -Section No. 85 to Section 2A-5, re-
zoning certain property', be considered and passed for the first time.
Ayes: Six. Absent: Lichty. Motion carried.
69487 - Councilman Getty raised the question of why the speed limit on the
two mile stretch of West Donald Street between Highways #63 and #20
should not be changed from 25 mph to 35 mph, in view of the fact that
the dike was completed in this area.
Further, Councilman Getty asked if it was too late to name the road
known as River Road to Trueman Miller River Road. Mayor Rooff said
he would check into these items.
69488 - Moved by Wilharm, seconded by Bowers that the two communications from
Black Hawk County Auditor advising offers have been made on 2/9/76
and 1/12/76 for the following properties in amounts shown on which
Black Hawk County holds title and requesting Council approval to ac-
cept these offers subject to City of Waterloo waiving all special
assessments and the City to receive the proceeds from the sale of
these properties, be received, placed on file, sale of said proper-
ties approved subject to the above provisions:

Civil Service Commission, certifying the following officers of the
Waterloo Police Department as qualified and eligible for promotions

ment for Federal -Aid Projects dated 2/16/76 from the Highway Division,
of IowaDepartment of Transportation, and City Engineer's recommenda-
tion for approval, be received, placed on file, approved and Mayor
authorized to sign said Statement. Motion carried.
69492 - Moved by Wilharm, seconded by Roehr that request from Neil J. Miller
with construction plans for sanitary sewer extension to serve part of
Tract 21, Auditor's Whitney Road Plat of Section 16 and 21-89-13 and
Treatment Agreement Form C 9/75 for the Department of Environmental
Quality, and City Engineer's recommendation for approval at no cost
to the City with final acceptance of attached plans subject to review
and acceptance by said Department, be received, placed on file, recom-
mendation approved and Mayor and Clerk authorized to execute said
Form. Motion carried.

No. 2644 known as the Traffic Ordinance of the City of Waterloo, Iowa,
by repealing Subsections (83) and (84) of Section 541 "Increasing
speed limits in certain areas", and by enacting in lieu thereof new
Subsections (83) and (84) of Section 541 "Increasing speed limits in
certain areas", be considered and the rules requiring ordinances to
be considered and voted on at two prior meetings, suspended, said
Ordinance recorded as having been considered and passed for the first,
second and third times, and now placed on its final adoption. Ayes:

Ordinance No. 2644 known as the Traffic Ordinance of the City of
Waterloo, Iowa, by repealing Subsections (83) and (84) of Section 541
"Increasing Speed Limits in Certain Areas,." and by enacting in lieu
thereof new Subsections (83) and (84) of Section 541 "Increasing Speed
Limits in Certain Areas", be adopted. Ayes: Six. Absent: Lichty.

ance No. 2644, known as the Traffic Ordinance by adding Subsection
2392 to Section 551, entitled "Parking Prohibited at All Times on
Certain Streets", be considered and the rules requiring ordinances to
be considered and voted on at two prior meetings, suspended, said
Ordinance recorded as having been considered and passed for the first,
second and third times, and now placed on its final adoption. Ayes:

Asst. City Attorney, transmitting two ordinances amending Ordinances

69498 - Moved by Bowers, seconded by Roehr that "An Ordinance amending Ordin-
ance No. 2588, Subsection 1, (Also known as Chapter 16, Subsection 5,
of the Code of Ordinances, City of Waterloo), and Subsection 2, (Also
known as Chapter 16, Subsection 41, of the Code of Ordinances, City
of Waterloo), by repealing Subsection 1, and by repealing Subsection
2 and enacting in lieu thereof a new Subsection 2", be considered and
passed for the first time. Ayes: Six. Absent: Lichty. Motion

ance No. 1461, Subsection 4, (Also known as Chapter 34, Subsection

section 78(d) of Chapter 34", be considered and passed for the first

69501 - Moved by Getty, seconded by Geiger that "An Ordinance amending Ordin-
ance No. 2761, Food and Food Handlers, by repealing Section 1, Defini-
tions, and enacting in lieu thereof new Section 1, Definitions", be
considered and passed for the first time. Ayes: Six. Absent:
Lichty. Motion carried.

City Attorney, transmitting an ordinance amending Ordinance No. 2446,
be received and placed on file. Motion carried.
69503 - Moved by Roehr, seconded by Bowers that "An Ordinance amending Ordin-
ance No. 2446, known as the Milk Ordinance by repealing Item 10p,
Sanitary Piping, and Item 18p, Bottling and Packaging, of Section 7,
Standards for Milk and Milk Products, and enacting in lieu thereof new
Item 10p, Sanitary Piping, and new Item 18p, Bottling and Packaging,
of Section 7, Standards for Milk and Milk Products, and by adding new
Subsections 0-1, Cottage Cheese; 0-2, Creamed Cottage Cheese; and 0-3,
Lowfat Cottage Cheese; to Section 1, Definitions," be considered and
passed for the first time. Ayes: Six. Absent: Lichty. Motion
carried.
69504 - Moved by Getty, seconded by Dowie that communication from Community
Development Administrator, transmitting a proposed resolution authori-
zing said Board to award contracts for demolition of dangerous build-
ings as part of Block Grant Program, and recommending approval, be
received, placed on file and "A resolution authorizing the Community
Development Board to advertise for bids, accept and open bids and
award contracts for the demolition of dangerous buildings under the
City of Waterloo Community Development Block Grant Program", adopted.
Ayes: Six. Absent: Lichty. Resolution adopted and upon approval
by Mayor, assigned No. 24453 in official resolution book.
69505 - Mayor Rooff stated the resolution would cover all the various studies
to be funded by Community Development Block Grant Program, and Dry
Run Creek ponding and garbage truck routing by computor were the ones
presently needed.

Moved by Roehr, seconded by Dowie that communication from Community
Development Administrator, transmitting a proposed resolution authori-
zing said Board to enter into various study contracts, and recommend-
ing approval, be received, placed on file and "A resolution autho-
rizing the Community Development Board to enter into contracts for
studies of various kinds as needed as part of the Community Development
Block Grant Program", adopted. Ayes: Six. Absent: Lichty. Reso-
lution adopted and upon approval by Mayor, assigned No. 24454 in
official resolution book.
69506 Moved by Roehr, seconded by Geiger that communication from Mayor Rooff,
submitting for Council approval the appointment of Carl A. Eicher to
the Board of Adjustment to fill unexpired term of John D. Swinehart,
who has resigned, to expire on December 8, 1977, be received, placed
on file and said appointment approved. Motion carried.
69507 Moved by Roehr, seconded by Bowers that communication from Fire Chief
requesting Council approval of appointment of Steven G. Jordan to the
Waterloo Fire Department, effective February 23, 1976, be received,
placed on file and approved. Motion carried.
69508 Moved by Wilharm, seconded by Bowers that the following request for
permission to attend function, with expenses allowed not to exceed
amount shown, be received, placed on file and approved: Milk Sani-
tarian and Assistant, to attend Annual Spring Meeting of Iowa Associa-
tion of Milk, Food & Environmental Sanitarians and Dairy Industry
short course, Ames, Iowa, March 22 and 23, 1976, $50.00 plus use of
City car. Ayes: Six. Absent: Lichty. Motion carried.
