The Council of City of Waterloo, Iowa, met in Regular Session in Council
Chambers in City Hall at 7:00 P.M. on February 9, 1976. Mayor Rooff in the
Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty and
Wilharm. Absent: Roehr. Invocation by Councilman Geiger.
69433 - Mayor Rooff announced the Agenda was rearranged by removing "Appli-
cation for Block Grant Funds and proposed resolution approving sub-
mission" from under UNFINISHED BUSINESS and placing same immediately
before HEARINGS.
Moved by Wilharm, seconded by Bowers that the Agenda, as changed, for
the Regular Session of February 9, 1976 at 7:00 P.M., be accepted and
approved. Motion carried.
69434 - Moved by Geiger, seconded by Getty that the Minutes of the Regular
Session held February 2, 1976 at 7:00 P.M., be approved. Motion car-
ried.
69435 - Mayor Rooff recognized Dave Fish and Britt Wadey of Boy Scout Troop
106 of West Junior High who were in attendance.
69436 - Under Council Action #69423 of 2/2/76, action was deferred on the
Application for Block Grant Funds and proposed resolution approving
submission. Mayor Rooff called for any written or oral objections or
support. Carroll Alberts, 225 West Parker Street, presented a pro-
posal of the Citizens for Community Improvement for $400,000 for re-
habilitation of homes.
Moved by Getty, seconded by Lichty that the above proposal be received
and placed on file. Motion carried.
69437 - Upon the request of Sue Vanderlind, Mayor Rooff read the proposed
breakdown of allocations: Paving $364,000, Sewer $151,000, Stalin
Sewer $185,000, Parking Lot Development $110,000, Ramp Repairs $75,000,
Parking Lot Paving $30,000, Park Improvement $6,000, Greenbelt Ac-
quisition $22,000, Code Enforcement $5,000, Demolitions$50,000, Re-
habilitation Grants $105,000, Elderly and Handicapped $10,000, Planning
$20,000, Administration $25,000, Contingencies $19,000.
Rick Stone, Vice -President of Downtown Council,read a statement urging
approval of funds for downtown parking, a key issue for successful
redevelopment of downtown.
Moved by Dowie, seconded by Bowers that the above statement be receiv-
ed and placed on file. Motion carried.
69438 - Mrs. Irving Carpenter, Lavonne Howrey, 1137 Columbia Street, Cynthia
Wagner, 345 Albany Street, protested the slow processing of rehabili-
tation grants and loans. Ida Tillman, 328 Anthony Street, reported
there was accumulated junk in yards in her neighborhood.
Jim Wilson, 315 Courtland Street, read a petition for elimination of
allotments for East 3rd and Sycamore Street Parking and West Side
Parking Lot and these allotments added to Housing Rehabilitation, and
demanded a motion be made accordingly. Mayor Rooff stated he would
not demand such a motion be made.
A discussion followed on parking lot allotments, use of Block Grant
funds for closing out Westfield -Virden Urban Renewal program, acquis-
ition and demolition of East 3rd and Park area, 1972 study showing
parking needs.
Moved by Wilharm, seconded by Lichty that the above petition be receiv-
ed and placed on file. Motion carried.
69439 - Charles H. Dykeman, Vice -President of Waterloo Chamber of Commerce,
read a statement supporting the proposed expenditures of Block Grant
funds, downtown revitalization and housing rehabilitation; also, that
the $200,000 carry over funds plus $110,000 and $50,000 in the present
proposal would make $360,000 available for housing rehabilitation
loans and grants during the next 18 months which should be efficiently
and adequately processed, and offering assistance to reach a satisfac-
tory solution. Mayor Rooff accepted the offer and asked that a com-
mittee be formed.

received and placed on file. Motion carried.
69440 - Also speaking in support of a larger housing rehabilitation allotment
were: Dorothy Wilson, Ruth Anderson, John Hollingsworth, John John-
son, Peg Thomas, Robert Norman, Rev. Stanley Kennedy, Lottie Odem,
and others.
Councilman Getty supported the Mayor's proposed budget. Councilman
Wilharm stated he would support the proposed budget in view of the
Chamber of Commerce statement that all the past funds have not been
used and that this money was still available for housing rehabilita-
tion grants and loans.
Moved by Getty, seconded by Wilharm that the Mayor's proposed budget
for Block Grant funds be accepted and approved as presented. Ayes:
Getty and Wilharm. Nays: Bowers, Dowie, Geiger and Lichty. Absent:
Roehr. Motion not carried.
69441 - Moved by Dowie, seconded by Bowers that the Mayor's proposed budget
be adjusted by decreasing Item (a) Paving by $100,000 and this amount
reallocated to Item 5, Rehabilitation Grants, with new figures of
$264,000 for Item (a) and $210,000 for Item 5. Ayes: Six. Absent:
Roehr. Motion carried.
FIVE MINUTE RECESS
69442 - Russ Candee, 601 Midlothian Blvd., and Lynn Cutler, Black Hawk County
Supervisor, 705 Prospect Avenue, asked for Council support for the
$2,750,000 bond issue for the Black Hawk County Care Facility at the
March 2, 1976 special election, and presented a brochure.
Moved by Wilharm, seconded by Dowie that the above request and brochure
be received, placed on file and "Resolution supporting the $2,750,000
bond issue for the Black Hawk County Care Facility", adopted. Ayes:
Six. Absent: Roehr. Resolution adopted and upon approval by Mayor,
assigned No. 24439 in official resolution book.
69443 - Moved by Dowie, seconded by Bowers that "Resolution approving the
submission of a revised Application to the Department of Housing and
Urban Development for Federal Assistance under Title I of the Housing
and Community Development Act of 1974", be adopted and the Mayor
authorized and directed to execute said revised Application. Ayes:

69444 Moved by Getty, seconded by Wilharm that the proof of publication of
the Notice of Public Hearing on proposal to vacate the portion of East
Second Street lying SEly of and adjacent to Lots 1 and 4, Block 7,
Original Plat East, as published in the Waterloo Daily Courier on
January 29, 1976, be received and placed on file. Motion carried.
69445 - The Mayor announced the time had arrived to hear objections, and call-
ed for oral and written objections. No objections were made or filed.

portion of East Second Street lying SEly of and adjacent to Lots 1 and
4, Block 7, Original Plat East, in the City of Waterloo, Iowa", be
considered and the rules requiring ordinances to be considered and
voted on at two prior meetings, suspended, said Ordinance recorded as
having been considered and passed for the first, second and third
times, and now placed on its final adoption. Ayes: Six. Absent:
Roehr. Motion carried.
69446 - Moved by Wilharm, seconded by Getty that "An Ordinance vacating a por-
tion of East Second Street lying SEly of and adjacent to Lots 1 and 4,
Block 7, Original Plat East, in the City of Waterloo, Iowa", be adopt-
ed, with retention of utility easement until present utilities are re-
located. Ayes: Six. Absent: Roehr. Ordinance adopted and upon
approval by Mayor, assigned No. 2787 in official ordinance book.

69449 - Moved by Wilharm, seconded by Dowie that "Ordinance vacating three

69450 - Moved by Bowers, seconded by Dowie that the communication from the
Property Administrator, transmitting an offer from Arlin Company,
Incorporated to purchase a part of right-of-way of Ansborough Avenue
(Black Hawk Road area) for the amount of $500, and requesting a date
of hearing be set, be received, placed on file and "Resolution fix-
ing the time and place of hearing as March 1 at 7:00 P.M. in Council
Chambers in City Hall on a proposal to vacate, sell and convey a
part of right-of-way of Ansborough Avenue to Arlin Company, Incorp-
orated", adopted. Ayes: Six. Absent: Roehr. Resolution adopted
and upon approval by Mayor, assigned No. 24441 in official resolution

69451 - Moved by Geiger, seconded by Dowie that request from Roberts Home
Decorating Center, 544 Ansborough Avenue, for permission to construct
a temporary commercial asphalt driveway on Stratford Avenue without
regard to sidewalk grade, together with $3.00 for recording waiver,
and City Engineer's recommendation for approval subject to the pro-
visions of his letter, be received, placed on file, approved and
"Resolution granting peLuiission to Roberts Home Decorating Center and
authorizing construction of a temporary asphalt driveway at 544 Ans-
borough Avenue on Stratford Avenue irrespective of later official
grade", adopted. Ayes: Six. Absent: Roehr. Resolution adopted

69452 - Moved by Bowers, seconded by Dowie that the City Treasurer's Finan-
cial Report for January, 1976, showing Balance on Hand 1/1/76
$13,422,696.36, Receipts $1,973,971.92, Disbursements $3,075,625.88,
Balance on Hand 1/31/76 $12,321,042.40, be received, placed on file
and approved. Motion carried.
69453 - Moved by Getty, seconded by Lichty that Operation Permit No.
5-07-90-0-01 for Waterloo Wastewater Treatment Plant from Iowa De-
partment of Environmental Quality, subject to certain conditions
and requirements, be received and placed on file. Motion carried.
69454 - Moved by Wilharm, seconded by Bowers that communication from City
Engineer, transmitting an Agreement of Public Improvement with the
Iowa Department of Transportation for Resurfacing Project on U.S.
218 from Plymouth Avenue to Eleventh Street, FN -218-7(34)--21-07,
and recommending approval, be received, placed on file and "Reso-
lution approving Agreement of Public Improvement with Iowa Depart-
ment of Transportation", adopted. Ayes: Six. Absent: Roehr.

69455 - Moved by Geiger, seconded by Dowie that communication from City En-
gineer, transmitting Professional Engineering Services Agreement
with Bert B. Hanson & Associates, Inc., Independence, Iowa, for in-
spections on all bridges within the City, reporting an estimated
cost of $12,000, and recommending approval, be received, placed on
file and "Resolution approving and directing execution of the Pro-
fessional Engineering Services Agreement with Bert B. Hanson &
Associates, Inc. by the Mayor and City Clerk", adopted. Ayes: Six.

ordinances to be considered and voted on at two prior meetings, sus-
pended, said Ordinance recorded as having been considered and passed
for the first, second and third times, and now placed on its final

69457 - Moved by Wilharm, seconded by Lichty that "An Ordinance repealing
Subsections 19, 22, 23, 24, 25 and 27 of Chapter 9 of the Code of
Ordinances of the City of Waterloo", be adopted. Ayes: Six. Ab-

tion 36-58 "Rates established; Computation of Waiting Time" by
repealing Subsections (a) (1), (a) (2), and (a) (5) and enacting in
lieu thereof new Subsections (a) (1), (a) (2), and (a) (5)", be con-
sidered and the rules requiring ordinances to be considered and
voted on at two prior meetings,.suspended, said Ordinance recorded

Commission on Human Rights for three year terms to expire on January 1,

69470 Moved by Geiger, seconded by Lichty that communication from Fire Chief,
reporting Daniel J. Lorraine, a Member of the Fire Deparment, passed
away on January 27, 1976, and his widow is entitled to sixty days sick
leave pay of $3,151.38 and five weeks vacation pay of $1,388.08, in
the total sum of $4,539.46, be received, placed on file and "Resolu-
tion approving payment of $4,539.46 for sick leave and vacation pay
to the widow of Daniel J. Lorraine, deceased, of the Fire Department
and authorizing a warrant be drawn in payment therefor", adopted.

and list of bonds filed with Clerk through 2/9/76, be received, plac-
ed on file and approved. Motion carried.
