The Council of City of Waterloo, Iowa, met in Regular Session in Council
Chambers in City Hall at 7:00 P.M. on February 2, 1976. Mayor Rooff in the
Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty and Wi1-
haLm. Absent: Roehr. Invocation by Councilman Wilharm.
69408 - Moved by Getty, seconded by Lichty that the Agenda, as amended, for
the Regular Session of February 2, 1976 at 7:00 P.M., be accepted and
approved. Motion carried.
69409 - Moved by Geiger, seconded by Dowie that the Minutes of the Regular
Session held January 26, 1976 at 7:00 P.M., be approved. Motion
carried.
69410 - Moved by Wilharm, seconded by Bowers that the proof of publication of
"Notice of Assessment" (Weed Cutting or Destroying for the Year 1975)
in the City of Waterloo, Iowa, be received and placed on file. Motion
carried.

69412 - Moved by Bowers, seconded by Dowie that proof of publication of Notice
of Proposal to Dispose of Real Estate in Sections 11-88-13 and 2-88-13,
as published in the Waterloo Daily Courier on January 22, 1976, to
State of Iowa, be received and placed on file. Motion carried.
69413 - The Mayor announced the time had arrived to hear objections, and call-
ed for oral and written objections. No objections were made or filed.
Moved by Wilharm, seconded by Dowie that "Resolution approving and
authorizing the conveyance of two parcels of land in Sections 11-88-13
and 2-88-13, as published in the Waterloo Daily Courier on 1/22/76, to
the State of Iowa, and directing and authorizing the Mayor and City
Clerk to execute and deliver a deed for said property", be adopted.
Ayes: Six. Absent: Roehr. Resolution adopted and upon approval by
Mayor, assigned No. 24434 in official resolution book.
69414 - Councilman Bowers presented a written request for the City Attorney
to review Chapter 9, Article II, Dangerous Buildings, Section 9-18
through Section 9-29, of the City Code of Ordinances and to present
to the Council by February 9, 1976, for action enforceable recommen-
dations in clear language as to how the City can insure that a vacant
house be secured and kept secured at all times, spelling out whose
responsibility for enforcement; also, whenever a house is demolished
that the debris be cleaned up iuunediately and the lot leveled and
seeded, with an ordinance amending said Sections 9-18 through 9-29 to
be submitted to the Council on February 16, 1976.
Moved by Dowie, seconded by Lichty that the above request be received,
placed on file, approved, and the City Attorney instructed to proceed
accordingly with recommendations to be submitted by February 9, 1976.
Motion carried.
69415 - Moved by Wilharm, seconded by Dowie that request of City Engineer for
Schenk Engineering Company for review and approval of a proposed
Sanitary Sewer Extension in the SE4 of Section 13-88-13 (Dysart Road
and East Orange Road area), as shown on the attached plats, and Plan
and Program Commission's recommendation for approval, be received,
placed on file and approved. Motion carried.
69416 - Moved by Wilharm, seconded by Getty that the communication from City
Plan and Program Commission, transmitting a request from Ivan L.
Myers and Virginia M. Myers for voluntary annexation to the City of
Waterloo, Iowa, real estate known as the SE4 of SE4 of Section 13-
88N -13W (Dysart Road and East Orange Road area), as shown on attached
map, be receivedand placed on file. Motion carried.

Moved by Dowie, seconded by Lichty that "Resolution annexing real
estate known as Southeast One-fourth (4) of the Southeast One-fourth
(4) of Section Thirteen (13), Township No. Eighty-eight (88) North,
Range No. Thirteen (13) West of the Fifth Principal Meridian, Black
Hawk County, Iowa, to the City of Waterloo, Iowa", be adopted. Ayes:
Six. Absent: Roehr. Resolution adopted and upon approval by Mayor,
assigned No. 24435 in official resolution book.
69418 - Moved by Getty, seconded by Lichty that the request of John Deere
Waterloo Tractor Works, 400 Westfield Avenue, for permission to con-
struct one 30° commercial curb cut on Westfield Avenue, as shown on
attached plat, and City Engineer's recommendation for approval sub-
ject to the provisions of his letter, be received, placed on file,
recommendations approved and permission granted in accordance there-
with at no cost to the City. Motion carried.
69419 - Moved by Wilharm, seconded by Dowie that the communication from City
Engineer, transmitting an Assigned Contract and Bond for Contract No.
181, be received, placed on file and "Resolution approving the
Assigned Contract and Bond of William R. Hennessey & Son, Incorporated,
Contractors, Marion, Iowa, for the Orange Township Sanitary Sewer Im-
provement Project, Contract No. 181", adopted. Ayes: Six. Absent:
Roehr. Resolution adopted and upon approval by Mayor, assigned No.
24436 in official resolution book.
69420 - Under Council Action #69363 of 1/19/76 action was deferred on a Data
Processing Agreement between the City of Waterloo, Iowa and Black
Hawk County, Iowa.
Moved by Getty, seconded by Bowers that the Revised Data Processing
Agreement dated 1/12/76 between the City of Waterloo, Iowa and Black
Hawk County, Iowa, be received, placed on file and "Resolution ap-
proving and directing execution of Data Processing Agreement dated
1/12/76 by the Mayor in behalf of the City of Waterloo, Iowa", adopt-
ed. Ayes: Six. Absent: Roehr. Resolution adopted and upon ap-
proval by Mayor, assigned No. 24437 in official resolution book.
69421 - Moved by Bowers, seconded by Lichty that Construction Permit No.
76-267-S for Sanitary Sewer Extension to Kingswood First Addition,
Waterloo, Iowa, from Iowa Dept. of Environmental Quality, subject to
certain conditions and requirements, be received and placed on file.
Motion carried.
69422 - Moved by Lichty, seconded by Dowie that "Resolution of cooperation
with Department of Housing and Urban Development relating to the Low
Rent Housing Program", together with report of City Attorney, be re-
ceived, placed on file and adopted. Ayes: Six. Absent: Roehr.
Resolution adopted and upon approval by Mayor, assigned No. 24438 in
official resolution book.
69423 — Mayor Rooff read a list of projects, activity descriptions and pro-
posed funding included in the City's application for a $1,182,000
Community Development Block Grant.
A group of concerned citizens objected as being too small the amount
earmarked for housing rehabilitation grants and criticized the
Community Development department for slowness in processing appli-
cations.
Community Development Administrator Mercer stated the maximum limit
for each grant was $5,000 with any additional cost of rehabilitation
to be raised by the applicant, pointing out the Council had raised
the grant ceiling from $3,500 to $5,000; and, the lack of the avail-
able contractors.
Mayor Rooff stated the application must be filed by March 1, 1976.
A discussion followed with James Wilson, Robert Morman, Lottie Odem,
Dorothy Wilson and Rev. Burt, and others, supporting the objectors.
Upon affirming a week's delay in submitting the application would
not place it in jeopardy, it was moved by Councilman Bowers, second-
ed by Lichty that the Application for Block Grant Funds and proposed

resolution approving submission, together with Community Development
Board's recommendation for approval, be received, placed on file
and action deferred until February 9, 1976 for further study. Ayes:

69424 - Moved by Dowie, seconded by Bowers that communication from Fire
Chief requesting Council approval of the following promotions in the
Fire Department, effective February 1, 1976, be received, placed on
file and approved: To rank of Captain - Robert Scharnweber. To
rank of Lieutenant - James Weber and Frank Magsamen. Motion carried.
69425 - Moved by Bowers, seconded by Lichty that the communication from
Mayor Rooff, submitting for Council approval the appointment of
Edward D. Paulsen to the Waterloo Water Works Board of Trustees to
fill the unexpired team of Allen C. Jensen, deceased, to expire
January 12, 1978, be received, placed on file and approved. Motion
carried.
69426 - Moved by Wilharm, seconded by Geiger that the following request for
permission to attend functions, with expenses allowed not to exceed
amounts shown, be received, placed on file and approved: Superin-
tendent of Water Pollution Control Plant and one Councilman to Mid-
west Conference on Land Application of Municipal Wastes, Omaha,
Nebraska, February 11, 12 and 13, 1976, $226.00 plus registration
and use of City car; Asst. Superintendent of Water Pollution Control
Plant to Laboratory Training Course for Pollution Control Plant
Operators, Ames, Iowa, February 23, 24 and 25, 1976, $145.00 plus
use of City car; Zoning Administrator and one Commissioner to Joint
American Institute of Planners and American Society of Planning
Officials Conference, Washington D.C., March 21 thru 25, 1976,
$337.47 plus registration each. Ayes: Six. Absent: Roehr. Mo-
tion carried.
69427 - Moved by Wilharm, seconded by Geiger that communication from Charles
F. Hinton, Attorney, reporting a favorable ruling from the Black
Hawk County District Court on the application of Midwest Paper and
Metals Company for a Junk Dealer License at 2724 Lafayette Street,
and requestirg issuance of said License, be received, placed on file
and license granted, subject to requirements of ordinance governing
same and pending receipt of agreement from owner to perform the
work needed to comply with the code requirements. Motion carried.
69428 Moved by Geiger, seconded by Getty that the application and fee of
Laverne Cecil Moon, 730 Calumet Drive, Cedar Falls, for a taxicab
driver's permit, be received, placed on file and granted. Motion
carried.
69429 - Moved by Geiger, seconded by Lichty that following applications for
Beer Pe&uiits and Beer and Liquor Licenses, be received, placed on
file, approved, the approval endorsed on applications and same for-
warded to the Iowa Beer and Liquor Control Department:

69431 - Moved by Getty, seconded by Bowers that the report of City Attorney
and list of bonds filed with Clerk through 2/2/76, be received, plac-
ed on file and approved. Motion carried.
69432 - Moved by Geiger, seconded by Getty that the Council adjourn. Motion
carried.
