Mayor Pro Tem Wilharm in the Chair. On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr and Wilharm. Invocation by Councilman Geiger. 69624 - Moved by Roehr, seconded by Bowers that the Agenda, as proposed for the Regular Session of March 15, 1976 at 7:00 P.M., be accepted and approved. Motion carried. 69625 - Moved by Geiger, seconded by Dowie that the Minutes of the Regular Ses- sion held March 8, 1976 at 7:00 P.M. and Special Session held March 15, 1976 at 8:00 A.M., be approved as corrected. Motion carried. 69626 - Moved by Roehr, seconded by Bowers that proof of publication of Notice of Public Hearing on Re -zoning, upon the request of W. Louis Beecher, Atty. for G. P. Schoenfelder, upon recommendation of City Zoning Commi- ssion and Council's own motion, to rezone from "R-3" Multiple Residence District to "R-4" Multiple Residence District part of NE Frac 4 of Sec- tion 2-88-13 and part of NE Frac 4 and SE-, of Section 2-88-13, located on South side of East Ridgeway Avenue and West of new K -Mart site, as published in Waterloo Courier on February 26, 1976, be received and placed on file. Motion carried. 69627 - The Mayor Pro Tem called for oral and written objections and there were none. Moved by Getty, seconded by Lichty that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 86 to Section 2A-5, re- zoning certain property", be considered and passed for the first time. Ayes: Seven. Motion carried. 69628 - Moved by Bowers, seconded by Dowie that proof of publication of Notice of Public Hearing on Rezoning, upon request of Harold and Virginia Guetzlaff, upon recommendation of City Zoning Commission and Council's own motion, to rezone from "R-4" Multiple Residence District to "C-1" Commercial District, part of Section 3 -88N -13W, located on East side of Kimball Avenue and North of Brookeridge Drive, as published in the Water- loo Courier on February 26, 1976, be received and placed on file. Mo- tion carried. 69629 - The Mayor Pro Tem called for oral and written objections and there were none. Moved by Dowie, seconded by Roehr that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 87 to Section 2A-5, re- zoning certain property', be considered and the rules requiring ordi- nances to be considered and voted on at two prior meetings, suspended, and said Ordinance passed on first, second and third times and placed on its final adoption. Ayes: Bowers, Dowie, Geiger, Lichty, Roehr and Wilharm. Nay: Getty. Hauser, et al, upon recommendation of City Zoning Commission and Council's own motion, to re- zone parts of Section 3-88-13 located South of Ravenwood Health Care Cen- ter in Hammond Hills between St. Francis Drive and Hammond Avenue, from "A-1" Agricultural District to "R-2" One and Two Family Residence Dis- trict, "R-4" Multiple Residence District and "C-1" Commercial District, as published in the Waterloo Courier on February 26, 1976, be received and placed on file. Motion carried. 69633 - Councilman Bowers briefly reported on the status of rehabilitation block grant fund and asked the Council to approve transferring of $70,000 from the loan fund to the grant fund when submitted next week. Moved by Dowie, seconded by Roehr that the above request be received, placed on file and considered 3/22/76. Motion carried. 69634 - Moved by Roehr, seconded by Bowers that request of Hoi Kit Wong dba Hong Kong Cafe, Inc., 631 Lafayette Street, for refund of $360.00 fee for Beer Permit, which was not issued, be received, placed on file and approved. Ayes: Seven. Motion carried. 69638 - Moved by Dowie, seconded by Bowers that construction plans for sanitary sewer extension for Dale Paulsen, Cemetery Road, Orange Township, with Treatment Agreement Form C 9/75 for Dept. of Environmental Quality, and City Engineer's recommendation for approval with final acceptance of plans subject to acceptance by said Department, be received, placed on file, recommendations approved and Mayor and Clerk authorized to execute said Agreement FoLin. Motion carried. 69639 - Moved by Roehr, seconded by Lichty that "Ordinance vacating portions of easements located on West 8' of Lots 22 and 23, Brookeridge Addition and East 8' of Tract A, Southbrooke Addition", be considered and rules requiring ordinances to be voted on at two prior meetings, suspended, and said Ordinance passed for second and third times and placed on its final adoption. Ayes: Seven. Ordinance adopted and upon approval by Mayor Pro Tem, assigned No. 2803 in offi- cial ordinance book. 69643 Moved by Bowers, seconded by Getty that "An Ordinance amending Chapter 33 of "Code of Ordinances, City of Waterloo, Iowa" by repealing Sec- tion 120 Thereof in Its Entirety and Enacting In Lieu Thereof a New Section 120 of Chapter 33 of "Code of Ordinances, City of Waterloo, Iowa" Relating to Numbering of Buildings on Streets and Sidewalks", be considered and passed for the first time. Ayes: Seven. Motion car- ried. 69644 - Moved by Getty, seconded by Dowie that communication from Community Development Administrator, transmitting proposed Fair Market Value resolution and recommending approval, be received, placed on file and "Resolution establishing fair market value for certain properties to be acquired in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7", be adopted. Ayes: Seven. Resolution adopted and upon ap- proval by Mayor Pro Tem, assigned No. 24480 in official resolution book. 69645 - Moved by Bowers, seconded by Roehr that "Resolution accepting certain deeds for public street purposes", be adopted. Ayes: Seven. Resolu- tion adopted and upon approval by Mayor Pro Tem, assigned No. 24481 in official resolution book. 69646 - Moved by Bowers, seconded by Lichty that communication from McElroy Auditorium Manager reporting retirement of Walter Renner as of 3/8/76• and entitlement to 376 hours sick leave and two weeks vacation pay, be received, placed on file and "Resolution approving payment of $1,128.00 accumulated sick leave and vacation pay to Walter Renner, retiree of McElroy Auditorium", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor Pro Tem, assigned No. 24482 in offi- cial resolution book. 69647 - Councilman Roehr recommended that Flower Street from Scott Avenue to Sheerer Avenue be included in the 1976 Paving Program. The intersec- tion of Scott Avenue and Flower Street was to be included and the two intakes on Flower Street were to be considered. Moved by Roehr, seconded by Bowers that the above recommendation of Councilman Roehr and the recommendation from the City Engineer that to correct a drainage problem , one block of Sheerer Avenue from Flower Street to a frontage road on University Avenue should be included in the 1976 Paving Program, be received, placed on file, approved and the one block of Sheerer Avenue from Flower Street to a frontage road on University Avenue and Flower Street from Scott Avenue to Sheerer Avenue ordered included in the said 1976 Paving Program.
