On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr, and Wilharm. Invocation by Councilman Geiger. 69559 - Moved by Roehr, seconded by Dowie that the Agenda, as amended, for the Regular Session of March 1, 1976 at 7:00 P.M., be accepted and approved. Motion carried. 69560 - Moved by Getty, seconded by Bowers that the Minutes of the Regular Ses- sion held February 23, 1976 at 7:00 P.M., be approved. Motion carried. 69561 - Moved by Roehr, seconded by Dowie that request of City Plan and Pro- gram Commission that a public hearing be set on the request of Fred Debe for Country Manor, Inc. for approval of a revised site development plan for Prairie Meadow West, east of Ansborough Avenue and North of Iowa Highway No. 412, approved under Council Action #69532 of 2/23/76, be received, placed on file, Council Action #69532 of 2/23/76 rescinded, date of hearing set as April 5, 1976 at 7:00 P.M. and Clerk instructed to publish notice. Motion carried. 69562 - Moved by Getty, seconded by Bowers that proof of publication of Notice of Public Hearing on proposal to sell Disposal Parcel No. G-3, Project No. Iowa R-7, Westfield Virden Urban Renewal Area, 47, 51-57 Commercial Street, published in the Waterloo Daily Courier on January 29, 1976, to John Deere Waterloo Tractor Works of Deere & Company, be received and placed on file. Motion carried. 69563 - The Mayor announced the time had arrived to hear objections, and called for oral and written objections. No objections were made or filed. Moved by Getty, seconded by Bowers that "A resolution approving the sale of Disposal Parcel No. G-3 in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, and authorizing the execution df the necessary contract for sale of land for private redevelopment and deed", be adop- ted. Ayes: Seven. Resolution adopted and upon approval by Mayor, as- signed No. 24467 in official resolution book. 69564 Moved by Roehr, seconded by Dowie that proof of publication of Notice of Public Hearing on proposal to sell Disposal Parcel Nos. G -4A, G -4C and G -4B (p) in Westfield -Virden Urban Renewal Area, north and west of 85 Commercial Street along east side of River Road, published in the Waterloo Daily Courier on January 29, 1976, to Nancy Shirey Trust, Water- loo Savings Bank, Trustee, be received and placed on file. Motion carried. 69565 - The Mayor announced the time had arrived to hear objections, and called for oral and written objections. No objections were made or filed. Moved by Dowie, seconded by Getty that "A resolution approving the sale of Disposal Parcel No, G -4A, Disposal Parcel No. G -4C and Disposal Parcel No. G-4B(p) in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, and authorizing the execution of the necessary contract for sale of land for private redevelopment and deed", be adopted. Re- solution adopted and upon approval by Mayor, assigned No. 24468 in offi- cial resolution book. 69566 - Moved by Getty, seconded by Roehr that proof of publication of Notice of Public Hearing on proposal to sell Disposal Parcel No. G -4B (p) in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, published in the Waterloo Daily Courier on January 29, 1976, to Holmes Motor Com- pany, be received and placed on file. Motion carried. 69567 - The Mayor announced the time had arrived to hear objections, and called for oral and written objections. No objections were made or filed. Moved by Bowers, seconded by Roehr that "A resolution approving the sale of Disposal Parcel No. G -4B (p) in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, and authorizing the execution of the neces- sary contract for sale of land for private redevelopment and deed", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24469 in official resolution book. 69568 - Moved by Getty, seconded by Bowers that proof of publication of Notice of Proposal to Dispose of Real Estate, a part of right-of-way of Ans- borough Avenue (Black Hawk Road area), as published in the Waterloo Daily Courier on February 13, 1976, to Arlin Company, Incorporated for the sum of $500.00 plus costs, be received and placed on file. Motion carried. - 2 - • 69569 - The Mayor announced the time had arrived to hea_ objections, and called for oral and written objections. No objections were made or filed. Moved by Wilharm, seconded by Dowie that "Resolution approving and autho- rizing sale and conveyance of part of right-of-way of Ansborough Avenue (Black Hawk Road area), as published in the Waterloo Daily Courier on 2/13/76, to Arlin Company, Incorporated for $500 plus costs, and direct- ing and authorizing the Mayor and City Clerk to execute and deliver a deed for said property", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24470 in official resolution book. 69570 - Anna Mae Weems related her excitement and awareness of the award trophy presented her by the City last year for dedication and exceptional pub- lic service for a better community, suggested an award trophy be given this year and offered the name of the late Herb Cox as recipient with the trophy to be placed in the museum in his honor. Moved by Bowers, seconded by Lichty that the above request be received and placed on file. Motion carried. 69571 - Anna Mae Weems of Job Services of Iowa, to make the entire Council aware of the study and need for Opportunity Industrialization Centers of Amer- ica in Waterloo, briefly outlined its purpose and how this would be achieved. She pointed out the need for answers as to how much money would be available, who would be responsible for it, would the City fund O.I.C.; asking that the Council be in on the groundwork as its support and leadership was needed, and that the Mayor be in on the orientation by accompanying a pilot group of the Governor, KWWL,-Courier, IPS, Vi- king Pump, Cedar Falls Mayor Crews, Chamber of Commerce, Manpower, or their representatives, to Chicago on March 5, 1976. Moved by Getty, seconded by Geiger that Mayor Rooff be allowed to attend this meeting with all expenses paid, and if he is unable to go, someone else go in his place. Ayes: Seven. Motion carried. 69572 - Councilman Wilharm stated the citizens on Wisconsin Street, going north from Ridgeway Avenue, have reported that the yield sign regulations are not being complied with and that this area should be heavily policed or stop signs installed. Moved by Wilharm, seconded by Lichty that the above report be received, placed on file and referred to the Sign and Traffic Department with a report back to the Council. Motion carried. 69573 - Moved by Dowie, seconded by Bowers that petition of Mrs. May Schotter, 203 Miriam Drive, et al, for concrete paving of Miriam Drive from Hale Street to Vermont Street, representing 90%, together with City Engi- neer's report this is in the proposed 1976 Paving Program, be received and placed on file. Motion carried. 69574 Moved by Getty, seconded by Roehr that petition of Eldora E. Mixdorf, 223 Reed Street, et al, against paving of Kern Street from Columbia Street to Cutler Street, representing 50% between Columbia Street and Lincoln Street, 77.% between Lincoln Street and Reed Street, and 16% between Reed Street and Cutler Street, and City Engineer's report that Kern Street between Lincoln and Reed Streets is deleted, and recommend- ing deletion of Kern Street between Columbia and Lincoln Streets and re- tention of Kern Street between Reed Street and Cutler Street in the 1976 Paving Program be received, placed on file and recommendations approved. Motion carried. 69575 - Moved by Bowers, seconded by Lichty that petition of Mr. and Mrs. Al- bert Worcester, 329 Archer Avenue, et al, objecting to paving of 300 and 400 block of Archer Avenue (between Linden and Nevada Streets), and City Engineer's report these two blocks have been deleted from the 1976 Pav- ing Program, be received and placed on file. Motion carried. 69576 - Moved by Roehr, seconded by Bowers that the 1975 Audit Report for Motor Vehicle Parking Facilities Funds as made by Carney, Alexander, Marold & Co., C.P,A.s, be received and placed on file. Motion carried. 69577 - Moved by Bowers, seconded by Wilharm that the request of the EEO Officer to attend the "Dealing with EEO" Seminar, New York, N.Y., March 2 thru 5, 1976, $850.00, on which action was deferred under C.R. #69552 of 2/23/76, be granted. Ayes: Bowers, Dowie, Geiger, Roehr, and Wilharm. Nayes: Getty and Lichty. Motion carried. March 1, `1976 - 3 - 69578 Moved by Roehr, seconded by Getty that Communication from City Attor- ney, transmitting a Tenant Dwelling Lease, Grievance Procedure and Statement of Policy regarding Low Rent Housing, and recommending ap- proval of Lease and Grievance Procedure and adoption of Statement of Policy, be received, placed on file, recommendations approved and "Re- solution approving the Tenant Dwelling Lease and Grievance Procedure and adopting the Statement of Policies governing admission to and con- tinued occupancy of the HUD assisted Low -Rent Public Housing Projects including Section 23 and Units owned and operated by City of Waterloo Housing Authority", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24471 in official resolution book. 69579 Moved by Getty, seconded by Roehr that Construction Permit No. 76-299-S for Sanitary Sewer Extension to Deward-Felcher Industrial Park, Water- loo, Iowa, from Iowa Department of Environmental Quality, subject to certain conditions and requirements, be received and placed on file. Motion carried. 69580 Moved by Roehr, seconded by Dowie that the Contract dated 3/1/76 be- tween the City of Waterloo, Iowa and The Waterloo Policemen's Protec- tive Association, be received, placed on file and "Resolution approv- ing the Contract with the Waterloo Policemen's Protective Association and authorizing the mayor to sign and execute same in behalf of the city of Waterloo, Iowa", adopted. Ayes: Bowers, Dowie, Geiger, Lichty, Roehr, and Wilharm. Nay Getty. Resolution adopted and upon appro- val by Mayor, assigned No. 24472 in official resolution book. 69581 - Moved by Dowie, seconded by Getty that "An Ordinance amending Ordinance No. 1461, Subsection 4, (Also known as Chapter 34, Subsection 78, of the Code of Ordinances, Oity of Waterloo) by repealing Subsection 78(d) of Chapter 34", be considered and the rules requiring ordinances to be considered and voted on for passage at two prior meetings, suspended, said Ordinance recorded as having been considered and passed for the second and third times (the first having passed under C.R. #69499 of 2/16/76; and, tabled under C.R. #69536 of 2/23/76), and now placed on its final adoption, Ayes: Seven. Motion carried. 69582 Moved by Wilharm, seconded by Bowers that "An Ordinance amending Ordi- nance No. 1461, Subsection 4, (Also known as Chapter 34, Subsection 78, of the Code of Ordinances, City of Waterloo) by repealing Subsection 78(d) of Chapter 34", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2798 in official ordinance book. 69583 Moved by Getty, seconded by Dowie that communication from Asst. City Attorney, transmitting a proposed Ordinance establishing fees for scav- engers to deposit night soil at the Water Pollution Control Plant and recommending passage on first reading, be received, placed on file and "An Ordinance amending Ordinance No. 1461, Subsection 4, (also known as Chapter 34, Subsection 78, of the Code of Ordinances, City of Waterloo) by adding new Subsection 78(d) of Chapter 34, the rules requiring ordi- nances to be considered and voted on at two prior meetings, suspended, said Ordinance recorded as having been considered and passed for the first, second and third times, and now placed on'its final adoption. Ayes: Seven.
