70015 - Moved by Roehr, seconded by Bowers that the Agenda, as amended, for the
Regular Session of May 24, 2976 at 7:00 P.M., be accepted and approved.
Motion carried.
70016 Moved by Dowie, seconded by Getty that the Minutes of the Regular Ses-
sion held May 17, 1976 at 7:00 P.M., be approved. Motion carried.
70017 - Harold Michels, in behalf of Frank Cooper, reported a revised site dev-
elopment plan had been submitted to the City Plan and Program Commis-
sion to allow a building to be set on the left hand property line in-
stead of the right and requested the Council to approve the change.
Associate Planner Temeyer stated the plan had been reviewed by the
Commission, recommended approval and a hearing be set, and presented
the revised site development pian.
Moved by Dowie, seconded by Getty that the above request, revised site
development plan, City Plan and Program Commission's recommendation for
approval, and Council's own motion, be received, placed on file, date
of hearing set as June 14, 1976 at 7:00 P.M.in City Hall and Clerk in-
structed to publish notice. Motion carried.
70018 - Moved by Roehr, seconded by Bowers that the revised site development
plan for Timberline Patio Homes as submitted by Jay Culver for Timber-
line Patio Homes, City Plan and Program Commission's recommendation
for approval, and Council's own motion, be received, placed on file,
date of hearing set as June 14, 1976 at 7:00 P.M. in City Hall and
Clerk instructed to publish notice. Motion carried.
70019 Moved by Bowers, seconded by Dowie that the five year site development
plan for an area South of East Donald Street and West of Elk Run Road
from Deere and Company, City Plan and Program Commission's recommenda-
tion for approval, and Council's own motion, be received, placed on
file, date of hearing set as June 14, 1976 at 7:00 P.M. in City Hall
and Clerk instructed to publish notice. Motion carried.
70020 - Moved by Getty, seconded by Lichty that the request of Anita Andries
for Gerold 0. Robinson and Carol A. Robinson, for the Council on its
own motion to rezone from "A-1" Agricultural District and "R-1" One
and Two Family Residence District to "C-1" Commercial District a tract
of land lying West of Logan Avenue and South of the Midwest Garden of
Memories Cemetery in Section 2 -89N -13W, as shown on attached plat, City
Zoning Commission's report that a number of property owners objected at
their hearing, and said Commission's recommendation for denial, be re-
ceived placed on file and date of hearing set as June 14, 1976 at 7:00
P.M. and Clerk instructed to publish notice. Motion carried.
70021 - Moved by Roehr, seconded by Bowers that request from Robert Stevenson
for renaming the portion of South Hackett Road lying between Lot 11
and Lots 12 and 13, Downing Heights Addition, as shown on attached plat,
and City Plan and Program Commission's recommendation that said portion
of South Hackett Road be renamed Deloris Drive, be received, placed on
file, recommendations approved and City Attorney instructed to submit
an ordinance accordingly. Motion carried.
70022 Moved by Roehr, seconded by Dowie that communication from City Attorney,
transmitting a Petition from Norma Phillips requesting suspension of
all taxes against the West 20' of Lot 10 and East 16' of Lot 11, and
the West 42' of Lot 11, all in Central Sub -Division, known as 120
Smith Street, now and hereafter so long as she remains the owner, under
and pursuant to the authority of Section 427.8 of the 1975 Code of Iowa,
be received, placed on file and action deferred until June 7, 1976.

70023 - John Beekman, Attorney for Wendell Lockard, reported the Central As-
sembly of God Church was on the city limits boundary, wants to purchase
six acres for a 120 member church, but the church itself would be in
Cedar Falls. In a discussion it was pointed out that several Waterloo
properties are serviced by Cedar Falls and vice versa, and double the
rate is paid.

Moved by Getty, seconded by Dowie that request from Wendell Lockard
for Ken -Jan, Inc. for sanitary sewer service for the Central Assembly
of God Church in Cedar Falls, and City Engineer's recommendation for
approval with connection at Scenic Drive, be received, placed on file,
recommendations approved and request granted in accordance therewith
with restriction of a single connection, Motion carried.
70024 - Moved by Getty, seconded by Geiger that request of Chamberlain Manu-
facturing Corporation for permission to construct one 22' commercial
curb cut in the 2400 block of East Fourth Street to serve a parking
lot, as shown on attached plat, and City Engineer's recommendation for
approval subject to the provisions of his letter, be received, placed
on file, recommendations approved and permission granted in accordance
therewith. Motion carried.

Hawk County Auditor, advising offers have been made on 3/31/76 and
5/18/76 for the following properties in amounts shown on which Black
Hawk County holds title, and requesting Council approval to accept
same subject to City of Waterloo waiving all special assessments and

on sanitary sewer petition for Suburban Heights area in southeast
Waterloo, referred to him under C.R.#69980 of 5/17/76, with recouuuend-
ation for inclusion in the 1978 sanitary sewer program, be received,
placed on file, recommendations approved and said sanitary sewer order-
ed included in the 1978 sanitary sewer program. Ayes: Bowers, Dowie,
