Invo- 70196 - Moved by Dowie, seconded by Bowers that the Agenda, as proposed, for the Regular Session of June 21, 1976 at 7:00 P.M., be accepted and approved. Motion carried. 70197 - Moved by Roehr, seconded by Wilharm that the Minutes of the Regular Session held June 14, 1976 at 7:00 P.M., be approved. Motion carried. 70198 - The Finance Committee, having checked the bids for the purchase of Tires, Tubes, Oils, Transmission Fluids, Batteries, Diesel Fuel, Fuel Oil, Elec- trolite and Anti -Freeze, recommended the acceptance of the low bids, both price and quality being taken into consideration. Moved by Getty, seconded by Dowie that the recommendation of the Finance Committee on bids submitted by various suppliers for Tires, Tubes, Oils, Transmission Fluids, Batteries, Diesel Fuel, Fuel Oil, Electrolite and Anti -Freeze, etc., be received, placed on file, recommendations approved, bids accepted as recommended, subject to the approval of the garage Supt. effective July 1, 1976 to June 30, 1977, and Finance Director directed and authorized to issue purchase orders and warrants in payment in ac- cordance therewith. Motion carried. 70199 - Ralph Grady reported he purchased Original Plat Waterloo East, SE 35' Lot 10, Block 45, had the condemned house torn down and the contractor was to take care of the permit. He stated he has received delinquent tax notices for 1973 $477.81, 1974 $512.12 and 1975 $161.58, asked forgive- ness of taxes as the house was demolished and presented the notices. Moved by Wilharm, seconded by Lichty that the above request for forgive- ness of taxes and notices be received, placed on file and referred to the City Attorney with a report back. Motion carried. 70200 - Louis Reimers, 1327 Shultz Street, reported that the vacant lot next to his property, owned by Ray White, is badly in need of cleaning up, and has been for the last several years. Mayor Rooff stated notice had been sent and he would check into this. 70201 - Hugo Boddeker, Joel Cizek and Ralph Grady, property owners of 1128, 1132, and 1134 Hawthorne Avenue, respectively, inquired as to difference in street improvement assessments when lots were equal in size; also, who pays for the replacement of driveway approach when torn out. Mayor Rooff instructed the City Engineer to check out the assessments and stated the property owner would replace the driveway approach, the City only puts the dirt back. 70202 - City Engineer Radue reported that the Orange Township Sanitary Sewer Program, Contract No. 181, calls for asphalting the streets and the affected property owners are asking this be delayed until next year to allow for settlement of trenches but his Department was going ahead with the asphalting this year. 70203 - Beatrice Allen inquired as to who paid for sodding when street improve- ments were made and was informed the City did not replace sodding or concrete approaches. She asked who decided what streets were to be paved and was told by petition and Council's motion; that several large programs were developed last year and Councilperson Berdell helped to select the streets in the Fourth Ward, but then, petitions objecting to the paving were received and the streets were taken out. 70204 - Walter Clark, 1401 Mulberry Street, inquired about repairing curb broken by storm sewer installation. Mayor Rooff stated it would cost $800,000 to replace all the broken curb in the City, there was no money but in the future an orderly program would be developed. Mr. Clark offered to do the work on Mulberry Street if the City would furnish the material. 70205 - Moved by Roehr, seconded by Wilharm that request from Chas. Mauser & Sons, Inc. for permission to construct one 22' commercial curb cut at 3139 Brockway Road to serve Frank Cooper building, as shown on attached plat, and City Engineer's recommendations for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. - 2 - 70206 - Moved by Roehr, seconded by Dowie that request from T & H Concrete for permission to construct one 20' commercial curb cut at 3151 Brockway Road, as shown on attached plat, and City Engineer's recommendations for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith. Motion carried. 70207 - Moved by Getty, seconded by Roehr that request from Fred A. Carpenter for permission to construct a temporary concrete driveway at 311 Downing Avenue without regard to sidewalk grade, together with $3.00 for record- ing waiver, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Fred A. Carpenter and authorizing con- struction of a temporary concrete driveway at 311 Downing Avenue irrespec- tive of a later official grade", adopted. Ayes: Seven. Resolution adopted and upon approval of Mayor, assigned No. 24617. 70208 Moved by Dowie, seconded by Geiger that report of Waterloo Civil Service Commission certifying the following ten applicants as eligible for ap- pointment to the Waterloo Police Department, be received, placed on file and approved: Richard G. Byersdorfer, Daniel R. Oliver, William C. Hilton, Michael J. O'Conner, Mark R. Meyer, Gregory L. Engel, Michael D. Hansen, David L. Marshall, Carl D. Carrier, Steven A. Boss. Motion carried. 70209 Moved by Wilharm, seconded by Bowers that the recommendation of Associ- ated Insurance Advisors, Inc., Insurance Consultants, that the City of Waterloo should continue its group medical/surgical program with Blue Cross/Blue Shield for another term, be received, placed on file, approved and "Resolution approving continuance of the group medical/surgical pro- gram with Blue Cross/Blue Shield to June 1, 1977", adopted, with the rates as follows: Blue Blue Major I.P.S.C. Total Cross Shield Medical Single $16.30 $ 9.90 $ 1.50 $ 2.30 $30.00 Family $38.05 $28.50 $ 3.75 $ 6.85 $77.15 Ayes: Bowers, Geiger, Getty, Lichty, Roehr, and Wilharm. Dowie declined to vote by reason of possible conflict of interest under Section 362.6 of Code of Iowa. Resolution adopted and upon approval by Mayor, assigned No. 24618. 70210 - Moved by Roehr, seconded by Wilharm that communication from City Engin eer transmitting progress report from Brice, Petrides & Associates,Inc. for May, 1976 for "Hackett Road Bypass Transportation Corridor Location Study", and recommending acceptance, be received, placed on file and ac-, cepted. Motion carried. 70211 - Moved by Dowie, seconded by Bowers that minutes of Waterloo Human Rights Commission for its meeting of May 10, 1976, be received and placed on file. Motion carried. 70212 - Moved by Bowers, seconded by Roehr that communication from EEO Of- ficer, transmitting copy of Waterloo Affirmative Action Program as re- quired by Executive Order #11246, as amended, and to comply with any and all applicable Federal, State and Local rules and regulations pertaining to Equal Employment Opportunity, and recommending approval, be received, placed on file and "Resolution approving the Waterloo Affirmative Action Program, with exclusion of instructional booklet", adopted, with said instructional booklet to be changed and resubmitted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24619. 70213 - Moved by Getty, seconded by Lichty that the following Construction Per- mits from the Iowa Department of Environmental Quality, subject to cer- tain conditions and requirements, be received and placed on file: Construction Permit No. 76-490-5, Sanitary Sewer Extension, Hammond Hills 3rd Addition; Construction Permit No. 76-481-5, Sanitary Sewer Extension, Jeanie's Addition; Construction Permit No. 76-485-S, Sanitary Sewer Ex- tension, Richland Park. Motion carried. 70214 - Moved by Roehr, seconded by Wilharm that Bituminous Casualty Corporation Policy No. WC 521 669 for Workmen's Compensation and Employers' Liability for period of 7/1/76-77 for the City of Waterloo, Iowa, with invoice for premium of $60,142.00 from Waterloo Insurance Agency, be received, placed on file and "Resolution accepting Bituminous Casualty Corporation Policy June 21, 1976 - 3 70214 - (Continued) No. WC 521 669 for Workmen's Compensation and Employers' Liability and directing and authorizing the issuance of a warrant in payment for same", adopted. Ayes: Bowers, Geiger, Getty, Lichty, Roehr and Wilharm. Dowie declined to vote by reason of possible conflict of interest under Section 362.6 of Code of Iowa. Resolution adopted and upon approval by Mayor, assigned No. 24620. 70215 - City Attorney Smith asked that action be deferred on "An Ordinance re- pealing and amending parts of Chapter 34, Sewers". Moved by Wilharm, seconded by Dowie that action on the above Ordinance be deferred to June 28, 1976. Motion carried. 70216 - Jay Roberts, Atty. for area residents opposing rezone of tract of land lying west of Logan Avenue and 'south of Midwest Garden of Memories Cem- etery in part of Section 2 -89N -13W, said they were against changing from farm and residence zoning to commercial, and were very concerned about the traffic hazard. Gerold Robinson, 3565 Logan Avenue, supported the rezoning request. Mayor Rooff read the petition in support which was received and filed last week. Jay Roberts presented a petition of objection. Moved by Dowie, seconded by Bowers that the above objection petition be received and placed on file. Motion carried. 70217 - A lengthy discussion followed with area residents citing past accidents and difficulty in entering the highway at this time. Moved by Dowie, seconded by Bowers that action be deferred until June 28, 1976 for further study. Motion carried. 70218 - Moved by Getty, seconded by Bowers that "An Ordinance establishing names for streets located within mobile home parks within the City of Waterloo, Iowa", be considered and rules requiring ordinances to be voted on at two prior meetings, suspended, said Ordinance passed for first, second and third times and placed ori final adoption. Ayes: Seven. Motion carried. 70219 - Moved by Wilharm, seconded by Getty that "An Ordinance establishing names for streets located within mobile home parks within the City of Waterloo, Iowa", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2825. 70220 - Moved by Roehr, seconded by Dowie that communication from City Treasurer listing transfers to the Special Assessment Sinking Fund of any and all funds remaining in various Special Assessment Contract Funds after all interest and principal have been fully paid, be received and placed on file. Motion carried. 70221 - Moved by Roehr, seconded by Dowie that "Resolution authorizing the trans- fer of funds in the special assessment funds where no bonds were sold to the special assessment sinking funds of the City of Waterloo, Iowa", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24621. 70222 - Moved by Roehr, seconded by Getty that "Resolution authorizing the trans- fer of the funds in the special assessment sinking funds to the general fund of the City of Waterloo, Iowa", be adopted. Ayes: Seven. Resolu- tion adopted and upon approval by Mayor, assigned No. 24622. 70223 - Moved by Roehr, seconded by Dowie that communication from Community Development Administrator, transmitting a proposed resolution on Stage lA of Local Flood Protection Project, and recommending approval, be received, placed on file and "Resolution authorizing the Mayor to accept on behalf of the City of Waterloo effective July 1, 1976,the assumption of operation and maintenance responsibilities for the Flood Protection Devices constructed as Stage 1A of the Corps of Engineers Local Flood Protection Project", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24623. June 21, 1976 - 4- 70224 - 70224 - Moved by Dowie, seconded by Bowers that statement from Star Refrigeration, Inc. for parts and emergency repairs to the Air Conditioning System in City Hall, be received, placed on file and "Resolution approving the statement dated 6/16/76 from Star Refrigeration, Inc. for parts and emer- gency repairs to the Air Conditioning System in City Hall, accepting the work subject to inspectors' approval and authorizing payment in full accordingly", adopted. Ayes: Seven. Resolution adopted and upon approv- al by Mayor, assigned No. 24624. 70225 - Moved by Roehr, seconded by Geiger that the Report of the Building Of- ficial as to work performed and materials furnished by Anderson Excava- ting & Wrecking Company, Contractors, for the Demolition of 127-129 East Fourth Street, Contract No. B-36, be received, placed on file and "Resolution approving the report and authorizing payment accordingly in the sum of $16,488.75", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24625. 70226 - Moved by Dowie, seconded by Bowers that communication from City Engineer, transmitting Final Pay Estimate and Certificate of Completion and Reco- mmendation of Acceptance for Downtown Fourth Street Improvements, subject to minor items of work yet to be completed, as submitted by Brice, Pet- rides & Associates, Inc., and recommending approval and acceptance, be received, placed on file and "Resolution approving the Final Pay Estimate and the Certificate of Completion and Recommendation of Acceptance as to the work and materials furnished by Cedar Falls Construction Co., Inc. for the Downtown Fourth Street Improvements, Contract No. 152, accept- ing the work and authorizing payment in full accordingly", adopted, Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24626. 70227 Moved by Bowers, seconded by Lichty that the two statements from Wayne Claassen Engineering & Surveying, Inc. for Virden Creek Reservoir, and City Engineer's recommendation for approval, be received, placed on file and "Resolution accepting the two statements dated 3/31/76 and 6/14/76 from Wayne Claassen Engineering & Surveying, Inc. for field surveys and legal descriptions for impoundment area and dam site for proposed Corps of Engineers Virden Creek Reservoir", adopted.
