On roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr and Wilharm. Invocation by Councilman Wilharm. 70092 Moved by Roehr, seconded by Dowie that the Agenda, as amended, for the Regular Session of June 7, 1976 at 7:00 P.M., be accepted and approved. Motion carried. 70093 - Moved by Wilharm, seconded by Bowers that the Minutes of the Regular Session held May 24, 1976 at 7:00 P.M., be approved. Motion carried. 70094 - Moved by Dowie, seconded by Geiger that the proof of publication of no- tice of public hearing on plans and specifications for the Demolition and Reconstruction of Sans Souci Bridges, Westfield -Virden Urban Renew- al Project R-7, Contract No. 11, and the taking of bids for the said im- provement, be received and placed on file. Motion carried. 70095 - The Mayor called for oral and written objections and there were none. Moved by Geiger, seconded by Wilharm that "Resolution confirming the approval of the plans, specifications, etc. for the Demolition and Re- construction of Sans Souci Bridges, Westfield -Virden Urban Renewal Pro- ject R-7, Contract No. 11", be adopted. Ayes: Seven. Resolution ad- opted and upon approval by Mayor, assigned No. 24585. 70096 - Moved by Wilharm, seconded by Dowie that "Resolution ordering the Demo- lition and Reconstruction of Sans Souci Bridges, Westfield -Virden Urban Renewal Project R-7, Contract No. 11", be adopted. Resolution adopted and upon approval by Mayor, assigned No. 24586. 70097 - Moved by Getty, seconded by Lichty that proof of publication of notice to contractors or invitation for bids for the demolition and reconstruction of Sans Souci Bridges, Westfield -Virden Urban Renewal Project R-7, Bridge Contract No. 11, be received and placed on file. Moved by Bowers, seconded by Dowie that "Resolution approving and author- izing sale and conveyance of certain parcel of land in Riverview known as "Old Mill Race" in Kenwood Park Second Addition, as published in the Waterloo Courier on 5/20/76 to James L. Dixon and Betty D. Dixon for $100.00 plus costs, and directing and authorizing the Mayor and Clerk to execute and deliver a deed for said property", be adopted. Ayes: Seven. Motion carried. 70102 - The Mayor called for oral and written objections and there were none. Moved by Getty, seconded by Lichty that "Resolution approving and author- izing sale and conveyance of portion of Section 2-88-13, as published in the Waterloo Courier on 5/20/76, to Southtown Development Co. for $5,000 and costs, and directing the Mayor and Clerk to execute and deliver a deed for said property", be adopted, Ayes: Seven. Resolution a- dopted and upon approval by Mayor, assigned No. 24588. 70103 - Councilman Roehr presented a petition from Leroy G. Parker, 1464 Hunting- ton Road, et al, that the Huntington Park Addition, including 1300-1800 blocks of Huntington Road, 1200-1600 blocks of Garden Avenue, 1400-2000 blocks of Robin Road and 1300-1400 blocks of Wren Road, be included in the 1976 storm sewer and paving programs. Moved By Roehr, seconded by Wilharm that the above petition be received and placed on file. Motion carried. 70104 - City Engineer Radue stated storm sewer was presently being constructed in the Huntington Park Addition and the paving was not included in this year's program because the work could not be done until after the sewer was completed; also, there was no funding for this. Mayor Rooff said it was physically impossible to complete the sewer and paving this year. Jan McKernan, 1638 Robin Road, stated the area residents should not have to wait until 1978, the area served 1600 children at Central High and Black Hawk School and they were concerned about their welfare as gravel trucks speeded on the area streets. A discussion followed on block grant money, which would not be forthcoming until June, 1977. Moved by Wilharm, seconded by Roehr that the oral presentation of Jan McKernan be received and placed on file. Motion carried. 70105 Nancy Parker, 1464 Huntington Road, supported immediate paving of Huntington Road. Ron Bromley, 1409 Garden Avenue, asked the paving not be delayed. Unused rehabilitation grant and loan money was • discussed. Mayor Rooff felt the finances could be worked out and urged the project be given consideration. Moved by Getty, seconded by Roehr that Huntington Park Addition be ordered included in the Fiscal 1977 Paving Program. Motion and second withdrawn. Mayor Rooff proposed a separate package be made for the project as inclusion in the present program would cause a month's delay in the entire program. Moved by Getty, seconded by Roehr that Huntington Park Addition be set up as Paving Program No. 2 in the Fiscal 1977 Paving Program. Ayes: Seven. Motion carried. 70106 - Donna Stephens asked if, prior to the Council meeting, sufficient in- formation had been given by Mayor Rooff to Councilman Getty to sub- stantiate the charges against the Brown Owl. A discussion followed on outside happenings, Mayor Rooff conceding 10 police calls due to faulty alarm system, leaving 56 calls, and the appeal to the State Board, which the Mayor planned to attend. 70107 - Councilman Getty inquired about the closing of Cedar Bend road and was told this was a haul route and would be closed about a week. 70108 - Nancy Parker, 1464 Huntington Road, asked that parking be allowed on one side of Huntington Road and Mayor Rooff said this would be taken up with the Sign and Traffic Department. 70109 - City Engineer Radue reminded he submitted the proposed sidewalk program for comment two weeks ago and he would bring it in next week for action. June 7, 1976 - 3 - 70110 - There was a lengthy discussion on criterion and formula used in figur- ing minimum rent per month for the West Ridgeway Avenue Housing for Elderly, minimum income requirement being too high for the very poor, subsidy, etc.. Councilman Wilharm reaffirmed his stand that government should stay out of low income housing, rents, etc. and should concern itself with sewers, paving, etc.. Mayor Rooff reported the elderly people can't cross at Ridgeway Avenue and Kimball Avenue as the walk light didn't allow sufficient time. Moved by Wilharm, seconded by Dowie that "No Right Turn on Red" sign be installed at the corner of Ridgeway Avenue and Kimball Avenue. Motion carried. 70111 - Moved by Roehr, seconded by Dowie that request of Roger C. Neebel Const., Inc. for permission to construct one 24° commercial curb cut at 1139 Langley Road, as shown on attached plat, and City Engineer's recoum°enda- tion for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in ac- cordance therewith. Motion carried. 70112 - Moved by Dowie, seconded by Bowers that request of W. W. Sindlinger, Atty. for Midway Development Corporation and the Sirloin Stockade, for permis- sion to construct two 24' commercial curb cuts on Midway Drive, south of University Avenue, as per attached plat, and City Engineer's recom- mendation for approval subject to the provisions of his letter, be rec- eived, placed on file, recommendations approved and permission granted in accordance therewith. Weichman for permission to construct a temporary asphalt driveway at 2901 Ans- borough Avenue without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Gary W. Weichman and authorizing construction of a temporary asphalt driveway at 2901 Ans- borough Avenue irrespective of a later official grade", adopted. Ayes: Seven. Resolution adopted and upon approval of Mayor, assigned No. 24589. 70114 - Moved by Bowers, seconded by Getty that request from Christ Lutheran Church for permission to construct a temporary concrete driveway at 234 South Hackett Road without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recommendation for ap- proval subject to the provisions of his letter, be received, placed on file, approved and "Resolution granting permission to Chirst Lutheran Church and authorizing construction of a temporary concrete driveway at 234 South Hackett Road irrespective of a later official grade", a- dopted. Ayes: Seven. Resolution adopted and upon approval of Mayor, assigned No. 24590. 70115 - Moved by Bowers, seconded by Getty that request from Richard L. June 7, 1976 - 4 - 70117 - Under Council Action #70039 of 5/24/76, action was deferred on approving the Unified Work Program/Overall Program Design of the Iowa Northland Regional Council of Governments. Moved by Roehr, seconded by Bowers that "Resolution approving the Unified Work Program/Overall Program Design of the Iowa Northland Regional Council of Governments", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24592. 70118 - Under Council Action #70038 of 5/24/76 action was deferred on approving Three -Year Street Construction Program for Fiscal Years 1977-1978-1979 as prepared by the Department of Engineering to be submitted to the Iowa Department of Transportation. Moved by Dowie, seconded by Bowers that "Resolution approving a Three - Year Street Construction Program for Fiscal 1977 through Fiscal 1979, both inclusive, and the Street Systems Map for the City of Waterloo, Iowa, to the Iowa Department of Transportation", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24593. 70119 - Under Council Action #70022 of 5/24/76 action was deferred on the Peti- tion from Norma Phillips requesting suspension of all taxes against 120 Smith Street, now and hereafter so long as she remains the owner. Moved by Bowers, seconded by Dowie that the above Petition from Norma Phillips, be approved and "Resolution recommending to the Board of Supervisors of Black Hawk County the suspension of all taxes, now and hereafter, on 120 Smith Street, as long as. Norma Phillips remains the owner", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24594. 70120 - Moved by Roehr, seconded by Getty that construction plans and specifica- tions for the sanitary sewer, stoic sewer, paving and greenway facilit- ies for Southland Park Subdivision (Stage I) together with Treatment Agreement Form C 9/75 for the Dept. of Environmental Quality, and City Engineer's recommendation for approval with final acceptance of plans to be reviewed and accepted by said Department, be received, placed on file, recommendations approved and Mayor and Clerk authorized to execute said Agreement Form. Motion carried. 70121 - Moved by Getty, seconded by Roehr that construction plans for sanitary sewerage facilities for Southdale Addition, together with Treatment Agreement Form C 9/75 for Dept. of Environmental Quality, and City Engin- eer's recommendation for approval with final acceptance of plans to be reviewed and accepted by said Department, be received, placed on file, recommendations approved and Mayor and Clerk authorized to execute said Agreement Form. Motion carried. 70122 - Moved by Getty, seconded by Lichty that construction plans for storm sewer and paving facilities for Prairie Meadow West Third Addition, and City Engineer's recommendation for approval with requirement that the storm sewer outlet on Olympic Drive be modified and approved by his department at a later date, be received, placed on file, recommendations approved, and construction plans approved in accordance therewith. Motion carried. 70123 - Moved by Roehr, seconded by Wilharm that coimiunication from City Attorney, transmitting Decision of Departmental Hearing Board of the Iowa Beer and Liquor Control Department granting Class "B" Beer Permit to Pocket Billiard Lounge, Inc., 3295 University Avenue, and reporting the City has the right to appeal this Decision to the Black Hawk County District Court within the 30 -day period following 5/28/76, be received, placed on file, appeal of Decision to Black Hawk County District Court ap- proved and the City Attorney instructed to proceed accordingly.,Ayes: Bowers, Geiger, Roehr and Wilharm. Motion carried. 70126 - Moved by Dowie, seconded by Bowers that communication from City Engin- eer, transmitting construction guarantees from Fuller Roofs, Inc., T.C. Motion carried. 70136 - Moved by Roehr, seconded by Bowers that communication from Housing and Rehabilitation Administrator, transmitting a proposed resolution au- thorizing Gene Meeker and John White to sign warrants and financial reports on behalf of the Public Housing Authority in connection with the Chamber of Commerce management of the City's housing programs, with bills to be .submitted to City Finance Committee for approval and actual checks to be written by City Treasurer, be received, placed on file, and approved, "Resolution designating authority to sign warrants and financial reports for the Public Housing Authority, City of Waterloo", adopted. Resolution adopted and upon approval by Mayor, assigned No. 24596. 70137 - Moved by Roehr, seconded by Wilharm that communication from City Plan and Program Commission proposing the City Council adopt a policy stating that the proposed Hackett Road Bypass will not be named Hackett Road Bypass, Hackett Road or some name similar to Hackett Road, to eliminate the need to rename a portion of South Hackett Road between Lots 11, 12 and 13, Downing Heights Addition, be received, placed on file, approved, Council Action #70021 of 5/24/76 recinded, and "Resolution adopting a policy that the proposed Hackett Road Bypass not be named as such or any similar name", adopted.
