The Council of City of Waterloo, Iowa, met in Regular Session in Council Chambers
in City Hall at 7:00 P.M. on July 6, 1976. Mayor Rooff in the Chair. On roll
call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr and Wilharm. Invoca-
tion by Councilman Getty.
70286 - Moved by Roehr, seconded by Bowers that the Agenda, as amended, for the
Regular Session of July 6, 1976 at 7:00 P.M., be accepted and approved.
Motion carried.
70287 - Moved by Geiger, seconded by Dowie that the Minutes of the Regular Ses-
sion held June 28, 1976 at 7:00 P.M., be approved. Motion carried.
70288 - Mayor Rooff welcomed twelve students from France, and presented to each
one a letter making him or her an honorary citizen of the City of Water-
loo, Iowa. Jacqueline Soliveau, Chaperone, introduced the students.
The students presented to Marvin Haugebak, Chairman of Black Hawk County
Bicentennial Committee, the French Tri -Color Flag, and he, in turn, pre-
sented the Flag to Mayor Rooff, who thanked the students. Imre Takacs,
President of International Student Exchange of Black Hawk County, Inc.
expressed gratitude to the host families who opened up their homes to
the students and stated he was very proud of Iowa. Marvin Haugebak
distributed to each student, the Mayor and Council Members, a copy of
the Bicentennial Times and thanked the Mayor and Council for the courtes-
ies extended.
Moved by Wilharm, seconded by Lichty that the above event and visit of
the students from France be recorded and thanks given to the host fam-
ilies. Motion carried.
70289 - Mayor Rooff briefly reported on the flood control project, stating the
Corps of Engineers was proposing the City purchase a number of acres of
land to build a dam, which the area residents opposed and the farmers
were against.
Robert B. Scism, Atty. for owners of properties proposed to be taken for
the Virden Creek Dam project, stated he reviewed design memorandum #2
of the Corps the environmental impact statement and updated himself on
the court decisions, and asked reconsideration of the project as the
Corps had never presented the City with (1) alternatives, (2) full cost
financial analysis, and (3) environmental impact statement. He expressed
concern that an estimated 1,000 acres of farmland would be taken out of
production and loss of crops. Mayor Rooff responded that he proposed the
project be rebuilt on the original site but was told by the Corps (1)
there wasn't enough room to build spillways, etc. and (2) when the Cedar
overflowed, the water had to be put somewhere, until it could be run in-
to the river. On the environmental aspect, he was not surprised that
the federal agencies had not gotten together. Mr. Scism offered his help
if the Council was inclined to review the project. Mayor Rooff stated
he was not in favor of the proposed site but the Council would have to
take the position of continuing to meet with the Corps; also, he would
write the Corps as the City didn't want to take farmland or crops, but
the loss of life must be taken into consideration.
Moved by Bowers, seconded by Dowie that the above presentation be re-
ceived and placed on file. Motion carried.
70290 - Councilman Getty presented two petitions from Greenbrier Road and Oak-
wood Drive residents objecting to sidewalks, and requested said side-
walks be removed from the sidewalk program at this time.
Moved by Getty, seconded by Lichty that the above two petitions be re-
ceived and placed on file. Motion carried.
70291 - A discussion followed and Mayor Rooff stated the proposed sidewalk pro-
gram with dollar amounts would be brought to the council on July 19th
and the streets could be removed at that time. Bonnie Pauling asked
for stop signs instead of sidewalks and Mayor Rooff reported the Sign
and Traffic Department would report to the council next week.
70292 - Mayor Rooff reported the City of Cedar Falls adopted an ordinance allow-
ing Waterloo taxicabs to operate in Cedar Falls without city license if
Waterloo extended the same privilege to Cedar Falls taxicabs. A discus-
sion followed.
Moved by Wilharm, seconded by Roehr that the Council not consider the
above any further. Motion carried.

70293 - Councilman Getty inquired about stoLui sewer installation to carry water
out of parking lot and was infoiwed this was not a new building and the
owner was only trying to satisfy the ordinance to dust proof.
Moved by Geiger. seconded by Bowers that communication from City Engin-
eer, transmitting a request from Warren Transport, Inc. for permission
to blacktop the parking area in the 300 block of Vaughn Street for dust
control purposes, and recommending approval, be received, placed on file
and approved at no cost to the City. Motion carried.

70295 - Moved by Dowie, seconded by Bowers that proposed Engineering Services
Contract dated 7/6/76 for a cost not to exceed $13,640, and recommending
approval and authorization to proceed immediately, be received, placed
on file, recommendations approved and "Resolution approving the Engin-
eering Services Contract with Brice, Petrides & Associates, Inc. for
Delane Avenue Flood Control Study and directing execution of same by
Mayor and Clerk", adopted. Ayes: Seven. Resolution adopted and upon
approval by Mayor, assigned No. 24645.
70296 - Moved by Roehr, seconded by Getty that Change Order No. 5 for a time
extension to September 30, 1976 for River Road, Stage II, Contract No.
150, Irving F. Jensen Co., Inc., Sioux City, Iowa, Contractors, and
Community Development Administrator's recommendation for approval, be
received, placed on file, approved and Mayor and Clerk authorized to
execute same. Ayes: Seven. Motion carried.
70297 - Moved by Getty, seconded by Lichty that the revised AffiLnative Action
Program, be received, placed on file and action deferred until July 12,
1976. Motion carried.
70298 - Moved by Roehr, seconded by Getty that construction plans for sanitary
sewerage facilities serving MPH, INC. APARTMENTS, together with Treat-
ment Agreement Form C 9/75 for Department of Environmental Quality, and
City Engineer's recommendation for approval with final acceptance of
plans to be reviewed and accepted by said Department, be received, placed
on file, recommendations approved and Mayor and Clerk authorized to
execute said Agreement Fotm. Motion carried.
70299 - Councilman Roehr questioned if changes could be made at any time and
was told they could as long as they stayed within the program.
Moved by Roehr, seconded by Dowie that couwmnication from Plan and Pro-
gram Commission, transmitting 1976-1981 Capital Improvements Program for
review and approval, be received, placed on file, and approved. Motion
carried.
70300 - Moved by Dowie, seconded by Bowers that the following Construction Petuiits
from the Iowa Department of Environmental Quality, subject to certain
conditions and requirements, be received and placed on file:
Construction Permit No. 76-503-S for Sanitary Sewer Extension, Prairie
Meadow West 3rd Addition; Construction Permit No. 76-505-S for Sanitary
Sewer Extenstion, Ridgeway Office Center.

70301 - Moved by Bowers, seconded by Roehr that couuuunication from Community
Development Administrator, transmitting the following offers of sale to

70302 - Moved by Roehr, seconded by Getty that "An Ordinance amending Ordinance
No. 2723, an Ordinance providing that general property taxes levied and
collected each year on all real property located within the Downtown
Waterloo Urban Renewal and Redevelopment Project area in the City of
Waterloo, County of Black Hawk, State of Iowa, by and for the benefit of
the State of Iowa, City of Waterloo, County of Black Hawk, Waterloo Com-
munity School District, and other taxing districts, be paid to a special
fund for payment of principal and interest on loans, monies advanced to
and indebtedness, including bonds issued or to be issued, incurred by
said City in connection with said Urban Renewal and Redevelopment Project,
to clarify actual value of $15,132,279 as the same taxing figure as
former "ASSESSED VALUE" of $4,428,951 by adding Subsection (a) to Section
2", be considered and rules requiring ordinances to be voted on at two
prior meetings, suspended, said Ordinance passed for first, second and
third times and placed on final adoption. Ayes: Seven. Motion carried.
70303 - Moved by Getty, seconded by Bowers that "An Ordinance amending Ordinance

enacting in lieu thereof new Subsection (a), COMPOSITION", be considered
and rules requiring ordinances to be voted on at two prior meetings,
suspended, said Ordinance passed for first, second and third times and
placed on final adoption. Ayes: Seven. Motion carried.
70305 - Moved by Roehr, seconded by Lichty that "An Ordinance amending Section
29-14, Plan and Program Commission rules generally, of Code of Ordinances,
City of Waterloo, Iowa, by repealing Subsection (a), COMPOSITION, and
enacting in lieu thereof new Subsection (a) COMPOSITION", be adopted.
Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned
No. 2828.
70306 - Councilman Getty noted for public information that the City Council
would not receive a wage increase.
Moved by Getty, seconded by Lichty that "Resolution fixing the compensa-
tion of the City Officials and Employees in the City of Waterloo, Iowa",
be adopted. Ayes: Seven. Resolution adopted and upon approval by
Mayor, assigned No. 24647.
'0307 - Moved by Roehr, seconded by Dowie that communication from City Engineer,
reporting Faye Martin Anderson and Dr. Robert E. Morrison have requested
sanitary sewer service for 5643 and 5640 Kimball Avenue under Waiver of
Assessment, and recommending approval, be received, placed on file, rec-
ommendations approved and City Engineer instructed to proceed according-
ly upon execution of Waiver of Assessments with cost to be assessed in
the same manner as Orange Township Assessment District. Motion carried.
0308 - Moved by Dowie, seconded by Lichty that communication from McElroy Aud-
itorium reporting retirement of Paul L. George as of 6/30/76 and is en-
titled to 51 hours sick leave pay, be received, placed on file and
"Resolution approving payment of $323.34 accumulated sick leave to Paul
L. George, retiree of McElroy Auditorium", adopted. Ayes: Seven. "Res-
olution adopted and upon approval by Mayor, assigned No. 24648.
70309 Moved by Geiger, seconded by Bowers that the following applications and

file, approved and licenses granted subject to the requirements of ordin-
