The Council of City of Waterloo, Iowa, met in Special Session in the Council
Chambers in City Hall at 8:00 A.M. on August 5, 1976, pursuant to the following
call:
TO: CITY COUNCILMEN OF THE CITY OF WATERLOO, IOWA:
You are hereby notified that a Special Meeting of the City Council of the City
of Waterloo, Iowa, will be held at the Council Chambers in the City Hall in
the City of Waterloo, Iowa at 8:00 A.M. on Thursday, August 5, 1976 and that
said Special Meeting is being called for the purpose of considering the granting
of a Class B Beer Permit to Robert A. Wolfe dba Happy Joe's Ice Cream & Pizza
Parlour, 3362 University Avenue (Renewal) which expired August 1, 1976.
You are further notified that no other business except the above will be trans-
mitted at said Meeting.

The Council of City of Waterloo, Iowa, met in Regular Session in Council Chambers
in City Hall at 7:00 P.M., on August 2, 1976. Mayor Rooff in the Chair. On
roll call, Present: Bowers, Dowie, Geiger, Getty, Lichty, Roehr and Wilha .
Absent: None. Invocation by Councilman Geiger.
70464 - Moved by Roehr, seconded by Bowers that the Agenda, as amended, for
the Regular Session of August 2, 1976 at 7:00 P.M., be accepted and
approved. Motion carried.
70465 - Moved by Wilharm, seconded by Roehr that the Minutes of the Regular
Session held July 26, 1976 at 7:00 P.M., be approved. Motion carried.
70466 - Moved by Lichty, seconded by Geiger that communication from City At-
torney, submitting the name of Robert C. Griffin for appointment as
Assistant City Attorney, effective August 2, 1976, be received, placed
on file and approved. Motion carried.
70467 - Councilman Roehr presented a petition from property owners in the areas
of Acorn Lane, Woodcrest Drive, Midway Drive, Loma Street and Progress
Street objecting to rezoning of Lots W-1 and W-2, Cedarloo Park from
R-1 One and Two Family Residence District to C-2 Commercial District.
Moved by Roehr, seconded by Dowie that the above petition be received
and placed on file. Motion carried.
70468 - Councilman Bowers presented a request from Highland Neighborhood, Inc.
that the City of Waterloo assume responsibility for the lighted brick
and concrete pillars at the intersection of Independence Avenue and
Highland Boulevard, basically the electrical work.
Moved by Bowers, seconded by Wilharm that the above request be received,
placed on file and referred to the City Electrician with a report back.
Motion carried.
70469 - Walter Clark, 1401 Mulberry Street, reported the City sweeper was
knocking out the curbing on Mulberry and Lafayette Streets. This was
referred to the Supt. of Streets.
70470 - Charles Dykeman presented the endorsement of the Board of Directors of
the Waterloo Kiwanis Club for the Black Hawk Creek Greenbelt to be re-
named the "Leonard Katoski Greenbelt" to show the community's gratitude
for a job well done in the park system.
Moved by Wilharm, seconded by Lichty that the above endorsement be re-
ceived and placed on file, Motion carried.
70471 - Moved by Getty, seconded by Lichty that "Resolution recommending and
urging the Waterloo Park Coumiission to rename the Black Hawk Greenbelt
the "Leonard Katoski Greenbelt", be adopted. Ayes: Seven. Resolution
adopted and upon approval by Mayor, assigned No. 24700,
70472 - Moved by Bowers, seconded by Getty that communication from City Engineer,
transmitting a petition from Frank Richard, Jr., 535 Warren Drive, et al,
for paving of Warren Drive from North Barclay Street to Charles Street,
representing 587 of property owners, and recommending consideration for
a future paving program, be received, placed on file and recommendations
approved and City Engineer instructed to proceed accordingly. Motion
carried.
70473 - Moved by Bowers, seconded by Dowie that communication from City Engineer,
transmitting a petition from Rubin Fisher, 1048 Cottage Street, et al,
representing 16Z% of property owners, for paving of 1600, 1700 and 1800
blocks of Linden Avenue, and recommending consideration for a future
paving program, be received, placed on file, recommendations approved
and City Engineer instructed to proceed accordingly. Motion carried.
70474 - James Dunbar, Atty. for objectors to rezoning of Lots W-1 and W-2, Cedar -
loo Park, from R-1 to C-2, stated that after a public hearing the Zoning
Commission recommended denial and urged the Council to respect this rec-
ommendation. There was a lengthy discussion on the C-2 being rezoned to
R-1 to establish a 140' buffer strip between the commercial and resi-
dental areas. Kjas Long, Atty. for Mrs. Jessen, stated she was not
planning anything drastically different for use of the land, but as a
matter of principal wanted it zoned C-2 as it was at the time she pur-
chased it, and requested a public hearing. Bob Sachau, 464 Woodcrest

Drive, strenuously objected to the rezone, and was supported by Martin
Nordman, 464 Loma Street, Neil Miller, 433 Loma Street, Chip Decker,
473 Woodcrest Drive, and others. Attorney Dunbar responded she now
had non -conforming use privilege, and she had waived her right to pro-
test at time of hearing of R-1 rezoning.
Moved by Roehr, seconded by Dowie that request of Kjas Long, Atty. for
Mr. and Mrs. Otto Jessen for the Council on its own motion to rezone
from "R-1" One and Two Family Residence District to "C-2" Commercial
District, Lot W-1, except the N 30' and Lot W-2, Cedarloo Park, on SE
corner of Midway Drive and Acorn Lane, as shown on attached plat, and
City Zoning Couuuission's report of objectors and recommendation for
denial, be received, placed on file, and request denied.
Ayes: Dowie, Geiger, Roehr and Wilharm. Nays: Bowers, Getty and
Lichty. Motion carried.
70475 - Moved by Geiger, seconded by Wilharm that request from Elaine E. Driver,
for permission to construct a temporary 30' asphalt driveway at 1008,
1014 and 1024 Leavitt Street without regard to sidewalk grade, together
with $3.00 for recording waiver, and City Engineer's recommendation
for approval subject to the provisions of his letter, be received,
placed on file, approved and "Resolution granting permission to Elaine
E. Driver and authorizing construction of a temporary asphalt driveway
at 1008, 1014 and 1024 Leavitt Street irrespective of a later official
grade", adopted. Ayes: Seven. Resolution adopted and upon approval
by Mayor, assigned No. 24701.
70476 - Moved by Roehr, seconded by Wilharm that Investment Report for 7/1/75-
6/30/76 to State of Iowa, prepared by City Treasurer, be received and
placed on file. Motion carried.
70477 - Councilman Geiger reported the Jefferson and Commercial Street area
residents requested (1) stop signs at corners of Commercial and 15th
Streets and at Jefferson and 14th Streets, (2) "Caution Children Playing"
signs at Commercial and Jefferson Streets (3) increased supervision
between llth and 18th Streets, especially between 11:00 A.M. and 2:00
A.M., and (4) one side parking on all side streets between Commercial
and Jefferson Streets, especially 12th and 13th Streets.
Moved by Geiger, seconded by Roehr that the above request be received
and placed on file. Motion carried.
70478 - Mayor Rooff reported the Police Department has increased its surveil-
lance of speeders and restricted on -street parking, 39 tickets were
issued on Saturday and Sunday, and extra surveillance would be contin-
ued here and in all parts of the City.
Quintin Parker, Sign and Traffic Department, reported the Iowa Depart-
ment of Transportation, has full authority over any signs placed in
a city whether it is a State highway or a residential street, and have
a uniform traffic control manual on traffic control devices for streets
and highways which all cities must conform with; the manual specifies
that stop signs should never be used to control speed, this must be
done by enforcement, also there should be a minimum of 750 vehicles
per hour from the major street and a minimum of 250 vehicles per hour
from the minor street per hour in an eight hour day, and, there should
be very poor sight distance. He stated "Children at Play" sign use
was prohibited; a survey of the area was made and stop signs were not
justifiable. He recommended law enforcement and education and re-
moving street parking on one side of several of the streets in the area;
and stated the Mayor and Council do not have the authority to authorize
signs which do not meet federal requirements.
Teresa Fields, 1711 Commercial Street, thanked the City officials for
enforcement of speed laws and suggested a neighborhood park and Mayor
Rooff said after the dike was built there should be some land and this
would be discussed with the Park Comuission; also, he suggested the
area residents contact the neighborhood businesses as he felt they
would cooperate if they knew the problems existed. The Mayor said their
request for streets to be swept more oftener would be referred to the
Street Superintendent,

Moved by Wilharm, seconded by Roehr that report of Quintin Parker,
Sign and Traffic Department on requests of residents of Jefferson
Street and Commercial Street area for traffic control devices, be
received, placed on file, and approved. Motion carried.
70479 - Under Council Action #70413 of 7/26/76 a petition from Gary C. and
Judy G. Hughes, 216 Glen Avenue, et al, requesting the 200 block of
Glen Avenue remain and be kept intact as an access for the residents
of 210-212-216 Glen Avenue and 1506 Riehl Street and retain the name
of Glen Avenue, was referred to the City Engineer.
City Engineer Radue reported the existing situation was Glen Avenue
ran from Conger Street to Norwood Street and Riverside Drive was torn
up. His recommendations were (1) Vacated Riverside Drive and Glen Ave-
nue be rededicated as Riverside Drive from Norwood Street to Riehl
Street, (2) On vacated Glen Avenue between Norwood Street and Riehl
Street, allow parking with two new drive entrances onto relocated
Riverside Drive, and Community Development Administrator Mercer to
require written agreement by property owners along vacated Glen Avenue
to acquire vacated Gien Avenue for parking purposes, and (3) Houses
on vacated Glen Avenue be readdressed on relocated Riverside Drive.

oral report with recommendations, be received, placed on file, the
pavement on vacated Glen Avenue retained, Community Development Admin-
istrator to obtain agreements from vacated Gien Avenue property owners
agreeing to purchase said excessive City property and to maintain same,
said Glen Avenue be renamed Riverside Drive and the houses thereon re-
addressed on Riverside Drive. Motion carried.
70480 - Moved by Dowie, seconded by Bowers that communication from City Engin-
eer, transmitting Municipal Agreement No. 76-F-069, allowing reimburse-
ment to City up to 707 of the eligible costs for West Ridgeway Avenue
Improvements, and recommending approval, be received, placed on file,
and "Resolution approving Municipal Agreement No. 76-F-069 with Depart-
ment of Transportation for Federal Aid Urban System Project for West
Ridgeway Avenue Improvements and authorizing the Mayor and Clerk to
execute same", adopted. Ayes: Seven. Resolution adopted and upon ap-
proval by Mayor, assigned No. 24702.
70481 - Moved by Roehr, seconded by Lichty that construction plans for storm
sewer and concrete paving in South Ridge Terrace Addition submitted by
Schenk Engineering Company and City Engineer's recommendation for ap-
proval, be received, placed on file and approved. Motion carried.
70482 - Moved by Dowie, seconded by Bowers that construction permit No. 76-549-S
for sanitary sewer extension for Southland Park Subdivision, Stage I
from Iowa Department of Environmental Quality, subject to certain con-
ditions and requirements, be received and placed on file. Motion car-
ried.
70483 - Moved by Roehr, seconded by Getty that Contract, Bond and Certificate
of Insurance for Contract No. 158 in the amount of $706,938,88, be re-
ceived, placed on file, approved and "Resolution approving the Contract
and Bond of Cedar Falls Construction Co., Inc. for Falls Avenue Area,
Phase II, Westfield -Virden Urban Renewal Project R-7, Contract No. 158",
adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor,
assigned No. 24703.
70484 - Moved by Getty, seconded by Lichty that "An Ordinance amending Ordin-
ance No. 2644, known as the Traffic Ordinance, by repealing Subsection
(8) Greenbrier and Oakwood Drive of Section 568, School Stop Signs,
and enacting new Subsection (27) Greenbrier Road and Oakwood Drive
under Section 544, Four -Way Stop Intersections", be considered and rules
requiring ordinances to be voted on at two prior meetings, suspended,
and said Ordinance passed for the second and third times and placed on
final adoption. Ayes: Seven. Motion carried.

ance No. 2644, known as the Traffic Ordinance by repealing Subsection
(40) Beech Street, of Section 545, Yield Streets, in its entirety, and
by adding new Subsection (7a) Beech Street, to Section 543, Thru Streets",
be considered and rules requiring ordinances to be voted on at two
prior meetings, suspended, and said Ordinance passed for the second
and third times and placed on final adoption. Ayes: Seven. Motion
carried.
70487 - Moved by Bowers, seconded by Lichty that "An Ordinance amending Ordin-
ance No. 2644, known as the Traffic Ordinance by repealing Subsection
(40) Beech Street, of Section 545, Yield Streets, in its entirety, and
by adding new Subsection (7a) Beech Street, to Section 543, Thru Streets",

70488 - Moved by Geiger, seconded by Lichty that communication from Fire Chief,
reporting retirement of Clark L. Brollier as of 7/31/76 and entitlement
to 486 hours sick leave and five weeks vacation pay, be received,
placed on file and "Resolution approving payment of $5,098.28 sick
leave and vacation pay to Clark L. Brollier, retiree of Fire Department",
adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor,
assigned No. 24704.

requesting Council approval of the following three appointments to the
Waterloo Fire Department, effective August 9, 1976, be received, placed
on file and appointments approved subject to passing physical examina-
tion: Richard A. Ingersoll, Richard A. Riker, Roger P. Wroten. Motion
carried.

permission to attend function, with expenses allowed not to exceed
amounts shown, be received, placed on file and approved: Supt. of Sewers

submitting for Council approval the appointment of Curt Parsons as
Building Official, effective August 2, 1976, at a salary of $16,000
