October 25, 1976 Waterloo, Iowa, met in Regular Session in Council Cham - 00 P.M..on October 25, 1976. Mayor Rooff in the Chair. Bowers, Dowie, Geiger, Getty, Lichty, Roehr, and Wil - Invocation by Councilman Getty. 70925 - Moved by Roehr, seconded by Lichty that the Agenda, as amended, for the Regular Session of October 25, 1976 at 7:00 P.M., be accepted and approved. Motion carried. 70926 - Moved by Dowie, seconded by Bowers that the Minutes of the Regular Session held October 18, 1976 at 7:00 P.M. be approved. Motion carried. 70927 - Moved by Roehr, seconded by Wilharm that Return of Service from the Black Hawk County Sheriff certifying a legal notice was served on William John Day, Licensee, setting Monday, October 25, 1976 at 7:00 P.M. in Council Chambers in City Hall, Waterloo, Iowa, as time and place of Council public hearing on matter of suspension and revocation of his Class C Beer and Liquor License for The Body Shop at 714 Syca- more Street, be received and placed on file. Motion carried. 70928 - The Mayor announced the time had arrived for the public hearing to determine whether the Class C Beer and Liquor License of William John Day dba The Body Shop, 714 Sycamore Street, should be suspended or revoked because of complaints, etc. The Clerk reported the following written complaints: 1. Waterloo Fish Co., 721 Sycamore Street 2. Cedar Book Store, 614 Sycamore Street 3. Short's Travel Service Inc., Fifth and Sycamore Streets 4. Jane's Flowers and Gifts, 521 Lafayette Street 5. Arthur Murray Studio, 316 West 4th. Street Oral complaints were made by: 1. Don Stephens, President of Downtown Council 2. Curt Glessner, Glessner Jewelry, 204 East 4th Street Speaking in support of Licensee were: 1. William John Day, Licensee 2. Benjamin Crawford City Attorney Smith reported 61 police calls in one six arrests. Moved by Wilharm, seconded by Lichty that the above complaints and support, be received and placed on file. Motion carried. 70929 - Moved by Wilharm, seconded by Lichty that "Resolution revoking the Class "C" Beer and Liquor License No. 7637 held by William John Day dba The Body Shop, 714 Sycamore Street", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24830. year and on 9/25/76 70930 - Refund of license fee was discussed and it was Moved by Wilharm, seconded by Bowers that the City Clerk be instructed to contact the Iowa Beer and Liquor Control Department to support William John Day's request for license fee refund. Motion carried. 70931 - Gladys Sharar, 1005 Wilbur Street, presented a petition for four cross walk signals at intersection of Falls and Ansborough Avenues on all four corners, Carol Adams, 1214 Janney Avenue, spoke in support, stating a letter had been mailed to the Mayor's Safety Com- mittee. Moved by Roehr, seconded by Wilharm that the above petition be received, placed on file and referred to Sign and Traffic Maintenance Depart- ment. Motion carried. - 2 - 70932 - Mayor Rooff recognized several observers of the Junior League. 70933 - Fred Sharar, 1214 Janney Avenue, reported that Burdette Buick were parking cars in front of their place hindering passage. Mayor Rooff said he would have this checked. 70934 - Mayor Rooff reported (1) receipt of a letter from the Cedar Falls Recreation Center that Waterloo people were using its recreational facilities; (2) that many Cedar Falls people use Waterloo's facilit- ies, (3) that he would deal with this in his own way. 70935 - Moved by Roehr, seconded by Getty that request of John and Jean Merrick, 103 Chicago Street, for vacation, sale and conveyance of all of Pett Street located North of Lot 1 and all of the North-South alley lying adjacent to Lot 1 and the North 20 feet of Lot 2, all in Block 3, Prospect Heights Addition, for $232.50 plus costs, and Plan and Program Commission's recommendation for approval of vacation of All of Pett Street not now vacated and the North 62.5 feet of the North-South alley in Block 3, Prospect Heights Addition, and the sale of All that part of Pett Street lying East of the East line of Chica- go Street and West of the West line of Lot 27 extended; and the North 62.5 feet of the North-South alley all in Block 3, Prospect Heights Addition, subject to retention of utility easement over all of vacated Pett Street, be received, placed on file and "Resolution fixing the time and place of hearing as November 15, 1976 on proposal to vacate, sell and convey certain real property to John and Jean Merrick for $232.50 plus costs", adopted and Clerk instructed to publish notice of hearing. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24831. 70936 - Moved by Dowie, seconded by Bowers that couuuunication from City At- torney, transmitting an Amendment to Contract For The Sale of Land with the United States Postal Service extending the closing to 11/15/76, be received, placed on file, approved and Mayor and Clerk authorized to execute same. Motion carried. 70937 - Moved by Roehr, seconded by Dowie that communication from Community Development Administrator, transmitting Temporary Construction Ease- ment Agreement with Iowa Public Service Company in connection with Stage 5B of Local Flood Control Project, and requesting approval, be received, placed on file, and "A resolution authorizing the execu- tion of an Easement Agreement with the Iowa Public Service Company in connection with the Local Flood Control Project", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24832. 70938 - Moved by Roehr, seconded by Lichty that counuunication from Community Development Administrator, transmitting Temporary Construction Ease- ment Agreement with National Bank of Waterloo in connection with Stage 5B of Local Flood Control Project, and requesting approval, be received, placed on file, and "A resolution authorizing the execution of an Ease- ment Agreement with the National Bank of Waterloo in connection with the Local Flood Control Project", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24833. 70939 - Moved by Bowers, seconded by Wilharm that construction plans for the stoic, sewer and concrete paving facilities serving Bronson Addition, Phase I, and City Engineer's recommendation for approval, be received, placed on file and approved. Motion carried. 70940 - Moved by Wilhatm, seconded by Roehr that Final Plat of Richland Park, with Engineer's Certificate of Survey, Deed of Dedication, Contract and Waivers, Report of City Engineer, City Plan and Program Commission's resolution of approval and recommendation for Council approval, be received, placed on file and "A resolution approving the Final Plat of Richland Park in Waterloo, Iowa", adopted. Ayes: Seven. Resolu- tion adopted and upon approval by Mayor, assigned No. 24834. October 25, 1976 - 3 - 70941 - Moved by Dowie, seconded by Bowers that Quit Claim Deed dated 10/8/76 from Campbell Homes, Inc. and Winchester Faims, Inc., with City Plan and Program Commission's recommendation for acceptance for extension of Flammang Drive from Hammond Avenue to the Eastern line of the Richland Park Subdivision, be received, placed on file and "Resolution approving and accepting a Quit Claim Deed from Campbell Homes, Inc. and Winchester Farms, Inc. conveying unto the City of Waterloo real property in part of Section 2 -88N -13W and directing the recording of same", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24835. 70942 - Moved by Roehr, seconded by Dowie that communication from City Plan and Program Commission, transmitting site development plan for United States Postal Service General Mail Facility in parts of BLock 6 and Block 7, Original Plat of Waterloo East, and recommending approval, and on Council's own motion, be received, placed on file, approved and date of hearing set as November 15, 1976 at 7:00 P.M. in City Hall and Clerk instructed to publish notice. Motion carried. 70943 - Moved by Wilharm, seconded by Roehr that Preliminary Plat of South- land Park Replat of part of Southland Park Subdivision with City Engineer's report, Deed of Dedication, and City Plan and Program Commission's resolution of approval and recommendation for Council approval, be received, placed on file and "A resolution approving the Preliminary Plat of Southland Park Replat of Part of Southland Park Sub -Division", adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24836. 70944 - There was a lengthy discussion on median cuts, stacking lanes, traf- fic control, additional 10' of easement, need for traffic informa- tion, etc. - Moved by Getty, seconded by Dowie that communication from City Plan and Program Commission, transmitting site plan for Marc's Big Boy at the Northerly Corner of Sears Street and Crossroads Boulevard, and recommending approval subject to (1) denial of a certain future Median Cut "B" on attached Sheet "B", and (2) increasing present 30' ease- ment parallel to Crossroads Boulevard to 40°, and on Council's own motion, be received, placed on file, approved, date of hearing set as November 15, 1976 at 7:00 P.M. in City Hall, Clerk instructed to publish notice and the Council to inspect this area. Motion carried. 70945 - Moved by Getty, seconded by Geiger that "An Ordinance amending Ordin- ance No. 2644, known as the Traffic Ordinance, by repealing Subsect- ions (225) Poplar Street and (239) Riehl Street of Section 551, Park- ing Prohibited At All Times on Certain Streets, and enacting in lieu thereof new Subsections (225) Poplar Street and (239) Riehl Street; and also by adding to Section 551 new Subsections (32a) Bryant Avenue, (164a) Lindale Avenue, (181a) Maplewood Street, and (207a) Norwood Avenue", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 70946 - Moved by Getty, seconded by Lichty that the rules requiring ordinances to be received, placed on file, considered and voted on at two prior meetings, be suspended, the above Ordinance recorded as having been considered and passed for the second and third times, and now placed on its final adoption. Ayes: Seven. Motion carried. 70947 - Moved by Roehr, seconded by Wilharm that "An Ordinance amending Ordin- ance No. 2644, known as the Traffic Ordinance, by repealing Subsections (225) Poplar Street and (239) Riehl Street of Section 551, Parking Prohibited At All Times on Certain Street, and enacting in lieu there- of new Subsections (225 ) Poplar Street and (239) Riehl Street; and also by adding to Section 551 new Subsections (32a) Bryant Avenue, (164a) Lindale Avenue, (181a) Maplewood Street, and (207a) Norwood Avenue", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2852. 70951 - Moved by Bowers, seconded by Dowie that "An Ordinance amending Ordin- ance No. 2644, known as the Traffic Ordinance, by repealing Subsection (216) Park Lane, of Section 551, Parking Prohibited At All Times On Certain Streets, and enacting in lieu thereof new Subsection (216) Park Lane, and also by adding Subsections (9a) Anthony Street, (18a) North Barclay Street, (52a) Cottage Street, (69b) Edgewood Drive, (94a) Fleur Drive, (133a) Ingersoll Road, (197a) Monterey Drive,(210a) Onawa Drive, (255a) Shilliam Avenue, (259a) Southview Drive, (280a) Valdez Drive, and (303a) Wren Road, to Section 551", be received, placed on file, considered and passed for the first time. Resolution adopted and upon approval by _Mayor, assign- ed No. 24837. 70953 - Moved by Roehr, seconded by Bowers that communication from Mayor Rooff submitting for Council approval the appointment of Ed Stanhope, 176 San Souci Drive, to the Riverfront Commission, to fill the unexpired tetuw of Fred Hagy which expires on January 1, 1979, be received, placed on file and approved. Motion carried. 70954 - Moved by Bowers, seconded by Geiger that following requests for per- mission to attend functions, with expenses allowed not to exceed a- mounts shown, be received, placed on file and approved; Supt. of Sewers to Iowa Chapter American Public Works Association meeting, Ames, Iowa, November 11 and 12, 1976, $65.00 plus use of City car; Supt. of Water Pollution Control Plant and Assistant to Advanced Water & Waste- water Works Operators Education Course, Iowa City, Iowa, November 8, 9 and 10, 1976, $125.00 each plus use of City car; City Clerk to Iowa Municipal Finance Officers Association Semi -Annual Meeting, Des Moines, Iowa, October 27 and 28, 1976, $132.00.
